’56 Inch’ Modi Sarkar received a ’56 Page Shock’ on RafaleScam !

Modi Government has made lies, falsehood, deceit, treachery and fakery the foundation of its defence in the Rafale Scam. Their ‘Defenseless’ Defence Minister, Smt. Nirmala Sitharaman&‘Lawless’ Law Minister, Shri Ravi Shankar Prasad’s fallacious arguments and bogus spins could not save the day for them after the Supreme Court order to hear the Rafale Case, afresh based on new evidences and documents.

The media managers of the Modi Government sounded like ‘cacophonous cry-managers’, desperately trying to spin something out in order to climb out of the well of deception that they had plunged themselves into. Sadly, their arguments were drowned by the loud noises of the people of India who are echoing the same sentiment across board i.e – एकहीचौकीदारचोरहै !

On March 7 2019, Modi Govt’s Attorney-General told the Supreme Court those “secret” documents published by a newspaper and some magazines on the purchase of 36 Rafale jets were “stolen” from the Ministry of Defence. On the very next day, in a bizarre claim the Modi Govt claimed that these ‘published’ documents were only “photocopies”. After yesterday’s Supreme Court judgement- both these assertions are conclusively punctured.

There are 3 Sets of Documents, which the Modi Government wanted to hide from the Supreme Court.

FIRST DOCUMENT:On 24 Nov 2015; Defence Secretary wrote to the then Defence Minister Manohar Parrikar stating that PMO be advised to not conduct parallel negotiations on Rafale Deal as this compromises and undermines the Indian Negotiations Team (INT).[Attached A1]

This raised several important questions.

Q1 – Why was PM Modi holding parallel negotiations undermining India’s interests?

Q2 – Why did Modiji bypass the Indian Negotiation Team to waive off the condition of Sovereign Guarantee or a Bank Guarantee?

Q3 – Did it not compromise India’s interests as over Rs 30000 Cr that would be paid in advance without delivery of a single aircraft?

Q4 – What was the ‘quid pro quo’ for PM Modi to compromise India’s interests by waiving off the Sovereign Guarantee/ Bank Guarantee?

Statement of French President Francois Hollande dated 21 September 2018 is was verified by this; that Modiji’s ‘New Formula’ of directly negotiating Rafale Deal was to ensure an award of aRs 30,000 Cr contract to his crony friend ‘Double A’, by snatching it from HAL.

It is clear that PM Modi lied to Supreme Court also and misled it. In the affidavit before Supreme Court, particularly para 24, 25, 27 ;Modiji said that negotiations on Rafale Deal were held by the Indian Negotiations Team (INT). Defence Ministry file notings now show otherwise. Parallel negotiations were actually held by PM Modi himself.  This fact was deliberately withheld from the Supreme Court.

SECOND DOCUMENT: Note 18 of MoD, August 2016: It records NSA Shri AjitDoval’s meetings with the French side in Paris on January 12-13, 2016. The note, prepared by the Air Wing of the MoD, records that Shri Parrikar, on the basis of Shri Doval’s negotiations outside the ambit of the negotiating team, directed that recommendation on waivers in clauses for Sovereign Guarantee and Arbitration be placed for consideration of the Cabinet Committee on Security instead of the Defence Acquisition Council which is the Competent Authority. [Annexure A2]

NSA was negotiating the Rafale Deal, and not the ‘Negotiations Committee’ of IAF & the Defence Ministry. Did PM Modi ask him to do so and for what reason?

• On 12/13.1.2016, NSA, Shri AjitDoval negotiated the Rafale Deal in Paris.
• On 7.03.2016, the then Defence Minister recorded about a meeting held by NSA with the French side in Paris to negotiate the Rafale deal.
• In August, 2016, The ‘Negotiations Committee’ headed by Deputy Chief of Air Staff submitted its report.

Simple question is, why was NSA, Shri AjitDoval negotiating the Rafale Deal in Paris and under whose authority?

THIRD DOCUMENT: The Dissent Note of the Indian Negotiating Team (INT) of June 1, 2016, which records objections of three members of the Indian Negotiating Team on various aspects of the deal. This note, which detailed ten objections, was appended to the final report of the Indian Negotiating Team.

Q2 – Did PM Modi ignore total 25% discounted price offered by Eurofighter, paid more?

Q3 – Did PM Modi waive crucial Bank Guarantee, even though cost was negligible?

Q4- Did PM Modi abandon ‘Sovereign Guarantee’/‘Bank Guarantee’ in exchange of only ‘Letter of Comfort’?

Q5 – Did India pay exorbitantly high price for Cost of ‘India Specific Enhancements’/’Design & Development’as compared to Congress deal?

Q6- Did PM Modi agrees to a longer delivery schedule than the UPA deal, which was flagged by the INT?

From day one, Modi Govt’slied in the Supreme Court.

Modi Govt mischievously lied to the Supreme Court when they said that the CAG report on the Rafale’s pricing had been made public and examined by the Public Accounts Committee, a statement that was denied swiftly by PAC Chairman Shri MallikarajunKharge

In the light of the above documentary evidence, it is crystal clear that set procedures have not been followed in the Rafale Deal and ‘Crony Capitalism’ has become the backbone of this scam. Therefore, A JPC Investigation is the only possible solution to ascertain the real culprits.

After 23 May 2019, when Congress will come to power, we shall order a JPC probe into the Rafale Scam.

Dr. Singhvi said – so, friends, in a nutshell, this is a ‘Jumla’ sarkar, a ‘Feku’ sarkar, this is a Sarkar of deceit, treachery and of trying to fool all the people all the time including institutions like the Supreme Court. I think the writing is on the wall before them and they shall see it not too much later.

May I add one thing before you ask the questions – are we entitled or not entitled, I ask you and my answer is Yes to seek the resignation of a exalted Ministers like the Defence Minister and the Law Minister who have tried to suppress these documents by calling them stolen documents and so instructing the Law Officer of the court to argue. Today when the Court has held that these are documents from the (a) file – so stolen does not mean it is fabricated. Stolen does not mean that I have made them up or I have forged them; (b) these are in the public domain and were tried to be suppressed by you by calling it stolen. You were not before media, you were not before me, you were not even in elections, you were before the Supreme Court. So is it not an act of deceit to say to the Supreme Court and seek to suppress by recharacterizing them as stolen and therefore, I think the resignation of people who called them stolen and repeatedly asserted they were stolen should be called for, should be in order.

Dr. Abhishek Singhvi quoted the MHA statement– “MHA has not yet received any letter regarding the alleged breach in security of Congress President Shri Rahul Gandhi.  However, as soon as MHA’s attention was drawn to reports that there was an incident of “green light” being pointed at him yesterday in Amethi, the Director (SPG) was asked to verify the factual position.  Director (SPG) has informed MHA that they have gone through the Video Clipping of the incident very closely.  The “green light” shown in the clipping was found to be that of a mobile phone used by the AICC photographer, who was videographing the impromptu press interaction of Shri Rahul Gandhi near the collectorate at Amethi.  Director (SPG) has also informed MHA that this position was conveyed to the personal staff of Shri Rahul Gandhi.  Dir (SPG) has confirmed that there was no security implication whatsoever. ” So, there is no letter, there is no complaint. Let me make it very clear that the obligation of security, especially, during election time and in particular for a SPG protectee is squarely on the SPG, on the security forces and ultimately in some sense on the MHA. I have no doubt that they are aware of their responsibility to discharge their duties as the ultimate protector just like they would discharge of every other SPG protectee, be it the Head of the Congress Party or the Prime Minister of this country or any other Head of any other party, who has SPG protection.

On Electoral Bonds, Dr. Singhvi said let me start by telling you very quickly, you have got our official statements on record about Electoral Bonds. More than two years ago or 2-1/2 years ago, I was myself part of the group which drafted the representation to the Finance Minister and to the Election Commission from the Congress Party saying this is cheating, this is fraud, this is facilitating unilateral contributions without transparency.

डॉ. अभिषेक मनु सिंघवी ने पत्रकारों को संबोधित करते हुए कहा कि दो मुद्दों पर मैं ध्यान आकर्षित करना चाहता हूं। पहला मुद्दा राफेल से संबंधित है,  सुप्रीम कोर्ट ने राफेल पर मोदी सरकार का झूठ पकड़ा है और कागजात की चोरी करने वाले बहाने को तगड़ा झटका लगा है। 56 इंच की मोदी सरकार को राफेल घोटाले का 56 पेज का शॉक लगा है, क्योंकि कागजात कई पन्नों के हैं। अपना पूरा आधार, नींव बेबुनियाद, झूठ, बरगलाने की प्रकिया, फेक तथ्यों को आपके सामने रखना, इन सबके लिए चाहे बिना डिफेंस वाले डिफेंस मिनिस्टर आ जाए, या स्पिन मास्टर कानून मंत्री आ जाएं, सच्चाई छुप नहीं सकती, सच्चाई आपके सामने है और दिन-प्रतिदिन ऊभर कर आ रही है। इन सारी सच्चाई का एक ही फोकस है, सब लोग एक आवाज में कह रहे हैं कि एक ही चौकीदार चोर है। 

अब आप जानते हैं कि उच्चतम न्यायालय में 3 मुख्य दस्तावेज थे, जिसके विषय में कल का आदेश आया है, वो बातें मैं दोहराऊंगा नहीं, ये भी नहीं दोहराऊंगा कि अटार्नी जनरल ने किस प्रकार से कहा कि ये चुराए हुए दस्तावेज है, इनमें ये कानून लगता है, इनमें वो कानून लगता है, इत्यादि-इत्यादि। मुद्दे की बात ये है कि उन तीन दस्तावेजों पर कुछ प्रश्न पूछने की आवश्यकता है।

पहला दस्तावेज है – 24 नवंबर, 2015 का, जब रक्षा सचिव ने लिखित रुप से और रक्षा सचिव लिखित रुप से अपने मंत्री, यानि रक्षा मंत्री को बहुत कम बार लिखेगा कि कृपया रक्षा मंत्री जी पीएमओ को कहिए कि साथ-साथ पैरलल नेगोसिएशन ना करें, ये अपने आपमें बहुत कम, तब ही होता है जब पानी हद से ऊपर निकल जाता है, तब रक्षा सचिव लिखता है, रक्षा मंत्री को, पीएमओ के विषय में। ये एक दस्तावेज था, जिसको उच्चतम न्यायालय में सरकार द्वारा छुपाने, लुकाने, दबाने, थ्रेट करने का प्रय़त्न किया था। तो हमारे प्रश्न उस दस्तावेज पर हैं कि मूल मुद्दा यह है कि क्यों पीएमओ में ये पैरलल नेगोसिएशन चल रहा था?

दूसरा प्रश्न है- सब जानते हैं और सबसे अहम पीएमओ और माननीय मोदी जी जानते हैं जो पीएमओ के ऊपर बैठते हैं कि इंडियन नेगोसिएशन टीम है, जो ये सब बातें उसी समय, उसी दिन, उसी वक्त कर रही है, तो उनसे बिना पूछे, उनको पहले बताए 2 चीजें सॉवरेन गारंटी भी, बैंक गारंटी भी कैसे वेव हुई? ये दस्तावेज लिखित है। सबसे ऊपर होती है सॉवरेन गारंटी, चलिए वो देश या सरकार ना माने, तो बैंक गारंटी होती है, उससे नीचे होती है। यहाँ पैरलल नेगोसिएशन में दोनों को हटा दिया और कंफर्ट लैटर को रखा गया, जिसे आप फाड़ कर कूड़ेदान में फैंक सकते हैं, ये उसका कानूनी अस्तित्व होता है।

तीसरा प्रश्न है- 30,000 करोड़ रुपए एडवांस पे करेंगे, पहला जहाज आने से पहले। ये भी मुद्दा उठाया है कि ये कैसे है कि आप 30,000 करोड़ रुपए रकम एडवांस दे रहे हैं, उसके खिलाफ बैंक गारंटी नहीं है, सॉवरेन गारंटी नहीं है, कुछ तो होना चाहिए हाथ में।

चौथा प्रशन है – ये सब किस कारण से हुआ, हमारा आरोप है कि कारण एक ही हो सकता है कि जल्दबाजी थी, कॉन्ट्रैक्ट आपको क्वीड प्रो के कारण जल्द लेकर अपने महत्वपूर्ण डबल OO 7,जैसे डबल AA को देना था। ये जल्दबाजी के अलावा इस प्रकार से अपनी नेगोशिएटिंग कमेटी में पीएमओ इंटरफेयर करे, ये हमने आज तक सुना नहीं और रक्षा सचिव पीएमओ के बारे में पत्र लिखें, ये भी बहुत कम सुना है। इस बात का एक प्रकार से पुष्टिकरण हुआ, जब ओलांद, जो उस देश के पूर्व राष्ट्रपति हैं, उन्होंने कहा था कि हमें तो बोला गया कि एच.ए.एल. को नहीं किसी और को देना है, आपको याद है ये हमने यहाँ से दिया है। इसका सीधा पुष्टिकरण होता है। आज एक बात पक्की है, आपने उच्चतम न्यायलय से जरुर छुपाने की कोशिश की है कि पैरलल नेगोसिएशन हो रहे थे, अब उसका क्या जवाब है, क्या स्पष्टीकरण है, क्या जस्टिफिकेशन है, वो उच्चतम न्यायालय की अगली सुनवाई में कोई हलफनामे में मनघढ़ंत, अजीबो-गरीब कहानी बनाई जाएगी, वो सामने आएगी। लेकिन एक बात जरुर है कि इतने बड़े कॉन्ट्रैक्ट में एक प्रकार से आप नेगोसिएशन टीम को सुपरसीड़ कर रहे थे।

दूसरा दस्तावेज है, उतना ही अजीबो-गरीब है, ये बताईए कि आपने कब सुना है कि राष्ट्रीय सुरक्षा सलाहाकार नेगोशिएटिंग टीम का हिस्सा होता है या नेगोसिएशन में हिस्सा लेते हैं, ना उनके अधिकार क्षेत्र में है, ना ट्रांजेक्शन ऑफ बिजनेस रुल में है, ना हमने पहले कभी सुना। पहले भी बीजेपी के राष्ट्रीय सुरक्षा सलाहाकार रह चुके हैं। 

तो दूसरा प्रश्न है – अगस्त, 2016 की जो फाइल नोटिंग है, जो रिकोर्ड करता है कि इसी मुद्दे पर, इसी टांजेक्शन पर, इसी नेगोसिएशन में एनएसए अजीत डोभाल साहब फैंच साइड से मिलकर12 और 13 जनवरी, 2016 में बातचीत कर रहे हैं। भारत सरकार एक तरीके से चलती है, सीधा अगर वो पैराशूट करके, वो अगर राष्ट्रीय सलाहाकार है, तो भी वो सीधा नहीं पहुंच सकता और वो भी अत्यंत महत्वपूर्ण है और अन्य ऐसे कई प्रावधान जो भारत को सुरक्षित रखते हैं, उनको हटाते हैं, विशेष रुप से आर्बिट्रेशन कहाँ होगा, अगर झगड़ा होगा तो आर्बिट्रेशन यहाँ होगा या विदेश में होगा? इस देश में ना कैबिनेट कमेटी ऑन सिक्योरिटी है, ना डिफेंस एक्विजिशन काउंसिल है, सब निरस्त हो गई है क्योंकि मोदी जी की सरकार में सीधा राष्ट्रीय सुरक्षा सलाहकार ऊपर से ये सब कर सकता है।

तो प्रश्न है कि किस आधार पर, ट्राजेक्शन बिजनेस रुल से, किस आधार पर, किस पत्र से, किस अधिकार क्षेत्र से श्री अजीत डोभाल जी वहाँ थे, 12,13 जनवरी, 2016 को?

दूसरा प्रश्न है कि  रक्षा मंत्री ने रिकॉर्ड किया है, 7 मार्च, 2016 की मीटिंग में कि एनएसए ने, यानि डोभाल जी ने पेरिस में नेगोशिएट किया है, ये रिकोर्डिड है।

तीसरा, अगस्त, 2016 में नेगोसिएशन कमेटी ने अपनी रिपोर्ट दी, तो एक तरफ रिपोर्ट एक बॉडी दे रही है, दूसरी तरफ एनएसए साहब गैर कानूनी रुप से, बाहरी रुप से, किस रुप से इस प्रक्रिया में दुष्प्रभाव कर रहे हैं। इसका जवाब भी हमें चाहिए। ये बात भी उच्चतम न्यायालय से छुपाई गई थी, निश्चित रुप से हलफनामा में कोई ना कोई बहाना बनाकर जवाब दिया जाएगा। लेकिन आज देश ये जवाब मांगता है।

चौथा है, जिसको कहा गया था कि नेगोशिएटिंग टीम के एक हिस्से का मत था, आप जानते हैं कि नेगोशिएटिंग टीम में तीन सदस्यों ने बड़ा विस्तृत लिखा, और वो दस्तावेज आपके सामने है, आपको डर, भय नहीं होना चाहिए कि ऑफिशियल सीक्रेट एक्ट है कि मैं हूं या आप हैं, बीजेपी वाला है जो आपको प्रभावित करेगा, ये सब पब्लिक डोमेन में है जो उस वक्त धमकी देकर दबाने की कोशिश की गई थी। तो इस कागज में लिखा है कि तीन व्यक्ति लिखते हैं –

पहला, कि सबसे गंभीर यही है, बेंच मार्क प्राईस 55 प्रतिशत से बढ़ गई है, बढ़नी नहीं चाहिए, क्यों? ये वो लिख रहे हैं, प्रश्न पूछ रहे हैं, अपने कर्तव्य का निर्वाह कर रहे हैं।

दूसरा, और लोग हैं जिन्होंने बिड किया है, उनके नाम लिखे हैं, एक यूरो फाईटर है, जिसने डिस्काउंट दिया है, 25 प्रतिशत का लिखित रुप से, क्या आप, यानि वो तीन लोग लिख रहे हैं बाकी समिति के लिए, क्या आपने इस ऑफर को अकाउंट किया है या नहीं? एक तरफ आपकी कीमत 55 प्रतिशत ज्यादा है, दूसरी तरफ आपने 25 प्रतिशत का डिस्काउंट फैक्टर इन किया है की नहीं? 

तीसरा, बैंक गारंटी की कुल 10-12 करोड़ की कोस्ट है, आप सोचिए। पूरी रकम की बैंक गारंटी तो होती है, अगर समस्या हो तो, लेकिन उसको बनाने की कोस्ट 10-12 करोड़ है, उस कोस्ट के लिए आपने वेव क्यों किया? हजारों, करोड़ की डील में बैंक गारंटी की 10-15 करोड़ की कोस्ट के लिए शर्त कैसे वेव हो सकती है? 

चौथा, ये अफसरों ने लिखा है, लैटर ऑफ कंफर्ट कहाँ से आ गया, कितनी डील हैं जिनमें लैटर ऑफ कंफर्ट किया है, अगर भारत सरकार लैटर ऑफ कंफर्ट में काम करना शुरु कर देगी, तो एक नया मापदंड बन जाएगा, मील पत्थर नया हो जाएगा। ये प्रश्न पूछा है।

पांचवा, जो इंडिया स्पेसिफिक एनहैंसमेंट के नाम बार-बार लिए जा रहे हैं, वो क्या हैं? क्योंकि कीमत 55 प्रतिशत से ज्यादा बताई जा रही है, हमने कहा 1500 करोड़ ज्यादा हैं, तो कुछ तो बताईए। ये बहाना कि बताएंगे तो राष्ट्रीय सुरक्षा कॉम्प्रोमाईज हो जाएगी, मजाक है। आप डिटेल थोड़ी दे रहे हैं।

अंतिम प्रश्न, जो हम नहीं पूछ रहे हैं, ये प्रश्न आपकी फाइल में, आपकी समिति ने पूछा है कि जो डिलिवरी की समयसीमा है, वो पुराने यूपीए के ड्राफ्ट डील से कहीं ज्यादा है, ये क्यों है? ये मान सकते हैं कि समय सीमा बढ़ा दीजिए, पैसे कम कर लीजिए, पैसे बढ़ा दीजिए, समय सीमा कम कर दीजिए। ये दोनों को थोड़ा परिवर्तित करके बैंक गारंटी ले लीजिए, ये आदान-प्रदान होता रहता है। लेकिन ये तो एक ऐसा दस्तावेज है जो बताता है कि हर मापंदड में भारत को इस सौदे में मुंह की खानी पड़ रही है। ये सब चीजें याद रहें, ये दो-तीन दिनों के लिए बहस हुई थी, तब ये सब कहाँ थे? ये तो देश के लिए सौभाग्य की बात है कि ये आप लोगों के जरिए, उन याचिकाओं के जरिए पब्लिक डोमेन में आग गए, नहीं आते तो ये सामने नहीं आते। जब ये आ गए तो उसके बाद अटॉर्नी जनरल के द्वारा झूठ, चोरी का इल्जाम, ऑफिशियल सीक्रेट एक्ट का इल्जाम लगाया गया। ये तो गनीमत है कि ये कोर्ट ने निरस्त किया, नहीं तो ये आज पहले खुद नहीं लाए, खुद ने सप्रेस किया, दूसरा लाया उसको धमकाया और छुपाने का प्रयत्न किया। निश्चित रुप से चोर की दाढ़ी में तिनका नहीं है, पूरी दाढ़ी ही तिनकों की है। तिनके ही तिनके हैं। क्योंकि 10-12 तिनके तो मैंने आपको दिखा दिए।

राफेल के मुद्दे पर न्यायालय की अवमानना के बारे में पूछे एक प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि याचिका कर दें, कंटेम्प्ट ऑफ कोर्ट में अर्जी डाल दें, 30 सैंकड लगते हैं, हिम्मत तो करें, मैं तो वापस चुनौती दे रहा हूं। अभी तो आप खुद कंटेम्प्ट से बचे नहीं है। आपने तीन कागजात सप्रेस किए, आपने फाइल नहीं किए और हमारे ऊपर कंटेम्प्ट का इल्जाम लगा रहे हैं। कागजात सप्रेशन का अगर कंटेम्प्ट होता तो कंटेम्प्ट उनके विरुद्ध होगा। तीन कागजात आप फाइल ही नहीं करते हैं, जो लोग फाइल करते हैं, उनको कहते हैं कि चोरी वाले कागजात है और कहते हैं ऑफिशियल सीक्रेट है। आज जब सुप्रीम कोर्ट ने आपकी अर्जी निरस्त की है तो कहते हैं कंटेम्प्ट हमने किया है। क्या मजाक की बात है।

एक अन्य प्रश्न पर कि सुप्रीम कोर्ट ने यह नहीं कहा कि चौकीदार चोर है, डॉ. सिंघवी ने कहा कि सुप्रीम कोर्ट नहीं कहता है कि चौकीदार चोर है।

एक अन्य प्रश्न पर कि प्रधानमंत्री जी ने कहा है कि कांग्रेस अध्यक्ष श्री राहुल गांधी बार-बार इसलिए राफेल का मुद्दा उठा रहे हैं क्योंकि उन्हें कहीं ना कहीं जो बात उन्होंने की है, उसको छुपाना चाहते हैं, डॉ. सिंघवी ने कहा कि जिस व्यक्ति, जिस प्रधानमंत्री ने दो वर्ष से करीब-करीब राफेल में चुप्पी साधी है। नंबर दो, जिस प्रधानमंत्री ने कभी भी राफेल के तथ्यों पर बोला नहीं, वो अचानक चुनाव के दौरान चले आते हैं और बिना किसी तथ्य के ऐसे भद्दे आरोप लगाते हैं तो कैसे कहा जाए कि ऐसे व्यक्ति प्रधानमंत्री जैसे उच्चतम पद को होल्ड करने के लायक हैं। आपने दो वर्ष में राफेल के तथ्यों के विषय में इस प्रधानमंत्री से क्या सुना है? अगर उनको थोड़ा भी इसमें संदेह है, संकोच है तो राहुल गांधी जी ने बार-बार कहा है कि गाली दो, लेकिन राफेल पर डिबेट करो। ये तो भद्दी गाली है ना, तो आप गाली देते रहो, आपको शौक है गाली देने का, आपको शौक है तथ्यों से दूर भागने का। आप राहुल गांधी जी से डिबेट क्यों नही करते, एक भी तथ्य पर आपने दो वर्ष से देश में डिबेट नहीं की।

चुनाव आयोग द्वारा ईडी और आयकर विभाग को कार्यवाही से पूर्व सूचना देने से संबंधित निर्देश पर पूछे एक अन्य प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि चुनाव आयोग की सीमाएं, लाचारी हम सब समझते हैं। बहुत सारी चीजें इवैंट के बाद ही कर पाते हैं, लेकिन चुनाव आयोग को सख्त से सख्त रुख अख्तियार करना चाहिए, क्योंकि दो-तीन मुद्दे बड़े स्पष्ट हैं। 70-72 वर्ष में इस देश मे चुनाव पहले भी हुए हैं, दुराव, भेदभाव पहले भी हुआ है, राजनीतिक पार्टियां पहले भी जबरदस्त लड़ी हैं, लेकिन 73 वर्ष में आपको, हमको, किसी और को कभी याद है कि चुनाव के दौरान उस 40 दिन की समयसीमा के अंदर इस प्रकार की रेड हुई हैं? दूसरा, इन दिनों जो 15 या 16 रेड़ आपने प्रकाशित की हैं या हुई हैं उन सबमें दूध से नहाए सफेद सिर्फ एक पार्टी के ही लोग हैं, जो सुबह-शाम तुसी ग्रेट हो बोलते हैं और काले वो विपक्ष के लोग हैं अखिल भारतीय स्तर पर, सब गलत काम वही करते हैं। तीसरा, 100 य़ार्ड दूर अरुणाचल प्रदेश में, मुख्यमंत्री अरुणाचल प्रदेश, उप-मुख्यमंत्री और सत्तारुढ पार्टी के मंत्री कमरे में, गेस्ट हाउस से 100 यार्ड दूर पौने 2 करोड़ रुपए गाड़ी में मिलता है। दो दिन बाद चुनाव आयोग एफ.आई.आर. जरूर करती है और उसके साथ-साथ कोई व्यक्ति आता है और कहता है ये मेरा पैसा है। इंकम टैक्स नहीं होता, वो तो लुप्त और सो रहा है। कुंभकरण की नींद सो रहा है क्योंकि यहाँ तो सत्तारुढ़ पार्टी के मुख्यमंत्री हैं। पैसा बरामद होता है, कोई आदमी दो दिन बाद आकर कहता है कि ये मेरा पैसा है। ये क्या हो रहा है इस देश में और अगर समतल जमीन, लेवल प्लेईंग फील्ड जो हमारे बेसिक स्ट्रक्चर का अभिन्न अंग है, मूल ढांचे का अभिन्न अंग है, वो संविधान से भी ऊपर है। संविधान संशोधन भी असंवैधानिक हो सकता है, अगर मूल ढांचे का उल्लंघन करे। अगर आप समतल जमीन के आधार पर, मैं सत्तारुढ़ पार्टी, यंत्र-तंत्र का दुरुपयोग करके आप पर दुष्प्रभाव डाल सकता हूं, रेड कह लीजिए, ईडी कह लीजिए, सीबीआई कह लीजिए तो बेसिक स्ट्रक्चर का उल्लंघन हो रहा है तो जो चुनाव आयोग ने किया है, वो जैसा अंग्रेजी में कहते हैं too little too late  है। It is too little too late. They have to act with lightening speed and they have to set example.  तो सिर्फ ये कह देना कि हमें खबर करके करो, ये भी देखना पड़ेगा कि रेड़ अचानक जो हो रही हैं, सिर्फ एक पक्ष के विरुद्ध चुनाव के दौरान पक्षपात हो रहा है तो ऐसा होना ही नहीं चाहिए।

कांग्रेस अध्यक्ष राहुल गांधी जी की सुरक्षा पर पूछे एक अन्य प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि पहले आप एक बात समझ लीजिए कि कांग्रेस ने कोई पत्र नहीं लिखा है। मैं वो ढूंढ रहा हूं जो वक्तव्य आया है होम मिनिस्ट्री का, वो मैं आपके लिए पढ़ देता हूं, कांग्रेस ने कोई पत्र नहीं लिखा है, ये स्पष्ट कर दूं। होम मिनिस्टर ने बड़ा संतुलित और बड़ा व्यापक और बड़ा स्पष्ट उत्तर दिया है, आप चाहें तो पढ़ दूं या आपके पास होगा।

इसी संदर्भ में डॉ. सिंघवी ने कहा कि ये तो आपको मालूम करना पड़ेगा कि कौन सा कैमरामैन है, मैंने आपके सामने वक्तव्य पढ़ दिया है। मैंने आपको साफ बोल दिया कि कांग्रेस ने कोई पत्र नहीं लिखा, लेकिन हमारे बोलने से ज्यादा जरुरी है कि आपने पहला वाक्य शायद नहीं सुना कि मिनिस्ट्री ऑफ होम अफेयरस का, जो सरकार संभाल सकती है, उसमें लिखा है – “MHA has not yet received any letter regarding the alleged breach in security of Congress President Shri Rahul Gandhi.  मैं भी तो यही कह रहा हूं। मैंने 4 बार नकार दिया है कि कांग्रेस ने कोई पत्र नहीं लिखा है। जब मैं बोल रहा हूं कि पत्र नहीं गया है, चिठ्ठी नहीं लिखी गई है तो उसके क्या मायने है कि वो चलाया जा रहा है, चल रहा है, आ रहा है, इसका मतलब क्या हुआ?

ईवीएम पर पूछे एक अन्य प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि आज पहला दिन है, एक प्रकार से 91 के आस पास व्यापक संख्या है। इसलिए एक प्रकार से आज अच्छा दिन है, एक अच्छा अवसर है कि सभी को और विशेष रुप से चुनाव आयोग को सब चीजों को नोट करना चाहिए, जो आज हुई हैं या नहीं हुई हैं और 7-8 चरण के चुनाव में ये दोहराया ना जाए। मेरे पास कई विचित्र और बहुत गंभीर शिकायतें हैं। इसकी सूची होगी जो हम आपको बाद में देंगे। लेकिन दो-तीन उदाहरण दूं, बिजनौर में बूथ नंबर 16 में जब कांग्रेस का बटन दबता था तो कमल पर वोट जाता था। ये स्पष्ट चीज मैं आपको बता रहा हूं, नाम के साथ और जगह के साथ। दूसरा, कांग्रेस का सिंबल जो बटन वाला है, वो पुंछ में, जम्मू और कश्मीर के पुंछ में लोकसभा में काम नहीं कर रहा है, इसका ट्वीट हुआ है, उमर अब्दुल्ला ने भी किया है, और लोगों ने भी किया है। तीसरा, उत्तर प्रदेश में, मुजफ्फरनगर में सैंकड़ों नाम मिसिंग हैं, इसका आरोप आ रहा है, कई नामों का। चौथा – ये बड़ा महत्वपूर्ण है क्योंकि शोभना कामिनी अपोलो अस्पताल की चीफ हैं और रेड्डी परिवार की बहुत वरिष्ठ सदस्य हैं, वो कहती हैं ‘I feel cheated as a citizen, does my vote not count?‘,क्योंकि हैदराबाद की लिस्ट से वो गायब हैं। नागालैंड के उप मुख्यमंत्री उनका नाम है वाई. पैटन, वो देखे गए हैं बीजेपी का स्कार्फ पहन कर, बीजेपी फॉर इंडिया का स्कार्फ है और बूथ पर खड़े हैं, 8 बार ईवीएम का बटन दबा रहे हैं। ये जो वोटर लिस्ट मिलनी चाहिए ये बाहर छाप कर बीजेपी वर्कर ले रहे हैं, ये उत्तराखंड में देहरादून के निशंक जी के विषय में। तो ये सब चीजें उदाहरण हैं लेकिन गंभीर हैं, बिखरी हुई हैं भारत के पूरे उत्तर-दक्षिण भागों में। अत्यंत महत्वपूर्ण हैं और तुरंत बहुत स्ट्रोंग एक्शन लेना चाहिए, इऩका तो लेना ही चाहिए इस केस में तो, लेकिन भविष्य के लिए किसी और चरण में ना दोहराई जाएं, यह भी सुनिश्चित किया जाना चाहिए।

 एक अन्य प्रश्न पर कि वीएचपी ने कहा कि वो राम नवमी के दिन पश्चिम बंगाल में शोभा यात्रा निकालेंगे, डॉ. सिंघवी ने कहा कि वीएचपी अगर ये कहती है तो मैं ये पूछता हूं कि अपने हृदय पर हाथ रखिए और खुद से पूछिए कोई अंधा, अराजनैतिक, नासमझ व्यक्ति भी कहेगा कि इसका उद्देश्य एक ही है। इसका उद्देश्य एक ही है कि कानून तो कोई मायने रखता नहीं, सेक्शन 120 (6), Representation of the  Peoples Act तो मायने नहीं रखते, चुनाव आयोग की गाइड लाइन मायने नहीं रखता, हमारे जो बेसिक सुप्रीम कोर्ट के 10 जजमेंट हैं, वो मायने रखती नहीं। लेकिन सिर्फ दोराव, मतभेद और मदभेद और आईपीसी का ऑफेंस है, करने के लिए इसका उद्देश्य स्पष्ट हो जाता है। दो बातें मैं आपको बता दूं, जो आपको मालूम नहीं, ये रथयात्रा के नाम से पिछले वर्ष जुलाई में प्रयत्न शुरु किया था बीजेपी में। मैं खुद उसमे वकील था, पश्चिम बंगाल सरकार में। 5 बार प्रयत्न किया है और हमेशा उच्च न्यायालय, सुप्रीम कोर्ट से, मुंह की खानी पड़ी है। मैं इसलिए कह सकता हूं क्योंकि मैं कोलकाता में पेश हुआ और यहाँ पेश हुआ। आखिरी बार 1 फरवरी, 2000 में मुंह की खाई थी, याचिका का नाम बीजेपी था, वीएचपी नहीं था। फरवरी से वो चुप हैं। परसों एक नई याचिका लगाई जो कल लगी है उच्चतम न्यायालय में कि हमें अनुमति दी जाए, इस चीज की नहीं, इसी प्रकार की चीज की। जहाँ तक मुझे मालूम है, महानुभाव आने वाला है, जो पेश भी होंगे। आज एक याचिका लगी है कि कल जो याचिका लगाई है उसको विदड्रो करना चाहते हैं। तो ये हथकंडे हैं, ये चालाकियां हैं, ये तौर तरीके हैं एक माहौल बनाने का, लोगों को बरगलाने का, लोगों को कन्फ्यूज करने का, आपसी वैमनस्य फैलाने का, विभाजन करने का और दोगुली आवाज में बात करने का। कल क्या होगा, हमें नहीं पता लेकिन कल जो याचिका आई है, उसको विदड्रो करने के लिए एक और आज याचिका लगी है। मुझे ये इसलिए पता है क्योंकि इसमें मैं पेश हो रहा हूं।

ये ट्रांसपेरेंसी के विपरीत चीज है। ये हमारा लिखित प्रतिवेदन है वित्त मंत्री को। दूसरा, चुनाव आयोग का पुराना स्टेंड है पत्र में और उसके बाद उन्होंने कहा कि आप डोनेशन जरुर दो, लेकिन याद रखिए, पहले 20 हजार की डोनेशन की चुनाव आयोग अनुमति दे सकता था, विडंबना देखिए आप। 20 हजार के डोनेशन को चुनाव आयोग प्रश्न चिन्ह लगा सकता था। आज 20 करोड़, 200 करोड़ पर नहीं बोल सकता, क्योंकि ट्रांसपेरेंट है, क्य़ा ट्रांसपेरेंट है? तीसरा, इसलिए चुनाव आयोग ने कहा कि इसमें जीरो ट्रांसपेरेंसी है, ये बात सही है कि इंकम टैक्स रिटर्न में आएगा, लेकिन क्या आप इंकम टैक्स रिटर्न को आरटीआई में देख सकते हैं, क्या इंकम टैक्स रिटर्न को खुद जाकर एक्सेस कर सकते हैं? चौथा, सबसे महत्वपूर्ण, प्रकाशित है कि सब पार्टी को मिलाकर भारत में इलेक्ट्रोल बांड 10 प्रतिशत से कम मिला है, बीजेपी को अकेले 90 प्रतिशत मिला है और आपको पता नहीं इन्होंने दिया है, इन्होंने दिया है और ये भी नहीं पता कि इनके देने और इनके देने की एवज में सरकार ने क्या काम किया। बड़ी मजेदार पारदर्शिता है ये तो, इसलिए सुप्रीम कोर्ट ने बड़े कठोर शब्दों का इस्तेमाल किया है और कहा है यह कि कालेधन को सफेद करने का तरीका है, ये मेरे शब्द नहीं है, ये सुप्रीम कोर्ट के शब्द हैं। कालेधन को सफेद करने का तरीका है, ये आज का है। आदेश नहीं है लेकिन ये कोर्ट में टिप्पणी हुई है। इसलिए मैं समझता हूं कि पूरे देश को बार-बार बरगलाने का प्रयत्न करना ये जो सरकार है, जिसको महान प्रधानमंत्री कहते हैं कि हम तो दूध के धुले हैं, ये सब क्या हो रहा है? पूरे भारत की सभी पार्टियों को एकसाथ जोड़कर 10 प्रतिशत से कम मिला है और उनको 90 प्रतिशत, किससे मिला है, फर्क नहीं पड़ता ये जानने में।

ड़ॉ. अभिषेक मनु सिंघवी ने पत्रकारों को संबोधित करते हुए कहा कि इन तथ्यों से बड़ा स्पष्ट है कि राफेल की जाँच से बचने के लिए चौकीदार ने सीवीसी को कठपुतली बना दिया है। अगर मोदी सरकार में रत्तीभर भी शर्म बाकी है तो तत्काल और हम ये कांग्रेस पार्टी की तरफ से ये मांग कर रहे हैं कि सीवीसी को तुरंत हटाना चाहिए। चाहें वो इस्तीफा दें या हटाए जाएं, निरस्त किए जाएं वो एक डीटेल की बता है, लेकिन इस प्रकार कि लुका छिपी, इस प्रकार की असंवैधानिक, कठपुतली वाला व्यवहार सीवीसी से अपेक्षित नहीं है। हाँ, Collaborator for violating the constitution (CVC) से जरुर ऐसी अपेक्षा की जा सकती है।

आज आपने क्या देखा है? आपने देखा है स्पष्ट रूप से कि ऑब्जेक्टिव तथ्य, जिनका आप और हम पुष्टिकरण कर सकते हैं, वो लिखित रुप से पब्लिक डोमेन में आए हैं। सीवीसी एक दूत बन गए हैं, अस्थाना के लिए। सीवीसी एक एजेंट बन गए हैं, एक नौकर बन गए हैं। सरकार के लिए एक संदेश ले जाने वाले मैसेंजर बन गए हैं। सरकार के सब गलत और काले कारनामे करने के लिए एक वकील बन गए हैं और सरकार में अस्थाना के लिए लॉबिस्ट बन गए हैं, जो अस्थाना को सपोर्ट कर रहे हैं।

ये ऑब्जेक्टिव तथ्य क्या हैं? जिनके पुष्टीकरण की भी जरुरत नहीं है, क्योंकि वो साफ पारदर्शी रुप से आपके सामने हैं। पिछले वर्ष एक तिथि को अक्टूबर में एक घंटे से ज्यादा सीवीसी मिलने गए सीबीआई डायरेक्टर आलोक वर्मा से, ये रिकॉर्डेड है, लिखित है। क्या इस मीटिंग की पुष्टिकरण करने की आवश्यकता है?, क्या ये किसी ने इसकी मनाही की है? क्या इसको किसी के द्वारा नकारा गया है? उसी एक घंटे की मीटिंग में बार-बार ये कहा गया कि All will be well, everything will be OK. ऐसा कहा गया है कि अस्थाना के खिलाफ जो सीबीआई डायरेक्टर द्वारा आरोपों की जो एंट्री है, उनकी सर्विस रिकॉर्ड में एंट्री है- अस्थाना की डाउटफुल इंटीग्रिटी वाली अगर उसको बदल दिया जाए, उसको सुधार कर दिया जाए। ये सब तो लिखित है, इसका भी तो डिनाइल नहीं आया अभी तक और मैं वापस स्पष्ट कह रहा हूँ कि इनमें से कुछ लिखित चीजें सौ प्रतिशत पटनायक जी को नहीं दिखाई गई होंगी। मैं इसके आगे आरोप लगा रहा हूँ कि इसमें पूरा संदेह है हमें कि इसमें से सौ प्रतिशत या 99 प्रतिशत उच्चतम न्यायालय को भी नहीं दिखाई गई। इससे जाहिर है कि आप जनहित के लिए, राष्ट्र हित के लिए विजिलेंस कमिश्नर नहीं हैं, आप विजिलेंस रखते हैं- आप सतर्कता रखते हैं सिर्फ अस्थाना के लिए और अस्थाना के राजनैतिक मालिकों के लिए, ये इस देश के लिए बहुत दुर्भाग्य की बात है ।

मैं याद दिलाऊँ कि ये वही सीवीसी है, जो 23 अक्टूबर को डेनमार्क जा रहे थे। अंतिम क्षण में अपनी यात्रा को निरस्त किया, कैंसिल किया। साढ़े आठ से 12 बजे रात तक बैठकर सिर्फ एक काम किया, सरकार के आदेश पर, प्रधानमंत्री जी के आदेश पर कि किस प्रकार से वर्मा को हटाना है, रोकना है। उस ऑर्डर को लेकर वर्मा को 1-2 बजे सर्व किया गया, रोका गया। अब रोचक बात सुनिए, वो हटाना तो उच्चतम न्यायालय ने निरस्त कर दिया इस आधार पर कि ऐसा सिर्फ समिति कर सकती है, सीवीसी नहीं कर सकता है क्योंकि सीवीसी न नियुक्त करने वाली संस्था है, न हटाने वाली। उसी  सीवीसी रिपोर्ट को आधार बनाकर, जिसको उच्चतम न्यायालय ने नहीं देखा था, क्योंकि उच्चम न्यायालय ने किसी और लीगल ग्राउंड पर हटाया था, उसी का आधार बनाकर वापस तुरंत प्रधानमंत्री जी की समिति ने टू-वन के आधार पर फिर हटा दिया। कौन सी रिपोर्ट है ये? कौन सी सीवीसी है ये? आप पहले वकील बनते हैं, दूत बनते हैं, एजेंट बनते हैं, संदेश वाहक बनते हैं, अस्थाना के और फिर अस्थाना के आरोपों को लेकर, रिपोर्ट में लिखकर उसकी रिपोर्ट बनाते हैं और वही पुलिंदा आपकी पैरवी का और अस्थाना के आरोपों का वही पुलिंदा समिति के निर्णय का आधार बन जाता है। मैं चुनौती दे रहा हूँ कि आपने पटनायक साहब को इसमें से कितना दिखाया, शेयर किया और मैं आगे चुनौती दे रहा हूँ कि हमारे पास कागजात नहीं हैं, लेकिन पूरा संदेह है कि इसका आंशिक रूप भी उच्चतम न्यायालय से शेयर नहीं हुआ होगा। तो ये हो क्या रहा है? हमने ‘केज पैरेट’ सुना है सीबीआई के बारे में, आज हम देख रहे हैं कि कोई नया एक सतर्कता का एजेंट और दूत सरकार का और अस्थाना का ‘New Vigilant Slave’ of the Government and Asthana has been born. हम कहना चाहेंगे बड़े स्पष्ट रूप से कि प्रधानमंत्री जी रामलीला मैदान से देश को, आम नागरिकों को बार-बार सच्चाई का दम्भ भरते हैं और संदेश देने का प्रयत्न करते हैं। रामलीला मैदान से वो ऐसी बातें करते हैं, क्योंकि मर्यादा पुरुषोत्तम राम को सच्चाई का प्रतीक माना जाता है। क्या ये आपकी सच्चाई की परिभाषा है? क्या आपकी सतर्कता, स्पष्टता, सच्चाई का द्योतक या मापदंड यही है? क्या आप सच्चाई को झूठ से हराने की कोशिश कर रहे हैं?

हम प्रधानमंत्री मोदी जी को बड़ा स्पष्ट कहना चाहते हैं, कि आपने तत्काल अगर सीवीसी को नहीं हटाया, तो आपका सच, पूरे देश के सामने बहुत जल्दी सामने आने वाला है।  

एक प्रश्न पर कि क्या कांग्रेस सीवीसी को हटाने का कोई अभियान चलाएगी के उत्तर में डॉ. सिंघवी ने कहा कि निश्चित रुप से हमने अभियान आज शुरु किया है। आपके जरिए शुरु किया है, क्योंकि खबर अभी आई है और आप ही लोगों से अपील करता हूँ। जब प्रेस ऐसी सूचनाएँ, ऐसे तथ्य प्रकाशित करती है। क्योंकि जो तथ्य है इसको अभी तक नकारा नहीं किसी ने। इसका निरंतर एक अभियान चलेगा, चलना चाहिए और हमारी बात नहीं, हमने तो उठाया है, देश का हर अंग ये जवाबदेही चाहता है, सिर्फ राजनैतिक पार्टी ही नहीं आम नागरिक भी इसकी जवाबदेही चाहता है।

किस प्रकार से ये कॉन्स्पिरेसी है, 23 अक्टूबर की रात से लेकर हर अंग को subordinate  करना, subvert करना, उसको पंगू बनाना, ये सरकार इसमें माहिर है।

एक अन्य प्रश्न पर कि जस्टिस सीकरी को पिछले महीने सरकार ने लंदन वेस्ड सीसैट ट्राईनल में उनको एक पोस्ट के लिए सिलेक्ट किया था और उसको स्वीकार भी कर लिया था जस्टिस सीकरी का सीबीआई डायरेक्टर के खिलाफ फैसला देना, कांग्रेस का क्या स्टैंड है के उत्तर में डॉ. सिंघवी ने कहा कि आप एक गंभीर मुद्दा उठा रहे हैं, मैंने अभी-अभी आते हुए देखा है, मेरे सहकर्मी इसके तथ्यों को जानकर हम आपके समक्ष होंगे, इसके विषय में, लेकिन मैं अभी कह नहीं पा रहा हूँ क्योंकि मेरे पास अभी तथ्य नहीं हैं, लेकिन हाँ, आपके मुद्दे के विषय में कांग्रेस पार्टी विचार करके आज या कल में आपके सम्मुख होगी।

उनकी आड़ में ये सब हो रहा है और इसलिए हमें कोई विश्वास या आशा नहीं है कि जिस कंधे की आड़ में आप ये गोलियाँ चला रहे हैं उसी कंधे को आप हटाएंगे और या वही कंधा अपने आप इस्तीफा देगा।

एक अन्य प्रश्न पर कि प्रधानमंत्री श्री नरेन्द्र मोदी ने बयान दिया है कि मोदी अच्छा काम कर रहा है तभी विरोधी अवसरवादी गठबंधन बना रहे हैं? विपक्ष के अंदर confidence नहीं है अकेले लड़ने का, के उत्तर में डॉ. सिंघवी ने कहा कि मैं समझ नहीं पा रहा हूँ कि ये विकृत कुतर्क क्या है? क्या इस देश में कभी भी गठबंधन सरकार बनी नहीं इससे पहले? क्या मोदी जी मजबूर, लाचार और बेकार बताते हैं उस सरकार को जिसमें मोदी जी की पार्टी जनता दल के साथ 1977 में जो शामिल हुई थी, वो कौन सी सरकार थी, मिलीजुली जिसको आप कहते हैं? जब आप चाहें तो मिलीजुली, जब वो चाहें तो मजबूर। उसके बाद कितनी बार हुई हैं सरकारे, 1989 में, जिस सरकार का आपने समर्थन किया, स्व. श्री राजीव गांधी के विरुद्ध, वो कौन सी सरकार थी? वो गठबंधन की थी या नहीं? 1991 में भी एक प्रकार से गठबंधन की ही सरकार थी अगर आप उसको टेक्निकली देखा जाए तो माइनोरिटी सरकार थी, तो सब सरकारें निकम्मी हैं, सिर्फ भाजपा सरकार अच्छी है। सबसे महत्वपूर्ण वाजपेयी जी की सरकार, कौन सी सरकार थी? तो ये क्या एक नया इतिहास लिखना, बरगलाना और एक प्रकार से देश के रीति-रिवाज, प्रादेशिक पार्टियाँ गठबंधन की प्रक्रिया, सबको गाली-गलौज देना है, अपमानित करना है। प्रादेशिक पार्टियाँ और साथ मिलना-जुलना असंवैधानिक नहीं है, अपना संविधान पढ़कर आईए और मैं एक चीज और बता दूँ आपको, गठबंधन की सरकारों में कई ऐसे फेज आए हैं, विशेष रुप से 1991 के बाद, जबकि विकास की दर सबसे उत्तीर्ण रही है। कई गोल्डन बजट्स आए हैं, देवगौड़ा जी की सरकार के वक्त, तो इसलिए अपने उल्लू सीधे करने और आपको झुठलाने या बरगलाने के लिए कहने की बातें होती हैं ये, इसमें कोई  तथ्य नहीं है, कोई आधार नहीं है।

Dr. Abhishek Manu Singhvi said-On behalf of the Congress Party from this podium, we seek the removal, the departure, the exit of the collaborator for violating the Constitution, the CVC. He must go. It is irrelevant whether he resigns or is sacked, but he must go. Just look at some simple facts; it is clear that the CVC is acting as an ambassador for Asthana, it is clear that he is acting as an agent and messenger for the government, to do whatever hatchet jobs. It is clear that after acting as an ambassador, after lobbying for Asthana, doing advocacy for Asthana, the CVC is writing a report which is the entire basis for the committee’s decision. The reports in your newspapers today, quote objective facts, they can’t be denied, they haven’t been denied, they’re very viable. One objective fact is, that on so and so date, the CVC met Mr Verma for more than an hour and CVC came to Verma and not the other way around, that’s 6th October.

Now, this is in black and white by Mr Verma, has it ever been denied? No body has denied it, the CVC has not denied it, it can be verified whether he came or not on that day.

Second, the purpose was to improve the appraisal report of Mr Asthana, it is directly recorded, it is also recorded that the existing report of Asthana, was of “doubtful integrity” and the CVC simply suggested that if this is changed/ modified, everything will be “okay”. All is well, if you do what we are requesting you to do. This is written, in writing by Mr Verma, where is the denial?

Third, Mr Verma has also written, in great detail, that I could see the CVC was batting entirely for Asthana, as if Asthana was the most important person in the Government and that is why, the CVC has forgotten that he has to be vigilant for public interest, he has to be vigilant for the nation, he doesn’t have to be vigilant for Asthana, he does not have to be a puppet, a vigilant puppet, in the hands of his political masters who want Asthana in that place.

Till now, friends, we had been told that only the CBI was a “caged parrot”. We are now seeing a new ‘Vigilant slave’ of the government. The Collaborator for Violating the Constitution; The CVC. The question arises, why was he acting as he was acting? The question arises, at whose behest was he acting as he was acting? Well the answers are self evident. None except the top two people in this country, who rule this country dictatorially, can claim the power to treat and make the CVC act like a puppet, and these master puppeteers can only be doing it to hide something. To hide something like Rafale and only Rafale can make them try and make CVC act like a puppet.

I want to remind you friends, that the data and the facts in writing deserve immediate action and that action much start with the removal and the sacking of the Chief Vigilance Commissioner. I must also remind you that the CVC himself is neither the removing nor appointing authority, but yet you see the sequence of events, it shows you how he has acted as the hatchet man of the government.

Remember, on 23rd October, he abruptly cancelled his visit in the night to Denmark, abruptly. No 2, on same 23rd October, from 8pm- 12.30am they sat to draft the order of removal of Mr Alok Verma. At 12.30am or 1am, the CVC order was taken to the Ministry and the hatchet job is complete, and of course, that is the only report. The Supreme Court set it aside on the grounds that only the committee can decide not the CVC, but the same report is used by the committee to set aside the tenure of Mr Verma.

On a question about the happenings in the CVC and its impact on the Rafale issue, Dr. Singhvi said- No, it is nothing to do with the Rafale issue. The Rafale issue is so much in the public domain, where is the question of changing any stand? There is no stand required for the Rafale issue, they are facts. We have asked 10 questions, Shri Rahul Gandhi has incessantly asked 10-20 questions, those are fact based questions, there’s no stand on it. We are getting no answer except spin doctoring. There is no connection now between that stand as you call it and this issue. Today we are showing the motivation, the motive, the reason, the nefarious thinking behind the government which has led to this whole chain. Can you not see the chain?

The chain is clear, that first, let me summarise it quickly, you try to push in Asthana time and again and this starts from 2017. You push him despite adverse reports, he’s your blue eyed favourite boy. No 2, as you find that the CBI Director no less, the head of the institution is sticking to his stand, you find ways and means of removing him and before removing him, making him lame duck. No 3, around that time Rafale has reached its peak, everybody in the country, not only the Congress Party, others have come to you (CBI Director) with a complaint. No 4, midnight operation is mounted on 23rd October (2018), the tool puppet made by the government, suborned by the government, subverted by the government is a high institution called the CVC. It is the funniest irony of fate that somebody who has to be vigilant, his name is vigilance, is completely subverted. No 5, within hours at 1am he has removed (CBI Director), within a few hours of that, 5 people are transferred, 5 new people are appointed. Judgment of Supreme Court 77 days later sets aside, immediately first day adjournment refused to Mr Kharge, second day removal happens, removal happens on the same report of the CVC, exactly the same report and now it is shown that the CVC was acting as an agent of Mr Asthana and the CVC report adopts Asthana’s allegations.

I am not going to repeat myself but I have shown you that 4 out of 6 allegations, which are the only allegations made out are vague, unsubstantiated, trivial, stale. So the government, we said yesterday, that the shoulder of the CVC is first lent by the CVC happily willingly and then used by the Government to fire bullets.

Scared of the ‘Rafale Truth’ – Modi Govt shamelessly fires bullets from the shoulders of CVC
& CVC is blatantly handing them the cover!

The Narendra Modi Government is, in a cowardly fashion, taking refuge and firing bullets from the shoulders of the CVC to completely damage and undermine the independence of the premier investigation agency – the CBI. It is extremely alarming, shocking and deplorable that the CVC as an institution is willingly allowed itself to be subordinated in this fashion.

The Indian National Congress strongly condemns this tyranny and absolutism whereby credibility of institutions is being bulldozed and institutions like the CVC are being made to surrender in front of a desperate Government, which will go to any extent to prevent independent CBI functioning. We are seeing the beginning of the end of the ‘One Man, One Rule Era’

A man who can’t take criticism or defeat used frivolous grounds to prove his point, misuse his power, distort the findings of CVC and misled the nation.

1. CBI Director should have been granted ‘Natural Justice’

• The principle of Natural Justice demands that the High Powered Committee should have given a hearing to the reinstated CBI Director, Shri Alok Verma, provide him a hearing and then take a decision.

Instead, the Committee removed Shri Alok Verma from the post of CBI Director without even listening to his side of the story. This was done, even as Leader of Opposition, Shri Mallikarjuna Kharge pleaded for the same.

Why was the CBI Director not heard in the Committee before a decision to transfer him was taken?

Since nothing has been either adjudicated or found against Shri Verma, the least required was for him to be heard by the Committee on mere allegations against him.

2. CVC Office was Completely bulldozed in ‘Save Modi Operation’:

It must be remembered that the CVC is neither the appointing authority nor the removing authority for the CBI Director. Hence, CVC report is not gospel truth to form the entire and sole basis for the Committee to remove Shri Verma. The Committee should see the nature of the superficial and subjective charges in the CVC Report.

The CVC report can never be a substitute for a due process of law enquiry. The Committee has overlooked the fact that the CVC report which is the sole basis of the Committee’s conclusions is based upon charges raised by a complainant (Shri Asthana) who is not only himself under CBI investigation but whose petition to stop and quash such investigation has been dismissed today. The entire CVC Report is based on conjectures, premises, speculations and unsubstantiated inferences, as demonstrated below by quoting from the self same CVC Report.

After careful analysis and analysis of the report, the following conclusions emerge:-

• On the charge of accepting a Rs 2 Cr bribe– The CVC itself concedes that “there is however, no direct evidence on the allegation of payment of bribe of Rs 2 Cr to Shri Alok Kumar Verma to Shri Satish Sana..”[Para 13(i).33]

Yet it is astonishing that this is one of the four alleged reasons relied upon for the removal of Shri Alok Verma.

• On the charge of Exclusion of a suspect from being named as accused in an FIR– IRCTC case-: “The allegation on Shri Alok Kumar Verma, Director CBI tried to call off the searches at Patna is not substantiated…” [Para 13(ii).18]

Yet it is astonishing that this is one of the four alleged reasons relied upon for the removal of Shri Alok Verma.

• On the charge of Inordinate delay in finalizing investigation report in bank fraud case against main accused, indicating favouritism towards the main accused. “The only allegation against him and this is merely an allegation that there was delay in finalizing the investigation report by the CBI and that Shri AlokVerma as Director CBI should have ensured its timely completion.” [Para 13(iii).11]

It is absolutely laughable that a CBI Director who otherwise has a fixed tenure can be removed on such specious and trivial charges.

• On the charge of Transfer of SIR related to Joint Director, CBI- “With regard to the allegation of transfer of SIR related to Shri Rajiv Singh then JD, CBI – the CVC has concluded that allegation is not substantiated.” [Para 13(iv).4]
• Not taking action on certain intelligence inputs. “The CVC has concluded that with regard to the allegation of not taking action on certain intelligence inputs, the allegation against shriAlok Kumar Verma stands not substantiated” [Para 13(v).2]
• With regard to the allegation of illegal gratification in the ongoing Preliminary Enquiry against land acquisition in Haryana “the CVC has merely concluded that there is some laxity in the progress of the enquiry”. This by no stretch of imagination can be a ground for the removal of a CBI Director. Moreover, the CVC has concluded “the reasons for such delay and roles of officers concerned cannot be discerned.” This by itself indicates that there is no criminal allegation or proof of wrongdoing against Shri AlokVerma. [Para 13(vi).3]
• With regard to the allegation of smuggling of gold at IGI Airport Delhi, the CVC has concluded “the Commission called for the records of the Customs authorities and Delhi police. As per records none referred to the name of Shri Alok Kumar Verma in this matter.” [Para 13(vii).4]

Moreover, “the CVC conclusively records that on a perusal of the entire records it is clear that no person has named Shri Alok Kumar Verma as responsible for facilitation of this smuggler.” [Para 13(vii).10]

• With regard to helping cattle smugglers the CVC records “there is no truth in this allegation insofar as it related to Shri Verma”. [Para 13(viii).3]
• With regard to the allegation of attempting to induct tainted officers it is noteworthy to point out that the proposal for the induction of both the officers was not acted upon by the DOPT. The allegation is premature at best and wild conjecturing at the worst. It is certainly not a valid ground to disqualify a CBI Director from performing his tasks. [Para 13(ix).5].
• With regard to the allegation of undue interference in CBI cases against ED officials (Lucknow case) the CVC has concluded that “from the above the allegation of pressure to refrain from seizure does not get established” [Para 13(x).A.8]

With regard to the allegation of ED Officer Gurnam Singh (Chandigarh Case) it is noted by the CVC that in fact Director CBI had given permission to go ahead and conduct searches. [Para 13(x).B.3]

Finally on this allegation the CVC Report concluded that “at this point of time the Commission cannot give any final view on this aspect” [Para 13(x).B.7]

3. In light of this vacuous CVC report, it is safe to unambiguously state that there is not a speck of evidence or grounds to remove the CBI Director.

4. In its usual disingenuous and spin doctoring manner another fig leaf behind which Modiji and the Government is trying to hide is that of Justice Patnaik. It is completely forgotten that Justice Patnaik was a broad overall supervisor who has stated that he didn’t participate in the enquiry and that the findings/conclusions of the CVC Report are not his.

5. Despite the above, it is highly regrettable that the Government is repeatedly using the shield of the CVC and indeed its shoulder to fire these politically motivated bullets at the CBI.

The CVC should have seen through this much earlier and not allowed such non conclusions and non-findings to be misused as if they are the conclusive, definitive views of some quasi judicial authority.

6. If mere allegations, surmises, conjectures and the use of subjective adjectives will become the basis for the removal of statutory and Constitutional post holders then the most alarmed persons should be the PM and the President of the ruling party who have constantly maintained that absent adjudication of allegations or strong virtually irrefutable evidence, they would not step down.

Furthermore there is complete lack of equivalence and stark contrast between direct physical and documentary evidence of serious wrongdoing available in the case of Asthana including witnesses, FIRs and direct documentary evidence in contrast to the Verma case. It is significant that the Delhi High Court in a detailed judgment, just a short while ago today, rejected Asthana’s petition to quash the FIR against him and instead directed the CBI to proceed and complete its investigation in his regard.

 We are stunned that the CVC is practicing willful and Nelsonian blindness to such obvious facts.

7. We all believe that what is sauce for the goose is sauce for the gander. But the BJP, the PM and the FM believe and act differently. They believe in discriminatory standards to be applied. For them, this vacuous and subjective CVC Report is not “a fishing and roving enquiry” but a case like Rafale, with humongous facts and documents, has been characterized by these 3 eminent persons to be a “fishing and roving enquiry”.

Defence Minister is Mum & Shri Jaitley has become the ‘Defensive Minister’ for Modiji

Modi Govt has bunked and flunked his Rafale Exam!

The Congress President, Shri Rahul Gandhi completely unmasked the lies of PM Modi yesterday, whilethe latter bunked the open book Rafale Exam in Parliament. Congress party directed pointed questions at PM Modi but he hid behind his advocates who did a terrible job in defending him.The Finance Minister, instead of the Defence Minister, was seen spewing manufactured facts and rhetoric on the floor of the House, while also debasing the dignity of his office with jibes that have no place in the hallowed halls of the Parliament.

Congress President Shri Rahul Gandhi, in his address post Shri. Jaitley’s response, not only disproved the goebbelsian lies of the Minister but did it by using the selfsame Ministers Statements. The BJP has perpetually been in damage control mode since news of the Rafale Scam broke and it is only a matter of time before the lid is blown off the top of this scam of unprecedented proportions. While the Congress President has exposed the massive fallacies in the speech, we would like to further highlight a few more falsehoods that the Blogger Minister sought to perpetuate through his speech which lacked as much truth as it did dignity.

Modi Govt has time and again said that they cannot reveal the commercial price of the 36 Rafale deal, in yesterday’s Press Conference, Congress President, Shri Rahul Gandhi busted that claim by quoting Shri ArunJaitley himself. Shri Jaitley emphatically stated that the deal cost Rs58000 Crore. That means, the per aircraft cost of Modiji’s deal is Rs 1611.11 Cr. – Which is exactly what the Congress party was claiming.

Shri ArunJaitley claimed that Congress-UPA was buying only ‘Bare Aircrafts’, but yesterday, Shri Gandhi made the Request For Proposal (RFP) 2007 public. UPA was buying a Fully Loaded Plane along with all the avionics, India Specific Enhancements & Weaponry.  These specifications were not changed by Modi Govt (Joint Statement of Modi- Francois Hollande, dated 10th April, 2015).

Why is Modi Govt lying on the increase in price from Rs 526 Cr to Rs 1611Cr? Is paying 300% extra a better deal for India or for Modiji?

Apart from what Shri Gandhi said, there are other points on which Shri Jaitley miserably floundered.

1. Supreme Court Verdict

It is unfortunate that Shri Jaitley, being a learned lawyer himself, is misleading the people of this nation and its parliamentarians. Throughout his diatribe he mentioned the Supreme Court verdict as having conclusively decided the matter on Rafale, while it is well known that the court itself has conceded to not having adequate jurisdiction, the court was also misled about information having been given to the PAC, which the Government tried to shoddily cover up after. Modi Govt which lies and perjures itself shouldn’t be preaching about the sanctity of the Supreme Court in order to save its skin.

2. Urgent Need for Jets

Shri Jaitleystated that there was an urgent need for the jets, while also justifying it with threats from across the border. If we accept that rhetoric, then why did the NDA scrap the UPA deal, which would have seen the Rafale jets arriving in India by 2019, as opposed to 2022 as is envisaged under PM Modi’s deal.

3. NDA deal 9% Cheaper than UPA

The squadron need of IAF was 126 aircrafts; If Modiji’s deal was cheap, as claimed by Modiji’s ‘Defensive Minister’ Shri ArunJaitley – then why buy only 36, why not 126 aircrafts as stated in the UPA deal.

4. Transfer of Technology

 Shri Jaitley conveniently omitted the crucial part of Transfer of Technology which the Modi Govt let go in their 36 aircraft deal. The moot point is that if the Transfer of Technology was forgone, then Rafale automatically L2 from L1 vendor. Eurofighter had already written to Shri ArunJaitley that they are ready to provide the aircrafts at a price which is 20% cheaper.

 Why didn’t the Modi Govt order fresh bids, if ToT was forgone?

5. Benchmark Price

 Why did Modiji increase the ‘Benchmark Price’ from €5.2 Billion (39,422 Cr) to €8.2 Billion (62,166 Cr), despite the objection of Law Ministry and Defence Ministry?

 Are these the files hidden in the bedroom of Manohar Parrikar?
