एक चौथा उदाहरण आता है, जहाँ हमने नहीं पास किया माननीय वित्त मंत्री और इस सरकार ने बहुत हल्ले-गुल्ले के साथ आपको इलेक्ट्रोरल बोंडस के बारे में बताया। आपको पता है कि जब इलेक्ट्रोरल बोंडस नही थे कानून में तो 20 हजार से ज्यादा कोई भी व्यक्ति अगर देता था तो उसकी पूरी आपूर्ति करनी पड़ती थी या छुपा कर कैश में देना पड़ता था, जो गैर-कानूनी होता। इंकम टैक्स में है, आर.बी.आई एक्ट में है। अब ये रिप्रेजेंटेशनल ऑफ पीपल एक्ट को बदल कर जो प्रावधान लाया गया है ,उसमें सबसे विशेष बात ये है कि करोड़ों-लाखों दान एक ही व्यक्ति अपने डोनेशन को 10 बोंडस में डिवाइड करे। 10 अलग-अलग विभिन्न व्यक्ति अपने डोनेशन को अलग-अलग बोंडस में डिवाइड करे, कैसे दें 50 हजार करोड़ दें, वो आरटीआई से,आपसे, हमसे और सार्वजनिक रुप से छुपा हुआ है, कानून के द्वारा। अब ये अलग बात है कि सरकार को पता है कि वो कौन है। तो ये सरकार को डोनेशन लेने के लिए, कम से कम अभी उसका फायदा उठाने के लिए और अगणित अमाउंट लेने के लिए सबसे सहुलियत, का कारगर कानूनी तरीका निकाला गया है।

श्री आर.पी.एन सिंह ने पत्रकारों को संबोधित करते हुए कहा कि अभी सिंघवी साहब जी और गौड़ा साहब ने बताया कि भ्रष्टाचार की बात करने वाली भाजपा खुद किस तरह भ्रष्टाचार में लिप्त है। चुनाव के दौरान किसानों के बारे में, आदिवासियों के बारे में, जमीन के बारे में बड़े भाषण भाजपा के नेताओं ने दिए। सत्ता में और केन्द्र में जब भाजपा आई तो सबसे पहले उसने किस पर हमला किया- किसानों की जमीन पर हमला किया। वो तो कांग्रेस पार्टी के नेतृत्व ने वो लड़ाई लड़ी और 44सांसदों से बिल को हमने बदलने की ताकत दिखाई क्योंकि किसानों का मुद्दा था। उसी तरह से एक मुद्दा सामने आया जब झारखंड में भाजपा की सरकार बनी, आदिवासी, पिछड़े गरीब आदिवासियों की बात करने वाली भाजपा सरकार जब झारखंड में सरकार बनी, जब चुनाव थे वहाँ प्रधानमंत्री जी ने कहा था कि CNP और SPT एक्ट, छोटा नागपुर टेडेंसी एक्ट और संथाल परगना टेडेंसी एक्ट जो 1908 में मूलवासियों और आदिवासियों की जमीन को सुरक्षित रखती है। परंतु पिछले 8 महीनों से वहाँ के मुख्यमंत्री और सरकार ने पूरी कोशिश की उस टेडेंसी एक्ट में बदलाव लाने की, क्योंकि विधानसभा में उनकी संख्या बल ज्यादा थी, उस विधानसभा में उस अमेंडमेंट को पास करवा कर गवर्नर तक भिजवाया। कांग्रेस पार्टी ने गवर्नर के सामने पिटिशन रख विरोध किया और वहाँ जो हमारे मूलवासी और आदिवासी को सुरक्षित रखती है उन्होंने भी विरोध जताया सड़कों पर। गवर्नर साहब ने उसको वापस लौटाया और हमने लगातार विधानसभा के अंदर और सड़कों पर लेकर उसकी खिलाफत की। कल हमारा एक बहुत बड़ा धरना था झारखंड में, विधानसभा का घेराव किया था। जिस तरह से भाजपा प्रजातंत्र का गला घोटना चाहती है। पानी के गोले और लाठी चार्ज हुआ परंतु जिस तरह से संख्या में लोग आए, जिस तरह से उन्होंने मूलवासी और आदिवासियों को रोकने की कोशिश की, मैं कह सकता हूं आज कांग्रेस पार्टी में फिर से भले हमारे पास झारखंड में संख्या बल नहीं है, आज विधानसभा में भाजपा की सरकार ने उस अमेंडमेंट को वापस लेने की बात की है, मैं समझ सकता हूं कि कांग्रेसी आदिवासी की जमीन हो, किसानों की जमीन हो उसके लिए लड़ाई लड़ते रहेंगे और ये जीत जो हमारी ट्रायबल भाई ने,उनके लिए झारखंड में बहुत बड़ी जीत हुई है। क्योंकि अमेंडमेंट को उन्होंने कई बार बदलने की कोशिश की और आज वापस लिया है और ये बहुत बड़ी जीत है, आदिवासी और मूलवासियों के लिए झारखंड में।

एक प्रश्न पर कि कल मानसून सत्र का आखिरी दिन है और कामकाज ठप रहा, बिल पास नहीं हुए, क्या कहेंगे, डॉ. सिंघवी ने कहा कि इस बार तो हम सब जानते हैं कि संसद का कार्य आगे बढ़ाने का पूरा उत्तरदायित्व सरकार पर होता है। इस बार भगवान की कृपा है कि कोई बहाना भी नहीं है विपक्ष के अवरुद्ध या विरोध करने के लिए, नहीं तो बहाना मिल जाता है। इस बार वो नहीं है कि किसी प्रकार से अवरुद्ध हुआ है और जैसे हमने पहले आपके सामने आंकड़े रखें है-जब भी हम सत्ता में होते हैं और जब बीजेपी सत्ता में होती है, उस दौरान जो अवरुद्ध करने की प्रक्रिया होती है उसके आंकड़े बड़े स्पष्ट होते हैं कि अवरुद्ध बहुत ज्यादा करती है, विरोध की हैसियत से। कारण आपको बीजेपी से और सत्तारुढ़ सरकार से पूछना चाहिए। शायद ये रहा हो पिछले दो हफ्ते इस सत्र के थे या तो गुजरात में बहुत ज्यादा व्यस्त थे या चुनाव आयोग में मंत्री महोदय बहुत ज्यादा व्यस्त थे, ऐसा कोई कारण रहा हो हमें पता नहीं, लेकिन निश्चित रुप से संसद का काम काफी प्रभावित हुआ है।

एक अन्य प्रश्न पर कि प्रधानमंत्री जी ने अपने मंत्रिय़ों को काफी खरी-खोटी सुनाई है संसद सत्र को लेकर, क्या कहेंगे, डॉ. सिंघवी ने कहा कि ये तो इनकी आपसी बात है, ना हमें इस पर कोई टिप्पणी करने का अधिकार क्षेत्र है। बात ये है कि मैं नहीं समझता कि बीजेपी के और हमारे नीजि वार्तालाप जो भी होते हैं सैंट्रेल हॉल में, उससे ये दिखता है। मैं नहीं समझता है कि बीजेपी के कोई भी एमपी को स्वतंत्रता है या पार्टिसिपेशन है, इसलिए उनको वो लगाव सैंसर ऑनरशिप बिल्कुल नहीं है। अगर सबकुछ, आप हाईकमांड की बात करते हैं, तो सुपर हाई कमांड इस देश में किसी पार्टी में हो तो वो एक ही पार्टी में है- सत्ता रुढ़ पार्टी बीजेपी में और उसके रहते कोई भी सांसद अपने आपको जुड़ा हुआ नहीं समझता संसदीय प्रक्रिया में।

एक अन्य प्रश्न पर कि गुजरात चुनाव में जीत से आप क्या सबक लेते हैं, आने वाले चुनाव के लिए क्या तैयारी है, डॉ. सिंघवी ने कहा कि कांग्रेस पहली बात तो नतमस्तक है उन एमएलए के समक्ष जिनको प्रलोभन दिया गया ,उसका तुलनात्मक रूप से आप अहसास भी नहीं कर सकते। उनको सैल्यूट करना चाहिए। दूसरी बात हर प्रकार का प्रलोभन, कई हफ्तों तक। ये संस्थाओं की जीत है सबसे पहले। माननीय पटेल जी की जीत तो है ही, निष्पक्ष स्वतंत्र संस्था, कानूनी कार्यवाही के आधार पर निर्णय दे सके, उसका द्ययोतक है, उसका उत्तम उदाहरण है। तीसरा ये दिखाता है कि जब अहंकार की चरम सीमा होती है तो ऊपर वाले का न्याय अजीब होता है, उसको आप हिट-वीकेट कह लीजिए, सेल्फ गोल कह लीजिए, टू क्लेवर बाय हॉफ कह लीजिए, लेकिन उस न्याय की चपत बड़ी करारी होती है।500, 2000 रुपए के नोट पर पूछे गए प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि आपके समक्ष हमने तथ्य रखे हैं। हमें अगर दो नोट मिलेंगे तो हम आपके समक्ष रखेंगे। हमें अभी तक संतोषजनक जवाब नहीं मिला है और जब तक नहीं आता है हम बार-बार जवाब मांगेगे। वो मांग जारी है।

The first is the Whistle-blower’s Act. I was intrigued to find that I was the Chair of the Committee, which recommended the basic structure of this Act. The Whistle-blower’s Act in 2014, contrary to what the UPA, in its outgoing phase recommended, which passed through Lok Sabha and Rajya Sabha was amended in 2014 and the principal strategy adopted of diluting it, virtually swallowing it up, is by making a category which was excluded from disclosure.

A list of ten items under the Amendment, the 10 items are so broad, so subjective that the so-called exceptions will swallow the rule. It will make whistle blowing nugatory. So, you need to allow whistle blowing if first, it affects the sovereignty and integrity of India. The words are very wide. You do have sovereignty, security in the Constitution, but not such words, security, strategic, scientific or economic interest of the State. What kind of wording is this? That means you can prevent any whistle blowing. Cabinet papers including records of the Council of Ministers, of Secretaries of the Government and all other officers is very wide. Using a peg which is known to law, you have expanded it completely precisely, for the exception to swallow the rule. Information that has been expressly forbidden by a Court or contempt, that is alright, no problem. If the information would cause a breach of privilege; There is no anticipatory breach of privilege of Parliament. Parliament will decide whether it is a breach of privilege. It is not the Government Officers sitting here who will decide in advance, that you will not allow whistle blowing, because he thinks that Parliament may hall it up for breach of privilege. Look at the width of this that relates to commercial confidence, trade secrets, intellectual property, almost everything will be covered if you use such broad words. I have got 7 other examples, I do not want you to take to details, the paper will tell you.

The first important point is The Whistle Blowers Act – our Government, our Standing Committee and then the Parliament passed it. We brought it up, it was our idea because in all developed countries and many other countries, it is a major weapon in the fight against corruption. Whistle blowing, which has the twin objectives of protecting the whistle-blower and allowing access to important information which leads to and involves corruption and proof of corruption, is the heart and soul of an anti-corruption campaign. This Government is used to ‘Jumlas’, to making tall claims, but the reality, the difference between fact and fiction, between rhetoric and reality is that they have by the Amendment, reduced the scope almost to vanishing point. And how do you blow the whistle at all after this Act, is a matter of great mystery.

The second example is the very important – Lok Pal Act and again coincidentally our Committee with 31 Members and 17 Parties, passed a near unanimous recommendation on that. Shri Modi has successfully done at the Central Government, precisely what he did for 12 long years, as the Chief Minister of Gujarat.

We passed it, we brought it in the Committee. We then brought it from the Committee to Parliament. In 2011, after our Committee report, which was done in a record four months, with almost 150 witnesses and several hours of evidence. It was delayed in Rajya Sabha, by the BJP. It got it again referred in May 2012 to a Select Committee. The Select Committee report comes in the end of 2012 and finally the Bill is ascended and brought into force during our time in the end of 2013 and 2014. Even the delay from 2012 to 2014 was by the daily obstruction by BJP. And remember how they rode ‘piggy-back’ on the man whom they called an ‘old man’ Mr. Anna Hazare. They rode ‘piggy back’, they abused us, they used vituperative adjectives.

Now you reach 2014. From 2014 when Mr. Modi took over – for almost 36 months – he has tried everything available not to promulgate and put into operation this Act. Two examples and I do not want to quote to you Ms. Sushma Swaraj who said in those days before she was in Government, ‘an old man’ who keeps fasting to fight corruption and appeals to our collective conscious, the UPA let him down. And 36 months inaction, silence now.

Mr. Jaitley said, if fears and fair anger is there because the government UPA wants a ‘Sarkari Lokpal – the UPA is acting like a child’. These are people who spoke then and who are the Ministers who have done nothing for three long years, because no one dares open his mouth.

One objection takes a 30 second Amendment – one line 30 second amendment, to say the ‘single largest party’. The excuse of the NDA is amazing. It is the most precious and superficial of excuses I have heard that there is no LoP and the Act, because when it was passed, it was not anticipated that there would be 44 persons. The Act uses the word ‘LoP’. Therefore, we cannot operationalize because there is no LoP. Instead they have brought two other Amendments. They could have easily got this Amendment. They brought other amendments to the Lokpal Act, they (a) avoided bringing this Amendment and (b) they brought retrograde Amendments to the Lokpal Act. One major change they brought was in Section 44 which said every public servant must declare his assets and those of his spouse and dependent children. They have changed that altogether and said, that they will be required to disclose as the Government may prescribe. So, from a statutory status of disclosure, mandatory obligatory disclosure in the statute, it is now a Governmental executive prescription which may leave out what they like in the prescription. They made this very significant Amendment saying single largest party can nominate. Result is, we have no Lokpal after three years. Is it not utter hypocrisy and from 2001 to 2013 till Mr. Modi left Gujarat, he did everything possible to ensure that there would be no Lokpal in Gujarat.

The Hon’ble Supreme Court in that matter when the Gujarat Government and I have got the names, we took a briefing on this, I took the briefing myself. How it went in those days in Gujarat from the original Mr. Justice Soni in 2003, Mr. Justice Vyas in 2006, nobody became a Lokpal – all blocked – nominated by either Chief Justice or by the other consultee but never appointed by Mr. Modi. Then Mr. Soni and Justice Vyas went, then Justice Vora, then Justice Dhokalia and you reach 2011. And finally, when Justice Mehta was appointed in 2011, the Gujarat Government in an unprecedented action, went in Writ Petition. The Government filed a Writ Petition; normally a private citizen files a Writ Petition which travelled to Hon’ble Supreme Court saying why Justice Mehta should not be appointed. That judgment has passed strong remarks and strictures against those in authority who tried to avoid accountability through Lokpal. And then said you must appoint. Unfortunately, Mr. Modi got his view again because no self-respecting man would take up Local or Lookout as the case may be in Gujarat and Mr. Mehta wrote a long letter expressing his deep pain and anguish and resigned. Then Mr. Modi came here. So exactly what he did there, he is doing here. That is Lokpal for you.

Prevention of Corruption Act is the third example – Prevention of Corruption act, was a very old Act which our Government in 1988 consolidated and made into a new Act and the 88 Act was much wider than the original version of the 1940s and 1950s. Now in the 1988 Act, one of the crucial provisions which is now being diluted was that a public servant can be punished for accepting or attempting to obtain any reward for performing its function improperly. That is the heart and soul of that Act. It is inter alia Section 7 but there are other provisions in it. Now they have said this will not apply unless it is shown that he acted dishonestly. A very wide exemption is brought it in. It is virtually impossible in the way the Section is worded, to prove that which makes a big-big escape route and actually again just like the first example I gave of the Whistle-blowers Act, creates an exception which swallows the rule. The intent is to allow gate ways, to allow passages which will make corrupt people get away free. Remember, each of these are our initiatives, which are diluted.

Dr Singhvi said, it legitimizes legally a way of huge political donations without transparency. If you are allowing me to give you Rs. 50,000 crores as a Corporate House, the only question we are asking is why you are not allowing the country to know who it is. We know you are biases, we know your dialectics, we know your preferences. Allow us to know.

That ultimately, this is the height of hypocrisy, double standards, it is the height of selectivity, it is shamelessness actually and just yesterday, yet again we hear our Hon’ble Prime Minister giving us sermons from the pull pit about eradication of corruption. Does not our Prime Minister see his own Party President? Do you think what you saw in the last two weeks in Gujarat, was happening because tea leaves and fresh air was being dangled. Do you think that the expenditure of Uttar Pradesh came from cheques cut for electioneering? You do not see anything there. But anytime there is the slightest tactical violation, you have all the agencies. So, I would request the NDA, I would request our Prime Minister to look backwards, to look inside, to look inwards and do not preach without practice. Do not have this ‘chasm’ between your words and your deeds.

Prof. Rajeev Gowda said I would like to follow up what on what my senior colleague Dr. Singhvi has shared with you and point out that we have documents that we will be sharing with you today – one page Press Release – on all that we have talked out and by e-mail. We don’t kill thousands of trees because the nature of criminal records, the nature of scams that we are going to share with you, adds up too many-many hundreds of pages.

Now first – the issue of criminal cases against BJP MPs and Ministers – this is evidence that is there in the Affidavits that have been filed by these candidates when they stood for election. There may be many more scams and criminal cases against after that, but this focus is what they themselves have revealed. I want to remind you that Prime Minister Mr. Modi in his first speech here, talked about how he would fast track criminal cases and ensure that within six months, those people including MPs from his own Party, would be tackled, action would be taken against them and that the cases would be closed. It is now three years. What happened to that promise Mr. Modi. How come those criminals continue to sit in Parliament and sit in your Ministry? From this document, you will see the list of criminal cases taken from the Affidavit data.

Similarly, the Research Department which I head, has come up with a white paper on the systematic weakening of anti-corruption laws. He has talked about them. I want to add one point – the Electoral Bonds. There are two aspects there – one is about the anonymity of donations Rs 20,000 to Rs 2,000, how it has been brought down, but that makes no difference whatsoever. But the basic point is in a democracy you want to be able to follow the money. You want to know who has contributed to whom and what the end result in terms of policy change is. What the Electoral Bond’s proposal does is, it eliminates that, shouts everything in secrecy. How much ever money they make and they take and they can coerce using all the new powers given to Income Tax officials. None of us will be wiser; none of us will be able to question them and day this is what you took from this person or that person. We are objecting to that anonymity, it is against the interest of transparency and level playing field in democracy.

Third document that we are releasing is the BJP’s involvement in scams. This is something that will go on and on. We have organized this according to States. Chhattisgarh, the first one is CM’s son, our Lok Sabha colleague Abhishek Singh’s involvement in the Panama Papers Leak. Recently we have done a Press Conference about Forest Land grabbing by Mr. Aggarwal, the Minister there. We had the PDS Scam and the MNREGA Scam, Sand Scam.

Maharashtra, we have recently did a Press Conference on numerous scams involving multiple Ministers. The housing Minister and the Sum Rehabilitation scam. So, we have organized these according to series. That is the level of scams that have been taking place which the Prime Minister for all that information that he receives in this highly centralized Government, somehow this information seems to elude him. We want to make sure and through you, the Nation, we want to make sure is aware of the extent the depth and the magnitude of the scams that are going on across the length and the breadth of the country under the ‘BJP Sarkar’s’. Karnataka, we have already mentioned. You can remember that we also had at the height of demonetization a 500 Crore wedding hosted by one of our Reddy Brothers who is very-very famous in the country. Gujarat – we have the GSPC scam, the Bank Scam, Fishery scam, Land allotment scam. Numerous scams in Rajasthan that are coming out all the time. Going back to Lalit Gate and other such issues – Madhya Pradesh VYAPAM has already been mentioned. And this is material that we will also share with you.

And so finally, I want to point out that you will get these three documents – one on criminal cases on which no action has taken place – A white paper on the weakening of anti-corruption laws and finally this list of scams that we have been able to uncover so far. And we ask and urge Mr. Modi, to end the hypocrisy to please match actions to the words that he periodically tries to entice the people with when he says that he is fighting against corruption. The record shows that his fight against corruption, the action level is absolutely Zero and until he takes action against his own colleagues and demonstrates how he is able to send them to jail, we will not believe and that Nation will not believe a word further that he utters on the issue of corruption.

इसके तीन पहलू हैं और मैं राष्ट्रीय सुरक्षा की व्यापकता की बात नहीं कर रहा हूं, मैं आज अभी चीन तक सीमित कर रहा हूं। जहाँ तक हमारे सबसे पुराने, बहुत ही महत्वपूर्ण दोस्त का पहलू है – भूटान का, जिसके प्रति हमारी कट्टिबद्धता पर कोई संदेह या प्रश्नचिन्ह नहीं उठ सकता और ना ही उठना चाहिए। दूसरी तरफ ये चीन का सबसे ज्यादा आक्रामक स्टांस जो देखा है हमने 40-50 वर्षों में वो पहलू है। तीसरा बार-बार हमारी बातचीत होती है, फोटो अपोर्चुनीटि होती हैं, यात्राएं होती हैं, अफ्सर जाते हैं, प्रधानमंत्री जाते हैं, आते हैं और झूला झूलते हैं और नतीजा, लगातार संबंध खराब होना। ये तीन पहलू हैं जिनको सरकार तुरंत ठीक करे। ये अति आवश्यक है देश के लिए।

इसके साथ हम आपको याद दिलाना चाहते हैं कि अगर पुराने एग्रीमेंट की हाल में जो नींव है, वो इतनी ठोस है, इतनी मजबूत, इतनी व्यापक है कि उस नींव के उपर भी अगर ये सरकार इमारत बनाने का प्रयत्न करती तो इतनी तकलीफ नहीं होनी चाहिए थी। मैं आपको दुबारा याद दिला रहा हूं, अप्रैल 2005 का करारनामा, जिसको ‘लाईन ऑफ एक्चुअल कंट्रोल’ करारनामा कहते हैं, चीन के साथ। उसके बाद हाल में अक्टूबर, 2013 का बॉर्डर डिफेंस कोरपोरेशन करारनामा, चीन के साथ। ये सब चीजें उस वक्त बहुत सीमित थी, कम थी। आज अचानक इसमें जबरदस्त चौंकाने वाली वृद्धि कैसे हुई?

मैं आपके सामने आश्चर्यजनक आंकड़ा रखता हूं कि पिछले 45 दिनों में 120 चीन के incursions हुए हैं, लगभग 3 प्रतिदिन। ये औपचारिक आंकड़े हैं, मेरे आंकड़े नहीं हैं और अगर आप 2017 को लें, जो अभी आधा हुआ है उसमें 240 ऐसे incursions या transgressions हैं। ये बहुत ही दयनीय हालत है और ये पहले कभी नहीं हुआ।

बहुत अरसों से नहीं हुआ कि मानसरोवर की यात्रा नाथूला के जरिए ऐसे आक्रामक रुप से बंद की गई हो। पहले नहीं हुआ जो अभी हाल में 4 जून को हुआ कि 2 चीन के हैलिकाप्टर चमोली तक पहुंच गए, उत्तराखंड में। उससे कुछ महिनों पहले 2 और हैलिकाप्टर साढ़े 4 किलोमीटर भारतीय टैरिटरी, उत्तराखंड में पहुंच गए और जैसे मैंने व्यथा व्यक्त की थी कि इन सब संदर्भ में, उन लाल आँखे, 56 इंच छाती की बात छोड़िए, वो लाल आंख हमें दिखती नहीं है और 56 इंच छाती इनविजिबल हो गई है। लेकिन इन सबके बीच हमारे मंत्री महोदय ने क्या वक्तव्य दिए हैं। हाल में माननीय गृहमंत्री ने कहा- Chinese incursions is only perception. माननीय राज्य रक्षा मंत्री ने पार्लियामेंट में कहा- No Chinese incursions, only transgressions. जैसा मैंने कहा कि वकील भी सक्षम नहीं है इस प्रकार का वक्तव्य बनाने में। इसके साथ वो बताते की मतलब क्या होता है, ये बिना फर्क वाले फर्क का।

ये सब कब हो रहा है? ये सब तब हो रहा है जब दिन-प्रतिदिन माननीय प्रधानमंत्री, वरिष्ठ अफसर, मंत्री चीन के लोगों से मिल रहे हैं, फोटो अपोर्चुनीटि हो रही है, मीटिंग हो रही हैं, अहमदाबाद में झूला झूला जा रहा है, आदान-प्रदान हो रहे हैं। साथ-साथ इतने जबरदस्त तरीके से मसूद अजहर को आतंकवादी घोषणा करने के मामले में विरोध हो रहा है भारत का, न्यूक्लियर सप्लायर ग्रूप NSG में बार-बार, हर दिन, हर हफ्ते विरोध कर रहा है। संयुक्त राष्ट्र काउंसिल में खुले रुप से भारत का अपमान कर रहा है। कॉरिडोर का जो मुद्दा था जिसको आप CPEC कहते हैं उसमें भारत बहुत दयनीय दृष्टि से आईसोलेट क्यों हुआ, अकेला क्यों खड़ा पाया गया, अगर आपको विरोध करना है जमकर कीजिए, अकेले मत दीखिए?

ये सब महत्वपूर्ण प्रश्न हैं, ये सब वो प्रश्न हैं जो हर जागरुक, जिम्मेवार और देश से प्रेम करने वाला, देश प्रेम से ओत-प्रोत नागरिक पूछेगा और हम इसे बहुत ही जिम्मेदारी के साथ पूछ रहे हैं? हम ये भी पूछ रहे हैं कि क्या इस देश की वो किस्मत है कि लगभग साढे 3 वर्ष में देश के पास दो ही प्रकार के रक्षा मंत्री होंगे, या तो Reluctant रक्षा मंत्री या पार्ट टाईम रक्षामंत्री। मैं किसी व्यक्ति विशेष की बात नहीं कर रहा हूं, मैं बात कर रहा हूं ऐसे महत्वपूर्ण करार पर खड़े देश के लिए, पार्ट टाईम रक्षा मंत्री से काम नहीं हो सकता।

अंत में एक दुर्भाग्य की बात है, खेद है ये कहने में कि जब यूपीए सरकार ने 64 हजार करोड़ रुपए का 90 हजार नए एडिशनल ट्रूपस का Mountain Strike Crops करने का पूरा प्रस्ताव पारित कर दिया, बजट बना दिया। चौंकाने वाले आंकड़े हैं- 90 हजार नए ट्रूपस और 64 हजार 678 करोड़ रुपए, वो MSC 90 प्रतिशत भारत चीन की बांउडरी सीमा पर ही होते। हम आपसे जवाबदेही चाहेंगे- क्या हुआ उसका, कहाँ चला गया वो, कार्यांवित क्यों नहीं हुआ, पारित क्यों नहीं हुआ? उसमें से आंशिक रुप से खड़ा क्यों नहीं हुआ, क्या वो आज जबरदस्त रुप से कारगर सिद्ध नहीं होता, ये सब महत्वपूर्ण प्रश्न हैं और हम दुख, खेद और जिम्मेदारी के साथ पूछ रहे हैं, सरकार से? अगर ये सरकार ठोस और सही एक्शन लेती है तो हम उसके साथ पूरी तरह से खड़े हैं, समर्थन के लिए, तुरंत इन सब विषयों, पहलुओं पर सही एक्शन लिया जाए।

अकबरुद्दीन औवेसी के बयान पर पूछे गए प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि हमें कोई झिझक नहीं है ये कहने में कि आप उस व्यक्ति, उस पार्टी का वक्तव्य पढ़ रहे हैं जिसको मैं आपके सामने बेबाक होकर, औपचारिक रुप से बीजेपी की B टीम कहता हूं, ये बीजेपी की बी टीम का वक्तव्य है। ये उस ऐजेम्डे वाला वक्तव्य है, जो बीजेपी ने बार-बार इस्तेमाल किया है। ऐसे ऐजेण्डे को फैलाने के लिए, जो विभाजन का ऐजेण्डे है, शत्रुता का ऐजेण्डा है, एक घृणात्मक वातावरण बनाने का ऐजेण्डा है और बीजेपी ने बार-बार औवेसी जैसे व्यक्तियों का उपयोग और दुरुपयोग किया है ऐसे ऐजेण्डे के लिए। उसका एक और उदाहरण आप देख रहे हैं। ये जो डर्टी ट्रिक्स विभाग है बीजेपी का, ये बार-बार चुनाव और चुनाव के अलावा स्ट्रेटेजिक क्षणों में, जब देश की समस्याओं का हल ढूंढने में आप नाकामयाब हों, जवाबेदही मांगी जा रही हो, इसका दुरुपयोग करते हैं और इसका एक ही उद्देश्य है कि आप हिंदु को मुस्लिम के विरुद्ध खड़ा कर दें। विभाजन का ऐजेण्डा पूरे देश में फैला दें, कास्ट बनाम कास्ट हो जाए, धर्म बनाम धर्म हो जाए, प्रदेश, प्रांत बनाम प्रदेश, प्रांत हो जाए और ये एक दुर्भाग्य है कि बीजेपी बार-बार करती है इसलिए इसको एक्सपोज करना इन स्पष्ट शब्दों में आवश्यक है। ये औवेसी बंधुओं को छोड़ दीजिए, ये बीजेपी का काम है।

नितीश कुमार जी के कांग्रेस के संदर्भ में दिए बयान पर पूछे गए प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि मैं स्पष्ट कर दूं कि जहाँ तक राष्ट्रपति के चुनाव का सवाल है, वो मामला खत्म हो गया है। हमने पहले भी और माननीय कांग्रेस अध्यक्ष ने बड़ा स्पष्ट किया था कि अंततोगतवा हर पार्टी का ये अपना स्वत: निर्णय है और जो इसमें अगर पार्टी कोई भी निर्णय करती है जो पार्टी होगी वो उस स्वायत का निर्णय होगा। इसका हमारे बिहार के गठबंधन से ना तो कोई संबंध है और ना ही किसी रुप से उसको कमजोर करता है। हम मजबूती के साथ, साथ खड़े हैं और जो माननीय नितीश कुमार जी ने बार-बार कहा है, कल भी कहा है, इसलिए इसे इस संदर्भ में देखा जाए।

एक अन्य प्रश्न पर कि सूरत में GST के खिलाफ कुछ व्यापारी प्रदर्शन कर रहे हैं, उन पर लाठी चार्ज किया गया, क्या कहेंगे, डॉ. सिंघवी ने कहा कि ये प्रश्न आप गलत व्यक्ति से पूछ रहे हैं, ये आपको उनसे पूछना चाहिए जिन्होंने घंटो मध्यरात्रि के भी बाद जश्न मनाया था। आपने सूरत का उदाहरण दिया, मैं आपको 5 उदाहरण दे सकता हूं, जहाँ लाठी-चार्ज हो रहा है, जो अभियान कर रहे हैं। तो ये सवाल आप उनसे पूछिए जो अच्छे आईडिया को कितने अच्छे तरीके से खराब कर सकते हैं। हमने बार-बार कहा कि GST एक बहुत ही प्रभावशाली और अत्यंत आदर्श आईडियल है। लेकिन अच्छी चीज को कैसे गलत रुप से कार्य़ांवित किया जाए, उसके लिए एनडीए-भाजपा के पास जाएं। 40 प्रतिशत वस्तुओं से रिवेन्यू हटा दिया। आज आप कहते हैं GST – वन नेशन, वन टैक्स। वन नेशन कहाँ है और वन टैक्स कहाँ है, 40 प्रतिशत GST में है ही नहीं। पैट्रोल, एल्कोहल नहीं है तो वन नेशन, वन टैक्स कहाँ हुआ? जिन देशों ने सफलता से इसको कार्यांवित किया है वो एक रेट रखते हैं और एक रेट जिसे डीमैरिट रेट कहते हैं। आज की सरकार ने 7 रेट बनाए हैं। जिसको वन नेशन, वन टैक्स कहते हैं। वन टैक्स 7 रेट, तीसरा कार्यांवित करने के लिए आप इतने नाम ले रहे हैं, सूरत का या और जगहों का, ये वो सब लोग हैं जो पूरी तरह से टैक्स पे करते थे, आज भयभीत हैं कि कल हमें आरोपी बना दिया जाएगा, मैं आपना काम नहीं कर पा रहा हूं ना कम्प्यूटर से ना फार्म से। इनकी व्यथा उस जश्न मनाने वाले इस सरकार के लोगों के कानों तक उस दिन रात को नहीं पहुंची और अब भी नहीं पहुंच रही है क्योंकि ये सरकार ईवेंट मैनजमेंट बनाने में माहिर है।

एक अन्य प्रश्न पर कि बीजेपी के राष्ट्रीय अध्यक्ष ने गोवा में एयरपोर्ट परिसर के अंदर ही मीटिंग कर दी, क्या कहेंगे, डॉ. सिंघवी ने कहा कि बीजेपी समझती है कि हम सरकार में है तो हर स्थिति, हर क्षेत्र, हर प्रोपर्टी उनकी पार्टी की है और दूसरा बीजेपी की ये एप्रोच है कि हर चीज में राजनीति होनी चाहिए, एयरपोर्ट में हो या बाहर हो। केन्द्र में उनकी सरकार, प्रदेश में उनकी सरकार, एयरपोर्ट की अथोर्टी उनकी सरकार के अंदर आती है, अफ्सर उनके, हम क्या जवाब दें? अगर इस तरह की गैर-जिम्मेदारी दिखाई जाएगी वो भी राष्ट्रीय अध्यक्ष के द्वारा तो वो बहुत दुखद प्रसंग है, कुछ लोग शिकायत करेंगे लेकिन जो रक्षक हैं वही उस सार्वजनिक प्रोपर्टी के भक्षक हो जाएंगे तो देश का क्या हो सकता है?

These three facets, I want to discuss with you. We all know that perhaps in the last 55 years such a serious standoff has not occurred and I am not talking merely of destruction of a bunker here or bunker there but this very serious eye ball to eye ball confrontation. This has been preceded with a humongous number of Chinese incursions and violations and I am startled to find this figure which is on the official website that in the last 45 days alone, 120 Chinese incursions i.e. almost at the rate of 3 a day and if you take the whole year of 2017 which is less than half over – these incursions have been 240, which is much more than one per day. Unfortunately, it appears this Government has been caught napping and has not been able to implement significant accords of recent vintage of recent origin – forget the old ones which the UPA Government did. We were able to contain and control the situation. I have to give more details but I will cite only two agreements for such.

The Line of Actual Control in the India-China Border Area Agreement – Title is this – of April 2005 – other is Border Defence Co-operation Agreement of 2013. This base existed and therefore, not only a violation of these has happened by the repeated transgressions but violation near the most sensitive part which is the area known as ‘Chicken Neck’. We say this with great responsibility and restrain but we would be abdicating our responsibility if we did not say. We have not had only these transgressions, we have not only had destruction of bunkers, and had but after a long-long time, a complete stoppage of the ‘Mansarovar Yatra’ from one entry point.

The Chinese have posted photographs of destruction. You have perhaps forgotten June 4, 2017 – a few weeks ago – two Chinese Army choppers violated Indian Air space in Chamoli District in Uttarakhand. On an earlier occasion which we shared with you, Chinese helicopters came more than 4-1/2 Kms. into Indian territory, again in Uttarakhand.

We are highly alarmed and concerned because the responses of the Government in one or two cases have been actually very-very pitiable – I quote the Minister of State for Defence, in written reply to Parliament said “No Chinese incursions, only transgressions’. Perhaps the Ministry of Defence should have supplied us a dictionary – the dictionary which tries to point out the different without a distinction or distinction without a difference when we say ‘No Chinese incursions only Transgressions’. Even a Lawyer will blush with such a distinction.

Then Shri Rajnath Singh, the Hon’ble Home Minister said ‘Chinese intrusions are only perception’. It is alright, we can get away with these statements but when you have such a serious standoff or face-off, the responses by Indian very senior Minister assume very great significance.

I am not going to remind you in details but all this happens in the backdrop of Chinese Daredevilry, Chinese unconcern and Chinese complete lack of sympathy what to talk of empathy for issues like Masood Azhar, persistent objection and obstruction, for issues like NSG, persistent repetitive obstruction, issues like UNSC Membership. This is much worse because I am sorry to say that our longest term ally Russia extended support to China on the Corridor issue.

Few days after, we were treated to all kinds of optics and photo opportunities and then comes India’s isolation. When we object and take a stand, we should not seem to be isolated. But we regretfully inform and remind you about India in isolation on the so-called CPEC Economic Corridor issue – 54 Billion US $ under our nose and we appear to have become an isolated object or who is standing on the silence watching helplessly.

I started and am ending by reminding you and telling this is said with responsibility and restrain but it is to be reminded to this country that nothing is more precious than our country’s National security and National integrity, territorial integrity. I am asking myself whether this Government’s three years can be described in terms of either a reluctant ‘Raksha Mantri’ or a ‘Part-time Raksha Mantri’. India deserves better. It is not the question of Mr.. A or B, I am not alleging personalities with some serious issues, it is just not possible for ‘Part-time Ministers’ to deal with such issues and unfortunately the Nation has lurched from a reluctant ‘Raksha Mantri’ to ‘Part Time Raksha Mantri’ and vice-versa.

I must inform you also with great regret and deep regret about the Mountain Strike Corps. The Government of India, under the Congress Party, devoted a scheme of Rs. 64,678 Crores with 90,274 additional soldiers for what was to be known as ‘Mountain Strike Corps’. ‘Mountain Strike Corps’ – basically 90% would be manning the ‘Indo-Chinese Border’. We have asked through you earlier and I ask again, why it is kept in deep freeze, where is the scheme gone. What has the BJP done – Rs. 64,000 Crore and 90,000 additional troops precisely in the area where we are having these very-very serious problems?

On the statement of Owaisi, Dr. Singhvi said let me make it clear – I have no hesitation in saying so. This is yet again the BJP ‘B’ Team, their name may be ‘Owaisi Brothers’. The party may be different but nothing; it is BJP’s ‘B’ Team. This is that Team which the BJP time and again in the past and now again has used to promote and to implement an agenda of polarization, of hate and envy, of mutual enmity and destruction, using or misusing the ilk of people like Owaisis. This is the ‘Dirty Tricks Department’ of the BJP which spreads this to create polarization for cheap politics and cheap votes. The object of this is only one – to create Hindu Vs Muslim, Caste Vs Caste, Region Vs Region, Indian Vs Indian and if affects Everybody Vs Everybody. I am shocked and aghast that the party which is in power stands exposed and every time they do so, we will expose them again.

इस देश में सरेआम, खुल्लमखुल्ला फांसी लगाने का अभियान चल पड़ा है। सबसे बड़ा गणतंत्र विश्व का और कानून व्यवस्था के नाम पर ना कोई भय है और ना ही अनुशासन। क्या ये भारत की अस्मिता और आत्मा है और क्या ये भारत का नया नोर्मल है? मोदी जी का नया नोर्मल, बीजेपी और एनडीए का नया नोर्मल। क्या ये वो नोर्मल है जिसमें दोषरहित व्यक्तियों को किसी भी संदेह, उंगली उठाकर या किसी भी आरोप के आधार पर बिना न्याय मिले, क्षणिक न्याय मिल जाता है और तुरंत न्याय मिल जाता है और ये न्याय पेड़ वाला न्याय होता है।

आज इस सरकार का विजिटिंग कार्ड, अस्तित्व और व्यक्तित्व और इस सरकार की आईडिंटिडी जो हो गई है वो है असहिष्णुता। दुखद प्रसंग ये है कि इसमें प्रादेशिक और केन्द्र स्तर पर समर्थन प्रकट किया जाता है, सभी सरकारी व्यक्तियों के द्वारा।अभी हाल में जो हमने देखा 7 व्यक्तियों की मृत्यु हुई है, पुलिस वाले खड़े हुए हैं। 80 साल की बुजुर्ग महिला के साथ भी मारपीट की गई है। दलित हो, अल्पसंख्यक हो, मानवता का कोई भी द्योतक हो, उनको कोई मतलब नहीं। इसमें एक गहरी बात छुपी हुई है जिसको छुपाने के लिए ये सभी ढोंग किए जाते हैं, कभी गाय के नाम पर, कभी धर्म के नाम पर वो हैं तीन चीजें- मानव अधिकार से असहिष्णुता, मानव अधिकार के विरुद्ध एक भावना, दलित और पिछड़ी जातियों के विरुद्ध एक भावना और हर चीज को साम्प्रदायिक बनाने की भावना। इन तीन चीजों पर सीधे और परोक्ष रुप से कई यंत्र-तंत्र बनाए गए हैं जिससे इनको आगे बढ़ाया जाए, प्रवोक किया जाए, समर्थन किया जाए। आपको अच्छे ये याद है कि दलित व्यक्तियों के कपड़े उतार कर कैमरे के समक्ष पीटा गया। किस प्रकार से अखलाक और दादरी हुआ सिर्फ संदेह के आधार पर। 23 वरिष्ठ सरकारी अफसरों, सेवानिवृत और जिनका कोई सरोकार नहीं राजनीति से, बार-बार राजस्थान के मुख्यमंत्री के अनुरोध किया कि पहलू खान के विषय में कि आप तुरंत गिरफ्तार करें। महीनें, हफ्ते निकल जाते हैं लेकिन कोई जवाब तक नहीं आता।

जम्मू से लेकर हरियाणा तक, चाहे गैंगरेप हो, महिला का चेहरा पत्थर से कुचल दिया जाता है या जम्मू में nomadic परिवार था, उसकी बात हो। आपके कैमरे के सामने था, वो अपने जीवन की भीख मांग रहे थे और ये 2017 वाले भारत में हो रहा है, क्या ये नया भारत है, क्या ये नया नोर्मल है?

मोदी जी ने सदैव पिछले 3 वर्षों में या तो जुमले सुनाए हैं या महान व्यापक वक्तव्य दिए हैं या फिर बड़ी विशेष चुप्पी बड़े crucial और संवेदनशील मुद्दों पर। एक तरफ मोदी जी ये कहते हैं और दूसरी तरफ उनकी पार्टी के लोग, उनके समर्थक ऐसे लाईसेंस टू किल को कार्यांवित करते हैं जिससे जेम्स बांड को भी शर्म आ जाए। ये बहुमत की एक विचित्र परिभाषा है जो गणतंत्र और लोकतंत्र के विरोधी हैं। ये जो नई परिभाषा है, बहुमत की, ये असहिष्णुता को छुपाने के लिए है। इन सबको छुपाने के लिए कई सांसद, मंत्री महोदय, वरिष्ठ अधिकारी बीजेपी और योगी जी के अलग-अलग स्तर के लोगों की सभी टिप्पणीयों की एक सूची, हमारे पास है जो आपके समक्ष रखी है। ये क्रूर, साम्प्रदायिक हैं और सरकार ने उनके विरुद्ध कभी कुछ नहीं किया, सिवाए सर्मन देने के।

हम बात करते हैं ठोस तथ्यों की। 2013 से 2015 में लगभग 38 प्रतिशत वृद्धि हुई है दलितों के विरुद्ध क्रिमिनल एट्रोसिटी के विषय में। 39 हजार से 54 हजार है ये आंकडा। आज दिन प्रतिदिन हम देख रहे हैं वो बहुत ही विकृत परिभाषा इस देश की है।

परेश रावल के अंरुधति राय पर ट्वीट पर पूछे गए प्रश्न के उत्तर में श्री सिंघवी ने कहा कि आपका प्रश्न महत्वपूर्ण है और एक प्रकार से जो मैंने कहा है उसको प्रमाणित किया है। मेरी जो दुर्भाग्यपूर्ण, लंबी और दुखद सूची है आपने उसमें एक और उदाहरण जोड़ा है। ये मामला इस बात का नहीं है कि किसी ने क्या कहा किसी के बारे में। इस कमरे में कई ऐसे लोग हैं जिनमें मैं भी शामिल हूं जो अंरुघति राय की कई चीजों से बिल्कुल भी सहमत नहीं हैं। लेकिन जो Voltaire की कहावत है कि गणतंत्र और लोकतंत्र की परिभाषा, कसौटी पर कि जब आपसे चाहे मैं बहुत बुरी तरह से भी असमहत हूं, तब भी आप खड़े होकर मेरी असहमती जाहिर करने के मानवाधिकार हक का समर्थन करें। ये चीज आज भारत से हटाई जा रही है, परोक्ष रुप से कम सीधे रुप से ज्यादा। इसके बहुत से उदाहरण हमने दिए एक आपने दिया। जब तक इस बात को समझा नहीं जाएगा वर्ष प्रतिवर्ष परिभाषा परिवर्तित होगी और भारत को अपना सर शर्म से झुकाना पड़ेगा।

एक अन्य प्रश्न पर कि पुलवामा में आज पाकिस्तान का राष्ट्रगान गाया गया है, क्या कहेंगे, श्री सिंघवी ने कहा कि भारतीय राष्ट्रीय कांग्रेस ने हमेशा भर्त्सना की है इस प्रकार की राष्ट्र विरोधी चीजों की। जो पहले हुआ है उसकी भी हमने भर्त्सना की है, लेकिन ये मुद्दा वो नहीं है। जो मूल मुद्दा है मीडिया उसको कई कारणों से भूल जाते हैं। पिछले 3 वर्षों से क्या ऐसी वारदातों में वृद्धि दोगुना-चौगुना नहीं हुई है? आप आंकड़े देख लीजिए। सबसे ज्यादा राष्ट्रवाद के सबक मैं सिखाता हूं और मेरी ही सरकार में ये होता है, ये विडंबना नहीं है क्या, केन्द्र में भी मेरी सरकार और राज्यों में भी मेरी सरकार, दिन प्रतिदिन, हर क्षण यही सिखाया जाता है कि राष्ट्रवाद क्या होता है, राष्ट्रवाद की परिभाषा सिखाई जाती है। ताने कसे जाते हैं, अपमान किए जाते हैं और आपकी नाक के नीचे ऐसा हो रहा है। आप असमर्थ क्यों हैं? आप जुमले देने में समर्थ हैं, उपदेश देने में समर्थ हैं, सिर्फ वाक्यों को बदलने में समर्थ है या फिर जमीनी स्तर पर भी कुछ करने में भी समर्थ हैं?

हुर्रियत पर पूछे गए प्रश्न के उत्तर में श्री सिंघवी ने कहा कि हुर्रियत के साथ बातचीत होनी चाहिए, नहीं होनी चाहिए उनको कब हाउस अरेस्ट पर रखना चाहिए, कब डिटेंशन में, कब उनके कारण पाकिस्तान से बातचीत तोड़नी चाहिए और कब नहीं। इन सबको एक नीति में पिरोना आवश्यक है। हमारा ये मानना है कि इनमें से कोई भी नीति सही हो सकती है। लेकिन इस सरकार का दुर्भाग्य ये है कि पिछले 3 वर्षों में अगर सोमवार है तो नीति उत्तर की है, मंगलवार है तो नीति दक्षिण की है। हफ्ते में 8 बार नीति बदलती है। ये सबसे दुर्भाग्य की बात है। कोई भी एक नीति बनाकर उस पर रहना, आपने देखा कि कैसे हुर्रियत के कारण कैंसिल हुई, अलाउ हुई, फिर हुर्रियत से ही जाकर मिलेंगे भारत से बाहर। फिर लंच हुआ पाकिस्तान के साथ। तो ये सब जो ज़िग-ज़ैग है, यू-टर्न है इससे गलत संदेश जाता है।

कश्मीर में सभी लोग केवल सरकार व सत्तारुढ़ दलों को छोड़कर चिंतित हैं। बहुत ज्यादा चिंतित है, विपक्ष के सभी हिस्से और वो हिस्से विपक्ष के जो आपस में सहमत नहीं हैं कई मुद्दों पर। ये राष्ट्र के लिए बहुत बड़ा महत्वपूर्ण बिंदु है पिछले 3 वर्षों में। कई स्तरों पर बात हुई है, आप विपक्ष की बात क्यों कर रहे हैं, खुद बीजेपी के कई सेक्शन, बीजेपी के पूर्व वित्त मंत्री इसमें हैं विपक्ष के साथ। ये सकारात्मक चीज है। इसमें राजनीतिक द्वेश की भावना से कुछ नहीं हो रहा है। लेकिन इसका क्या स्वरुप है, किस प्रकार से होगा उस पर नहीं जा सकते। निश्चित रुप से ये बहुत ही महत्वपूर्ण मुद्दा है और सरकार पिछले 3 वर्ष से इस पर अवहेलना कर रही है।

एक अन्य प्रश्न पर मणिपुर के मुख्यमंत्री के बेटे के मामले पर सुप्रीम कोर्ट का फैसला आया है उस पर क्या कहेंगे, श्री सिंघवी ने कहा कि ये चौंकाने वाली बात नहीं, बहुत ही दर्दनाक बात है, अगर आप उस परिवार की तरफ से देखें जिसके विषय में ये हुआ है। आप मणिपुर की सड़क पर दिन दहाड़े छोटे से झगड़े पर गन निकाल कर शूट कर देते हैं। मर्डर का चार्ज नहीं लगाया जाता है, डायल्यूट किया जाता है, Man slaughter – culpable homicide not amounting to murder का चार्ज लगाते हैं और जनवरी 2017 में साढ़े 4 साल के ट्रायल के बाद सजा मिलती है। 2017 के बाद आज मई साढ़े 4 महीनों में आपको बेल मिल जाती है और उसका विरोध भी नहीं किया जाता। सबसे बड़ी और महत्वपूर्ण बात इसमें प्रोसिक्यूशन ऐजेंसी कौन है, सीबीआई। केन्द्र भी आपका, प्रदेश भी आपका, तो ये प्रश्न उठता है कि क्या माननीय मुख्यमंत्री जी ने इसलिए पद संभाला था, इसलिए दल-बदल किया था, इसलिए अस्थिरता पैदा की थी। अस्थिरता द्वारा आपने सरकार बनाई थी, इसलिए की थी ताकि अपने लड़के को रिहा करा सकें? जितने भी आपको मोदी जी के उपदेश मिलते हैं, फरमान और जुमले मिलते हैं वो स्वच्छ और सुशासन के शब्द हैं या ये नई स्वच्छ और सुशासन की परिभाषा है जहाँ पर जोड़-तोड़ करके ये सरकार बनाई है और शायद इस सरकार के बनाने का एक उद्देश्य आपके सामने परिभाषित हो रहा है।

3 तलाक पर पूछे गए प्रश्न के उत्तर में श्री सिंघवी ने कहा कि इसमें दो पहलू हैं। एक तरफ तो अटार्नी जनरल ने कहा है कि अगर स्ट्राईक डाउन करते हैं तो हम नया कानून लाएंगे। ये प्रश्न उत्तर उस सुनवाई के दौरान भी हुआ था कि अगर आपने तलाक की पूरी प्रक्रिया को ही हटा दिया, असंवैधानिक करार दिया तो जहाँ पर नोर्मल तलाक है A और B के बीच में तो वो तलाक कैसे होगा, तो उसके उत्तर में कहा था कि हम कानून लाएंगे। लेकिन एक और प्रश्न है जो आप भूल गए- वैंकेया नायडू जी ने कहा कि अगर नहीं किया तो हम कर देंगे स्ट्राईक डाउन एक कानून लाकर। तो प्रश्न ये हुआ कि पिछले 36 महीनों से क्या कर रहे थे आप? उसी से हमारा प्रश्न उठता है कि आपने इतना मूल्यवान समय सुप्रीम कोर्ट का नष्ट क्यों किया? कानून ही ले आते, पूरी सुनवाई क्यों की? आपके अटार्नी जनरल एक आवाज में बोल रहे हैं, केन्द्रीय मंत्री, वरिष्ठ मंत्री दूसरी आवाज में बोल रहे हैं। लेकिन हम समझते हैं कि सभी आवाजें एक चीज के लिए हैं, इसे साम्प्रदायिक की भावना भड़काने के लिए कह लीजिए या विभाजन के लिए कह लीजिए, उसको प्रेरित करने के लिए है, वोट की राजनीति के लिए है।

This BJP-NDA Government is a Whatsapp Government, a Whatsapp driven Government. It thrives on emotions and vulnerabilities of the people and the uses it deliberately and mischievously to target those who may have different views, different ideologies. It has become the ‘Pehchan’, the modus-operandi and identity of the BJP. What is worse, it amounts to almost State-sponsored activity because every time we find, and some of these pictures in Media which show that the Police act as mute spectators. Law enforcement agencies are mute silent spectators – turning a Nelsonean blind eye but actually encouraging as there is no punishment, there is no fear, in fact therefore, is an encouragement. In Jharkhand, in fact, Police were present – seven people were killed by mobs and figure may increase – I was astonished and shocked to find that even an 80 years old grandmother of the victims was not spared – badly beaten. What is this India we are living – this un-Indian idea of the ‘Idea of India’? Is it the India of mob justice, instant nearest tree hanging, lynching justice in the world’s largest democracy which we are proudly practicing because the philosophy of the ruling dispensation encourage it. Is it a methodology used as an excuse, it is a mindset which covers up the real object which is anti-human rights which is anti-dalit, communal, which is divisive and which is anti-humanity.

This is my sad duty to remind you that Una in Gujarat when people were stripped, paraded naked, who were they, they were human beings like you and me.

Similarly Dadri and Mohammad Akhlaq are not just a statistics – they are imprinted through media into our collective memory. Gruesome incident and Union Minister Mr. Mahesh Sharma termed this gruesome incident as an accident. Is this an accident when people are picked, singled out, plucked out for instant mob justice on mere rumour, on mere suspicion, on mere finger pointing, on mere suggestion, on mere innuendoes, insinuation. 23 former Bureaucrats – some of them very senior level – urged the CM of Rajasthan to arrest those who killed Pehlu Khan. How long could it take? What happened – insensitivity happened, stony silence, inactivity and cover up followed – how many examples – from Jammu to Rajasthan to Haryana. They all happened to be BJP-ruled States is one part of the theory – whether it is Haryana gang rape of 20 years old in Rohtak, whose face was smashed with brick, whether it was the cow vigilantes’ brutal assault on a nomadic family in Jammu – so many examples. The point is that multiplication of examples really does not convey the agony and pain of this country. So, we ask you again is this the new India, is this the new normal of Modi Ji where Modi Ji practices either great ‘Jumlas’, high-sounding sermons or eloquent silence. But in fact, this practice is license to kill which would make James Bond gush. Is this the New India which Modi Ji wants to create, the so unindian India where ruthless mobs take law into their hands, where lynching is instant. Is this the intolerance – intolerance of majoritarianism and they are all encouraged, supported indirectly or directly promoted by the regressive and intolerant remarks of the BJP Leaders and senior bureaucrats and we are not talking of ordinary people, we are talking of Leaders like senior, MPs, MLAs, senior office-bearers.

Ultimately this is because the object is to either get or cling on to power by these divisive tactics, practiced through subterfuge. I have many more examples and particularly remind you of Dabolkar, Pansare and Kalburgi examples where for months and years, the PM has practiced a stony silence and I also remember Rohit Vemula’s example and I also remember the comments of Genl. VK Singh referring a Dalit child as a dog.

The rise of atrocities against Dalits has increased by 38% under the BJP Government at the Centre. Please note the year and the figure – 39,408 in 2013 and 54,355 in 2015 – this is the data of the NCRB – the highest were Rajasthan and Madhya Pradesh in the top four States as far as crime against Dalits are concerned.

On the question of reaction of the Congress Party on Mr. Paresh Rawal, BJP MP’s comments on Ms. Arundhati Roy, Dr. Singhvi said it is an important question, you have just validated it. The point of your question is larger and that is not that – I or you have to agree with Arundhati Roy. There are many people in this room who disagree with her including me.

It is precisely the definition of democracy that even when you violently disagree with someone, you will defend to death their right to disagree with you. She is a citizen of this country and for an MP, for the smallest ordinary citizen to express this view shows the mindset which has been and now that you have raised the question, consistently since 2014 they have an anti-NGOs mindset. They may disagree with you, what is the problem.

On the question on Manipur CM’s son, Dr. Singhvi said let me tell you that a man is convicted in 2017 – blunder No. 1 he is charged not for murder but for man slaughter. No. 2 – he is given 5 years and No. 3 apparently he is let off on bail and No. 4 from what we hear, the bail was not opposed. Now the question I am asking you – did this person become CM, did he break parties and defect only to ensure his son’s freedom? What is the object of the political shenanigans we saw in Manipur or is it contemplated that you pick up someone and shoot in road rage. And you are prosecuted and then in 2017 after four years convicted only of man slaughter and that too only 5 years. I think it is very sad and what pictures we have seen of the old mother and the family, is extremely tragic. The most important is that all the homilies that Mr. Modi gives, the NDA gives or the BJP gives, Goa and Manipur, you remember the actual results and this is the true face of the BJP who gives you homilies and sermons on clean governance.

On the situation in Kashmir and especially the incident in Pulwama, Dr. Singhvi said let me make it clear that in the sad trajectory since 1987 in Jammu & Kashmir and we now are roughly 30 years down the line, things have never spiraled out of control to the extent they have now under this Government for 2-1/2 years. Secondly, it is tragic because there is a tremendous theoretical synergy in between the same colour of Government at the Centre and the same coluor of Government in State which rarely happens in J&K. Even in spite of that we are in shambles. Civilian casualties, police casualties, and terror incidents numbers you see. Fourthly given this fact and every segment of the Opposition is very-very sensitively and gravely concerned about this rise, perhaps everyone except the Government of the State and the Centre. Therefore, it is not surprising that initiatives are being undertaken for this purpose. Initiatives have been taken by even former BJP Ministers – whether inside or outside the ‘Margdarshak Mandal’.

And therefore, in case the Government abdicates its constitutional duties for a sensitive State as J&K, it is but natural for Opposition that otherwise may differ across the board on many issues to get together and try their best although they were powerless beyond a point.

Regarding the violence in this connection, Dr. Singhvi further said we have as Congress Party condemned all symbolic, direct, indirect and other activities which are intended to promote separatism. We have condemned it and I repeat its condemnation but it raises a far more important question and that is that we have had the highest, largest number of homilies and sermons on Nationalism from this Government both at the Centre and at the State for the last 36 months. Never before have we been taught about so much about Nationalism – true or fake – and yes under the nose of this Government for the last 36 months, never before has J&K spiraled out of control with such incidents happening. So, follow up your question with the second question – why how is it happening, why is this Government failed at the State as well as at Centre level and yet shamelessly giving us sermons on Nationalism.

आपको मोदी जी के वो सब वाक्य याद हैं जो आपने 2013-14 में सुने, प्रचुर मात्रा में सुनें। उनके चुनावी घोषणा पत्र में लिखित रुप से 2 करोड़ रोजगार प्रतिवर्ष देने का वायदा किस बेशर्मी से तार-तार किया गया है। सच्चाई ये है कि आज जिसको आप विकास कहते हैं, जिसको आप विकास मानते हैं, नए आंकड़ों के आधार पर और सरकार के आधार पर, कभी 6 प्रतिशत कहते हैं कभी 7 प्रतिशत कहते हैं, लेकिन ये बात आधारित है कि रोजगार का विकास 1 प्रतिशत है। 1 प्रतिशत, बड़ा स्पष्ट है कि वो बिना रोजगार वाला विकास है। बेरोजगारी की ये बढोतरी है वो दुर्भाग्यपूर्ण और चौंकाने वाली है।

पौने 9 लाख था 2009-10 में नए रोजगार जो बनाए गए थे (2009-10 में 8.7 लाख था)। 2010-11 में सवा नौ लाख और 2014-15 में 1.35 लाख। ये मैं आपको सटीक फीगर बता रहा हूं। कहाँ 9 लाख और कहाँ 1.35 लाख? 7 गुना फर्क। 2 वर्ष से ये चल रहा है और ये सब संबंधित है, आपसी पारस्परिक संबंध रखते हैं। 63 वर्ष में सबसे न्यूनतम विकास है बैंक के क्रेडिट का, जो बैंक देते हैं, क्योंकि बिना बैंक के रुपए दिए गए। औद्योगिक विकास नहीं हो सकता, उद्योग की रफ्तार नहीं बढ़ सकती और उद्योग की रफ्तार के बिना रोजगार नहीं बढ़ सकता। 63 वर्षों में सबसे न्यूनतम दर बैंक क्रेडिट की अगर है तो अब है, 2016-17 में 5.3 प्रतिशत। IIP का जो विकास है वो बिल्कुल न्यूनतम है 0.6 प्रतिशत यानि आधा प्रतिशत, जनवरी 2017 तक।

हम ये सब आपके द्वारा इसलिए पूछ रहे हैं कि जुमलेबाजी जरुर कीजिए मोदी जी, वायदे जरुर कीजिए, बहकाइए और बरगलाइए जरुर लेकिन कृपया साथ-साथ ये जरुर बताईए देश को कि आप किस चीज का जश्न मना रहे हैं, किस चीज की बधाई आप दे रहे हैं? Job Loss के लिए, बेरोजगारी बढ़ाने के लिए? क्या ये आवश्यक है इतना बड़ा खर्चा करना? आप आशिंक रुप से रोजगार बढ़ाने के लिए इसका इस्तेमाल करते। आप क्या ठोस कदम उठा रहे हैं रोजगार बढ़ाने के लिए, औद्योगिक प्रोडक्शन बढ़ाने के लिए और बैंक क्रेडिट की दर बढ़ाने के लिए? ये आपके माध्यम से हम और पूरा देश पूछना चाहते हैं।

एक प्रश्न पर कि भाजपा 3 सालों का जश्न मनाने जा रही है, क्या कांग्रेस पार्टी के पास ऐसी कोई योजना है जो मोदी सरकार के दावों को नकार सकें, श्री सिंघवी ने कहा कि अगले 2 हफ्तों में आप देखेंगे कि भारत के विभिन्न भागों में हम सब लोग स्वयं अलग-अलग जाकर इन बिल्कुल निराधार, बेईमानी, बरगलाने वाले दावों और वायदों का पर्दाफाश करेंगें और दिल्ली के बाहर जाकर ये बताएंगे। चाहे कृषि क्षेत्र हो, राष्ट्रीय सुरक्षा हो, जम्मू-कश्मीर का मुद्दा हो या अन्य मुद्दे हों। जागरुकता आपके माध्यम से व्यापक तरीके से विभिन्न भागों में होनी चाहिए। प्रादेशिक शहरों में ये बहुत ही आवश्यक है।

अलग-अलग शहरों में जाते हैं मोदी सरकार की वायदा खिलाफी के बारे में कांग्रेस पार्टी तुलानात्मक आंकड़े देगी। रोजगार के हमने 2 आंकडे दिए। 8.7 लाख और 1.35 लाख का फर्क, ये क्या है? जम्मू-कश्मीर में 10 वर्ष में पर्यटन था, वोटिंग थी, रोजगार की जिंदगी चल रही थी, एक जो समता थी, स्थिरता थी, काम करने की शक्ति थी और जमीनी सच था वो आज से भिन्न था या नहीँ? निश्चित रुप से था।

एक अन्य प्रश्न पर कि बीजेपी सरकार में कांग्रेस के बड़े-बड़े नेताओं के ऊपर कार्यवाही की जा रही है, क्या कहेंगे, श्री सिंघवी ने कहा कि ये सत्य नहीं है। आप अगर अवसरवादी और सिलेक्टिव जांच करेंगे, आपको मालूम है कि ईडी ने और सीबीआई ने 34 लीडर के विरुद्ध कार्यवाही की है और उसमें से 30 विपक्ष के हैं। जनार्दन रेड्डी के केस में ईडी ने कुछ नहीं किया था, 500 करोड़ तो उन्होंने शादी में खर्च किया, उनको छोड़ दिया गया। सहारा में आपने खुद ने क्या तहकीकात की? 34 में से 30 आरोप लगाएंगे विपक्ष के ऊपर। आपने व्यापम को सीबीआई को सौंपा, डेढ़ वर्ष पहले सुप्रीम कोर्ट से डांट खाकर, लेकिन आज डेढ़ साल में सीबीआई ने क्या किया उसमें, कुछ हुआ? हिंदुस्तान का सबसे बड़ा मल्टीस्टेट स्कैम है, मृत्यु हैं उसमें पैसा है, क्या किया गया उसमें? GSPC में क्या किया? Selective Prosecution, opportunistic Prosecution से माहौल अपनी गलतियाँ छुपाने के लिए बना सकते हैं, क्योंकि आप सरकार में हैं, लेकिन हकीकत नहीं बदली जा सकती है

In several public rallies Mr. Modi would tell voters each and every time that just give BJP a chance to improve their lives with new jobs and I will give you one quotation, you have many of them – in 2013-2014, one of them says “I can’t do much about those in their 50s but I want to transform the lives of those in their 20s who are seeking new employment”.

Similar quotes are there in the BJP election manifestos and specifically in writing promising 2 Crore jobs every year. This is the claim, this is the ‘दावा’, and this is the false promise. Actually on the ground, we are having a ‘Pink Slip Season’ – you know Pink Slips are supposed to signify termination of employment. Every other quarter alarming figures are published showing (a) little or no growth or abysmal growth and (b) pink slips season. Labour Bureau has published it. In eight Labour Intensive Sectors and they are most vital Sectors of our economy – Construction and FMCG etc. etc. The growth is 1.1%. In Numbers, it is 1,35,000 jobs. If this is ‘Achhe Din’, then obviously the Government’s definition of ‘Achhe Din’ is ‘Achhe Din without Jobs’, ‘Achhe Din Jobs Bin’. I want to give you very recent history – not old history – within memory – recent past – recent published figures of jobs Creation in Lakhs in the last 5–6 years.

In 2009-10 Job creation was 8.7 lakhs. In 2010-11 9.29 lakhs. If you go from 2011-12, it is 3-1/2 Lakhs, 2013-14 it is 4.21 Lakhs, in 2014-15 it is 1.35 lakhs and in 2016-17 it is again 1.35 lakh – more or less static. Manufacturing, Construction, Trade, Transport; Hotels, Restaurants, IT, BPO – India was the toast of the globe in the BPO and IT Sectors. These are the figures from these 8-9 core sectors.

In this ‘Jumlebazi’ of this Government, I want to ask a few questions through the Media – what is it that they are celebrating? In the next few days, we are going to pan out in the country telling the disaster faced by each sector. It is important to be specific, it is important to nail the lies of the Government, it is important to be factual, it is important to pin point.

It is easy to avoid reality with ‘Jumlebazi’ but everyone is asking you what is it that they are celebrating? Are they celebrating Joblessness or they are celebrating Jobless Growth. What is the point of 6% growth or 7% growth, although it is only claimed and although it is only under the new series when admittedly the growth of Sectoral employment in the 9 most vital or the 8 most vital sectors of the country is only 1%. It is called Jobless Growth or growth without jobs. Is it this Joblessness or Jobless Growth or job losses or unemployment that the Government is celebrating?

The credibility of the Government, they are all linked – Bank Credit Growth – which is directly linked with the Business Growth which is directly linked to Employment Growth is at the lowest at 5.3% in 2016-17 and it is the lowest in last 63 years. The IIP data, which is the Industrial Data counting Industrial Growth – Production – all this ‘Make-in-India’ is mere all or the ‘Skill India’ is there – the IIP data shows flat trajectory or flat growth line of 0.6% till January 2017, close to a mere half a percent.

On the question of NIA investigation on receiving funds from across the border by Hurriyat, Dr. Singhvi said I want to Say two things – first and foremost – it is extremely serious, it is gross, brazen patent and deserves the strongest action in the shortest possible time and in the most effective manner. This undermines National Security directly and completely. But the second point is no less important and that is what we are seeing everyday-homilies, preachings, lectures, sermons being given by none less than High Government functionaries to which the entire country, in a bemused, amused manner, asks itself and the Nation asks itself that whom are you giving lectures to – you are the Government in Centre, you are the Government in J&K and yesterday I saw Minister of State giving a lecture on the subject. For the last 3 years both Central and State Governments individually and in coalition have done nothing and today you are lamenting.

And last third point I want to add is that this is serious no doubt but there is never and I repeat very clearly and categorically that there has never been such a rapid, accelerated tragic decline in governance in 36 months as there has been in last 36 months in J&K from any trajectory, any paradigm, be it casualties, violence, lack of governance, lack of decision making, lack of co-ordination, security scenario different departments and Ministers pulling in directions, no consistency of policy etc. etc. In 36 months we have seen the most rapid decline.

After all, we were there for ten years in Kashmir. We had external infiltrations but never before have we seen this kind of tragic state of affairs which makes the heart of every Indian bleed.

इस सरकार के आने के बाद, 2014 के बाद IT डिपार्टमेंट एक नोटिस देता है 6 वर्ष के पुराने असेस्मेंट को पुन: वापस खोलने के लिए। उसके दो कारण देता है, उसका जवाब जो भी होता है लेकिन आज की बात अगर संक्षेप में कहनी हो तो जब डिपार्टमेंट से चिट्ठी आ जाती है तो हम एक याचिका देते हैं, उच्च न्यायालय में। हमारा प्रमुख बेसिस उस याचिका में है कि डिपार्टमेंट के पास कोई भी Reason to believe नहीं था। Reason to believe एक कानूनी फ्रेज है जो अतिआवश्यक है, किसी नोटिस द्वारा पुराने वर्षों का किसी भी व्यक्ति का असेस्मेंट खोलने के लिए। तो हम याचिका में कहते हैं कि Reason to believe नहीं है डिपार्टमेंट के पास इसलिए कोई अधिकार क्षेत्र नहीं है कि 5-6 वर्ष पुराना असेस्मेंट खोलें। उच्च न्यायालय ने काफी समय तक उस मामले को सुना और ओपन कोर्ट में कहा कि आप याचक हैं, जो-जो आपको आपत्तियाँ हैं, हर आपत्ति को हम आपको छूट देते हैं कि आप वापस जाकर डिपार्टमेंट के सामने दोहरा सकते हैं और डिपार्टमेंट बाध्य होगा कानून के अनुसार निर्णय लेने का।

उसके बाद उच्च न्यायालय और स्पष्टीकरण देता है कि आप पुन: डिपार्टमेंट के पास जाकर अपनी सभी दलीलों को दोहरा सकते हैं, उसमें ये भी शामिल है कि आप डिपार्टमेंट को ये बता सकते हैं कि क्यों ये नोटिस जब तक Reason to believe नहीं हो, तब तक नहीं दिया जा सकता और क्यों इस केस में Reason to believe नहीं है। जब हमारी हर दलील को खुला रखा गया है, जब हमारी हर आपत्ति को पुन: वापस डिपार्टमेंट के सामने दलील के लिए छोड़ दिया गया। उसके बाद ऑर्ड़र में लिखित रुप से स्पष्ट शब्दों से कहा गया है कि हम ये लिबर्टी लेते हैं। तो हम क्यों बहस करें उच्च न्यायालय के सामने? इसलिए हमने Constitutionally याचिका को withdraw किया है। आपको सिखाया-पढ़ाया जा रहा है बच्चों की तरह, लुके-छीपे टिप्स दिए जा रहे हैं कि उच्च न्यायालय ने कहा कि डिपार्टमेंट जांच करो। 3 घंटे पहले का ऑर्डर निकाल लीजिए। कहाँ लिखा है ये, अगर लिखा है तो हम आपसे माफी मांगेंगे। 

क्या कि संतुलित सरकार का ये काम है कि इस प्रकार के बिना हस्ताक्षर के गलत, फरेबी, विकृत नोटिस द्वारा आपको बरगलाएं। कौन से नोट में लिखा है सोनिया गाँधी जी आप पेश हों, राहुल गाँधी जी आप पेश हों या अन्य कोई पेश हो, हमने तो नहीं सुना, मैं खुद वहाँ पर था कोर्ट में।

 हमने याचिका दी कि IT डिपार्टमेंट का अधिकार क्षेत्र नहीं है बिना Reason to believe पुराने 6 वर्ष के असेस्मेंट को खोलने का। उच्च न्यायालय ने डिटेल में सुनने के बाद ये होल्ड किया कि ये जो आप हमारे सामने आकर आपत्ति दर्ज कर रहे हैं, ये आप वहाँ जाकर कर सकते हैं। फिर स्पष्ट रुप से 8 लाईनों में लिख कर दिया कि आपको सिर्फ ये स्वतंत्रता नहीं है कि आप वापस जा सकते हैं और हर वो आपत्ति जो यहाँ लिखी है हमारे सामने, वो वहाँ भी रेज कर सकते हैं। including Reason to believe/ कि Reason to believe नहीं होने पर आप नोटिस जारी नहीं कर सकते इस मुद्दे को भी आप वहाँ रेज कर सकते हैं। ये अधिकार क्षेत्र का मुद्दा है। ज्यूडिशरी का मुद्दा है। इस कारण से,इस आधार पर, इस रिकोर्डिंग के बाद, इस लिबर्टी के बाद, कानून में इसे लिबर्टी कहते हैं, स्वतंत्रता के बाद जो लिखा है उसमें हमने याचिका withdraw की और मुझे बड़ा आश्चर्य हुआ ये देखकर कि 5 घंटे तक सरकार के पास कोई काम नहीं था, सब काम बंद हो गए। सिर्फ एक काम चल रहा है कि किस प्रकार से आप सब लोगों को बरगलाया जाए, जिसका सच से कोई सरोकार नहीं है।

 मैं ये भी स्पष्ट करना चाहता हूं कि कांग्रेस बहुत गौरव महसूस करती है कि नेशनल हैराल्ड जैसे अखबार के साथ कांग्रेस का नाम जुड़ा है और कांग्रेस के साथ नेशनल हैराल्ड का नाम जुड़ा है। ये स्वतंत्रता से पहले का अखबार है। जिस वक्त हमारे सोचने की, बोलने की, अभिव्यक्ति करने की, मानवाधिकार का हनन और कुचलना ब्रिटिश सरकार कर रही थी, आज बहुत हद तक आज उस जैसा वातावरण ही है। उस वक्त भी तीव्रता से, जोश और हौसले से नेशनल हैराल्ड ने अपनी आवाज उठाई थी और उसी तरह से कांग्रेस पार्टी आज भी अपनी आवाज उठाती रहेगी।

हमने पहले भी इस पोडियम से नेशनल हैराल्ड के विषय में तथ्य पहले भी दिए हैं। लेकिन संक्षेप में मैं आपको याद दिला दूं कि क्या मिथ्या प्रचार हो रहा है, क्या ये संभव है कि कोई भी संपत्ति अचल या चल कोई व्यक्ति हड़प सकते हैं। ये सब उस कंपनी के साथ हैं, उस कंपनी के स्वायत्तव में है जो एक सेक्शन 25 कंपनी है। 25 कंपनी की परिभाषा ही ये है कि ‘नोट फॉर प्रोफिट कंपनी‘ होती है। इसका मतलब है कि जो लाभ के लिए नहीं बनाई गई है। किसी प्रकार से अपने लाभ का वितरण नहीं कर सकती। डॉयरेक्टर और शेयरहोल्डर को उसका फायदा नहीं हो सकता। ये वो कंपनी है। क्या लोन लिया जा सकता है, दिया जा सकता है? हर राजनीतिक पार्टी में ये है, एक्ट के सेक्शन 13 में बड़ी स्पष्ट अनुमति है। तो क्या ये प्रोपर्टी को हड़पने का प्रयत्न हुआ। एक एंटिटी से दूसरे एंटिटी वो भी सेक्शन 25 में ‘नोट फॉर प्रोफिट कंपनी‘ है, जो। सेक्शन 25 Not for Profit, उसको कहते हैं कि कंपनी हड़प ली, ट्राँसफर कर ली। तो मैं कहूंगा कि इसमें उल्टा, बौखलाहट, भय वो इस सरकार का झलकता है और वो समझते हैं कि इससे हमें भयभीत करेंगे तो उनको जाकर अपना इतिहास पढ़ना चाहिए।
