The defining characteristic of PP Rao ( or PPji as I used to call him) was sobriety, balance and equanimity. His speech, his demeanour, his style, his idiom, his tonality, his volume, even his gait, would not change, irrespective of the provocation, irrespective of his opponent, irrespective of the judge’s query and irrespective of the surcharged nature of the surrounding ambiance. One would never expect, and never did one see, any trivialization, any hitting below the belt, any cheapness of discourse or any vulgarity of speech or conduct, all of which are ever present in our tension ridden profession and are liable to overwhelm the best of individuals. PP Rao’s inherent balance and restraint shone unwaveringly and undiluted in his personality, at least during the 40 odd years that I have seen him or interacted with him. It must have come either from an inherent inner calm and stability or cultivated by some special form of meditation, though I never got around to asking him about this important recipe.

Secondly, this defining part of his persona was a fortiori creditable, for PP ji experienced several turbulences, not least being the long, crippling illness of his wife and, to a lesser extent, the divorce of his son. It was only his inherent persona, his innately gentlemanly nature and his inner  philosophical approach that allowed him to continue to take his Ooty summer holidays, alone but dignified in solitude and immersed in simple living, high thinking and surrounded by books.

Similarly, it was this persona which led his ( divorced) daughter in law to work with, help and promote the legacy of her late father in law ( including the present publication) without rancour, ill will or bitterness ( for which she, in turn, deserves kudos). Those adjectives were as alien as planet Pluto to PPji!

Thirdly, he was one of the few senior practicing advocates in India with a genuine interest in academics. Having myself pursued the lonely furrow of a PhD at Trinity College, Cambridge and having started some teaching there before returning to India almost by chance, I could relate more easily to his academic impulses. We indulged our vicarious pleasures for academia by discussing new academic legal and non legal research, Memorial lectures, articles and speaking as much as we could at seminars and colloquia. But his eyes would always light up when the talk turned from banal cases appeared in court  to harder core academic subjects and he would be ready to miss professional preoccupations if asked to attend or participate at such fora. One week for these academic pursuits was especially reserved during the June in addition to his beloved Ooty holidays.

Fourthly, though he was my father’s contemporary, our independent relationship started much, much before my father’s demise. PPji never allowed any generation gap to emerge and discussed all and sundry freely with me. Not only was he a fixture at every legal function of mine ( including  farewells to retiring SC judges), but his attendance was remarkable and unprecedented viz approx 95% over a twenty year period! On the few 5% occasions he missed, I could expect with unfailing promptitude and gracious elegance a handwritten letter, expressing regret and specifying the unavoidable exigency resulting in his absence. Every pore of his personality exuded his genetic gentlemanliness.

Fifthly, I have not seen his genuine and inbuilt commitment to secular, inclusive and pluralistic principles vary once, even slightly or symbolically, right through his life. He remained steadfast and single minded, prepared to do Ekla Chalo on the path of this guiding polestar, irrespective of deserters along the arduous path ( and deserters there were, including some close friends!). On anchor principles, he was never opportunistic, never transient, never selective, never flexible. Indeed, he was always deeply saddened towards the end of his life and for some years leading up to his death, with the culture of divisiveness, the idiom of intolerance and the emerging ambiance of hatred. Till he came to court, this was the first topic of discussion he would start with me.

Lastly, in his chosen vocation (ie Law), PP Rao displayed old world charm and talents which all new entrants and young practitioners would do well to emulate. I had the privilege of working with him in a few cases in my early years, the pleasure of opposing him in many, many more and the singular honour of leading ( at his request) in some, over our long association of almost four decades. He would be meticulous and laborious to a fault, irrespective of the weight or importance of the brief. The list of dates was almost 100% mandatory, usually dictated personally. Every proposition, every point, was diligently identified, persistently pursued and either included in the right order or discarded, yielding a final and most comprehensive dictated note / written submissions. I don’t think he deviated from this exhaustive ( and exhausting!) process even once in his long career. He would then argue them as per his pre decided hierarchy of importance and would be unmoved and undeflected, despite interrupting or unsympathetic judges. But never once would he be rude, combative or even abrasive. Over time, judges, well versed with his impeccable manners, reciprocated.

PP Rao deserved more, much much more. He was of the old mould, gentlemanly, principled, restrained, unostentatious but solid, both in substance and in belief. That is why old is gold. He scored extremely high, indeed superlatively high, in the four core tests making up a personality viz temperament, talent, character and ideology ( as our close mutual friend Jaipal Reddy always put it). Posts, power, pelf and position do not a man define. PP Rao had in him each of the 60 seconds which made him the complete Rudyard Kipling man, making each second in the minute count.

I deem it a great privilege and an enormous pleasure to contribute this short piece in memorium to a great human being and my dear friend and elder, PP Rao.

Delegation of 22 opposition parties met the Election Commission of India at Nirvachan Sadan, New Delhi, today. Shri Ghulam Nabi Azad, Leader of Opposition (Rajya Sabha) and Dr. Abhishek Manu Singhvi, MP, Spokesperson AICC addressed the media outside the Nirvachan Sadan.

We have raised the same issues in the last 1-1/2 months in writing, in a delegation of the Congress, in delegations combined of the Congress, TDP and other parties. Now, we asked the EC why they have not responded. Well, strangely, although the EC has heard us for an hour, they are saying now, they assured that they will meet again tomorrow morning to consider primarily these two issues.

The second point we made was that even if you, the EC, disagrees with us, there is nothing to disagree, it is a very small, simple thing, which is a confidence building measure, but, if you disagrees with us also, if 75% of the electorate represented by these 22 parties has before you, how does it matter if you change the rules, which is not even a rule change, it is merely a change of a guidelines, the procedures that you count first. I think, this is if I may use that phrase with great respect, a no brainer and the EC has not decided it for 6 weeks, they are now saying that they will again meet tomorrow.

The second point is that if a glass of milk by a sample, a sample as they say is supposed to be a subset of the universe. If a subset of the universe is a sample is found poisoned as the Supreme Court says in 5 sample checks you find it discrepancy between the VVPAT and the EVM, then it is obvious that the universe, which that sample represent is vitiated. So, it is obvious that if a sample check, what is the purpose of sample check by the Supreme Court, the purpose of sample check is to see whether the whole universe is vitiated. If the sample finds it to be vitiated by discrepancies, why should it not count 100% of VVPAT? We are only asking for a counting of 100% of VVPATs and remember Rs. 9,000 crores were spent to ensure that 1 EVM has 1 corresponding VVPAT. This also happened over a 3 years campaign. Why should you have these VVPATs as decorative, ornamental pieces and not count them after finding a sample problem?

श्री गुलाम नबी आजाद ने पत्रकारों को संबोधित करते हुए कहा बैठक में तकरीबन 22 राजनीतिक दलों ने भाग लिया, जो देश के 75 प्रतिशत वोट को रिप्रजेंट करते हैं, और डेढ़ घंटा विपक्षी दलों की मीटिंग हुई और सभी राजनीतिक दलों ने मीटिंग में बताया, अपने-अपने प्रांतों में कि किस तरह से ईवीएम की कुछ मशीनें कई गाडियों में आ रही हैं, जा रही हैं, स्ट्रांग रुम के आस-पास में जा रही हैं, प्राईवेट गाड़ियों में आ रही हैं और सभी राजनीतिक दलों ने बताया कि इलेक्शन के वक्त भी कई ईवीएम खराब थी और कई ईवीएम मशीन्स पर जब एक राजनीतिक दल के उम्मीदवार का बटन दबाते थे, तो दूसरी पार्टी का, विशेष रुप से भारतीय जनता पार्टी के नाम पर वोट चला जाता था। ये तमाम चीजें हम लोगों ने इलेक्शन कमीशन और चीफ इलेक्शन कमिश्नर के सामने रखीं और हमने पिछले 3-4 साल से ईवीएम्स के बारे में जो शिकायत है, जो इलेक्शनों में शिकायतें मिलती हैं, उन सबको, लोक सभा, राज्य सभा और विधानसभाओं में इसके बाद भी जनता में उठाया है और कई दफा हम कमीशन से मिले हैं सभी राजनीतिक दल।

आज हमने 2-3 चीजें मोटी-मोटी बताई हैं, अभी सुप्रीम कोर्ट ने तो अनुमति दी है कि हर विधानसभा में रेंडम 5 ईवीएम मशीनों के जो वीवीपैट हैं, स्लिपें, वो गिननी चाहिए लेकिन इलेक्शन कमीशन में उसमें निकाला है जो ऑर्डर उसमें कहा है कि पहले काउंटिंग हो जाएगी और उसके बाद वीवीपैट गिने जाएंगे। हम लोगों ने कहा, 22 राजनीतिक दलों ने कि नहीं, आप पहले तो वो जो 5, एक विधान सभा में 5 पोलिंग स्टेशनों की जो 5 मशीनें गिनोगे, वो सबसे पहले गिनोगे, क्योंकि अगर उसमें गलती होगी, तो फिर आप उस पूरी विधानसभा के वीवीपैट को गिनना चाहिए, वरना बाद में कोई फायदा नहीं है। तो ये हमारी सबसे बड़ी मांग है कि एक तो वीवीपैट की गिनती पहले होनी चाहिए, उसके बाद बाकी ईवीएम की गिनती होनी चाहिए। दूसरा अगर उन 5 पोलिंग स्टेशन्स में कोई गड़बड़ी पाई जाए, डिस्क्रिपेंसी पाई जाए, तो पूरी विधानसभा के सभी वीवीपैट को गिनना होगा, एक मशीन में भी अगर गड़बड़ निकला, तो पूरी विधानसभा के वोट दोबारा से गिनना चाहिए।

इलेक्शन कमीशन ने हमको कहा कि इलेक्शन कमीशन दोबारा बैठेगा और इसके बारे में वो निर्णय लेंगे ये उन्होंने कहा कि वो ओपन माइंड है और इसके बारे में डिटेल हमारे बाद में देंगे।

डॉ. अभिषेक मनु सिंघवी ने कहा कि माननीय आजाद जी ने आपको अहम दो मुद्दे बता दिए, मूल मुद्दा ये है कि हमने विभिन्न प्रकार से पिछले डेढ़ महीने में ये मुद्दे बार-बार उठाए हैं।

Shri Rajeev Shukla, former Union Minister addressed media at AICC Hdqrs, today.

Through everything which I want to bring in your notice, is that there are lot many complaints pouring from all parts of the country, nook & corner of the country about the movement of EVM machines through trucks, through people, through police, so, basically people are very suspicious about them. The Election process in India should be above any kind of suspicion or doubt. That should be ensured by the Election Commission of India. I would urge the Election Commission to take immediate steps by removing this kind of suspicion and they should come out with statement clarifying the situation even if those were the reserve machines, the movement should take place with the knowledge of the candidates, their representatives and political parties. What is the harm in it? Just show it to them and the security of the strong rooms should also be ensured because day after is the counting day. So, all these steps should be taken, this is what I want to urge to the Election Commission. The high level delegation of different opposition political parties will also call on the Election Commission, today, this afternoon and this issue will be taken up.

On a question related to Exit polls, Shri Shukla said- Earlier, I have also said that Exit polls are entertainment, so, we don’t entertain them. Let them come up. But, you know the real result is going to come on 23^rd May, 2019. We should only react about it after the real result is there. So, now lot many jokes are also doing the rounds about Exit polls. So, Exit polls, we are not taking that seriously. It is the job of the channels and agencies to run Exit polls. So, they are doing their jobs, we have not got any problem with that, but, the same time, we don’t pay much attention to it. The results are going to be altogether different from what is being shown in Exit polls.

If it doesn’t’ get tally with VVPAT, the actual result on those five booths than what step Election Commission will be taking? That is not clear in their guidelines. So, that should be made clear after that what step are you going to take? We will raise the issue and seek further action in this regard.

श्री राजीव शुक्ला ने पत्रकारों को संबोधित करते हुए कहा कि चंदौली, फतेहाबाद, डुमरियागंज, झांसी, गाजीपुर, सारन, बिहार, पानीपत, हरियाणा, पंजाब, तमाम राज्यों से रिपोर्टें आ रही हैं कि अवैध ढंग से गाड़ियों में ईवीएम मशीनें इधर से ऊधर जा रही हैं। जो तर्क है, कि साहब ये रिजर्व मशीनें हैं ये जा रहीं हैं, अगर रिजर्व मशीनें भी हैं तो उनको कैंडिडेट्स के लोगों को दिखाकर आप भेजिए। आप जो ये रात के अंधेरे में मशीनें इधर से उधर जा रही हैं, उससे शंका बढ़ रही है, शक बढ़ रहा है लोगों का और इस तरह कई प्रत्याशी, कई जगह धरने पर बैठे हैं। तो मैं चुनाव आयोग से आग्रह करुँगा कि उनकी जिम्मेदारी बनती है कि लोगों के संदेह को दूर किया जाए, लोगों के शक को दूर किया जाए, लोगों को विश्वास हो कि निष्पक्ष चुनाव हुआ है। इसलिए उसको इंश्योर करने के लिए चुनाव आयोग को कारगर कदम उठाने चाहिए, चुनाव आयोग को तत्काल इस पर कार्यवाही करनी चाहिए।

जहाँ पर इस तरह की मशीनों की रफतरी हो रही है अवैध ढंग से, वहाँ पर उनको तुरंत कार्यवाही करनी चाहिए और एक पूरा खुला स्पष्टीकरण देश की जनता को देना चाहिए, वरना लोगों का शक बढ़ता जा रहा है, लोगों का गुस्सा बढ़ता चला जा रहा है। इसलिए चुनाव आयोग से मेरा आग्रह है कि इस मामले में तत्काल प्रभावी कदम उठाए जाएं, इस सिलसिले में सभी दलों का डेलिगेशन भी आज चुनाव आयोग से मिलेगा, उसमें भी शिकायत को दर्ज करेगा, लेकिन चुनाव आयोग को शिकायतों को नजरअंदाज नहीं करना चाहिए, बल्कि उनको नोटिस देना चाहिए, तत्काल कड़ी कार्यवाही करनी चाहिए।

मैं नहीं कहता हूँ कि क्या गड़बड़ी और क्या नहीं गड़बड़ी हुई है, लेकिन लोगों में विश्वास कायम करना चाहिए, राजनीतिक दलों को चुनाव प्रक्रिया के बारे में विश्वास कायम रखना चाहिए, वो सबसे बड़ी बात है,

कांग्रेस महासचिव श्रीमती प्रियंका गांधी वाड्रा के ऑडियो संदेश से संबंधित एक अन्य प्रश्न के उत्तर में श्री शुक्ला ने कहा कि उनको इसलिए कहना पड़ा क्योंकि एग्जिट पोल के जरिए पूरे देश में ऐसा माहौल बनाया जा रहा है कि लोग, कार्यकर्ता कहीं ये न समझ लें कि जैसे एग्जिट पोल नतीजे ही हैं, चुनाव परिणाम है, कार्यकर्ताओं की ओर से कहीं किसी किस्म की ढिलाई नहीं होनी चाहिए। जो काउंटिंग एजेंट्स हैं, उनको पूरी तत्परता रखनी चाहिए और पूरी मुस्तैदी से उनको वहाँ डटे रहना चाहिए, क्योंकि जो माहौल बनाने की कोशिश की जा रही है कि एग्जिट पोल के जरिए कि, जैसे नतीजे ही आ गए हों, रिजल्ट आ गया हो। ये चुनाव परिणाम बिल्कुल नहीं है, एग्जिट पोल कुछ एजेंसीज करती हैं, कुछ चैनल्स दिखाते हैं, वो उनका काम है, वो ठीक है हमें उस पर कोई आपत्ति नहीं है, लेकिन इसकी तरफ बिल्कुल ध्यान पार्टी कार्यकर्ताओं को नहीं देना चाहिए और उनको अपना काम मुस्तैदी से काउंटिंग के दिन करना चाहिए, स्ट्रांग रुम जहाँ-जहाँ मशीने रखीं हैं, उसके बाहर बराबर पूरा कड़ा पहरा देना चाहिए ताकि किसी किस्म की कोई गड़बड़ी न होने पाए।

एक अन्य प्रश्न पर कि इसको मनोरंजन क्यों कह रहे हैं आप, श्री शुक्ला ने कहा कि एग्जिट पोल एक प्रकार से मनोरंजन ही है, मजा आता है लोगों को देखने में, तो ये होता है तो इसके लिए तो ये कोई रिजल्ट थोड़े ही न है। एक अनुमान लोग लगाते हैं, अपने-अपने हिसाब से, सबका अनुमान अलग-अलग है, कोई नतीजे तो हैं नहीं।

चुनाव आयोग को लेकर उप राष्ट्रपति श्री प्रणव मुखर्जी के दिए बयान से संबंधित एक अन्य प्रश्न के उत्तर में श्री शुक्ला ने कहा कि प्रणव बाबू ने कहा है उनके विचार बिल्कुल ठीक है, चुनाव आयोग को उन्होंने कहा है कि उनको अधिकार है अपने विचार व्यक्त करने का लेकिन उसके साथ-साथ उन्होंने एक बात और भी कही है उस पर किसी का ध्यान नहीं जा रहा प्रणव बाबू ने जो कहा है, उसको कोई नहीं कोट कर रहा कि चुनाव आयुक्त नियुक्त करने की प्रक्रिया में बदलाव होना चाहिए। चुनाव आयुक्त कैसे नियुक्त किए जाते हैं, इसकी प्रक्रिया नए ढंग से शुरु करनी चाहिए, इसके लिए बिल्कुल नया होना चाहिए, जैसे आप सीवीसी बनाते हैं, या सीबीआई डायरेक्टर बनाते हैं, उसमें विपक्षी दल के लोग भी शामिल रहते हैं, उसी तरह चुनाव आयुक्तों की नियुक्ति के लिए भी कोई ऐसी प्रक्रिया होनी चाहिए जिससे उनकी नियुक्ति लोगों को निष्पक्ष लगे, सिर्फ सरकार का विशेषाधिकार न हो।

एक अन्य प्रश्न पर कि आपने जो ईवीएम को लेकर और चुनाव आयुक्त को लेकर जो सवाल खड़े किए हैं, क्या कहेंगे, श्री शुक्ला ने कहा कि जो राष्ट्रपति जी ने जो अपने विचार व्यक्त किए हैं, हम उनके बयान पर कोई टिप्पणी नहीं करते लेकिन उनके इस बयान की ओर जरुर ध्यान दिया जाना चाहिए कि चुनाव आयुक्तों की नियुक्ति कैसे होती है, इस प्रक्रिया को बदला जाए।

एक अन्य प्रश्न पर कि चुनाव आयोग में आप वीवीपैट को लेकर गिनती की मांग है उसको लेकर क्या कहेंगे, श्री शुक्ला ने कहा कि वीवीपैट की गिनती को लेकर चुनाव आयोग से हम ये कहने जा रहे हैं हमने कहा है कि मान लो कहीं वीवीपैट का मिलान सही नहीं निकला ईवीएम मशीन के साथ तो उसके बाद कार्यवाही क्या है? ये तो बताइए न, वो तो चुनाव आयोग ने, अपनी गाइडलाइन्स में कहीं स्पष्ट नहीं किया है कि अगर वो मिलान सही नहीं निकलता है, वीवीपैट के साथ तो वो फिर उसके बाद क्या कदम उठाएगा, इस बारे में हम अपनी मांग चुनाव आयोग से रखेंगे।

डॉ. अभिषेक मनु सिंघवी ने पत्रकारों को संबोधित करते हुए कहा आप देख रहे हैं, व्यापक डेलिगेशन गया, लंबी बातचीत हुई। पहला महत्वपूर्ण मुद्दा था, पश्चिम बंगाल के विषय में और जिसे विशेष बिंदु पर महत्व रखा वो ये है कि चुनाव आयोग ने बिना किसी एक न्यायिक प्रक्रिया के, सुनवाई के, बिना दोष निश्चित करे एक ब्लैंकेट, सामूहिक चुप्पी वाला समय 24 घंटे से बढ़ा दिया, यानि उन्होंने ये निर्णित नहीं किया कि ये दंगेबाजी किसने की थी, तो इसका परिणाम ये हुआ कि जो लोग दंगा करते हैं और हमारा सीधा आरोप, इन्हीं कई सारी पश्चिम बंगाल की नॉन बीजेपी, नॉन एनडीए पार्टीज का ये आरोप है कि विद्यासागर जी की मूर्ति को तोड़ना, रोड़ शो के दौरान दंगा और जितनी भी हिंसा हुई उसका सीधा आरोप, सीधी जिम्मेवारी बीजेपी के ऊपर है, तो ये बिना निर्णित किए, अगर चुनाव आयोग एक ब्लैंकिट रुप से 24 घंटे की अवधि बढ़ा देती है, चुप्पी वाले पीरियड की तो इसका परिणाम बड़ा विचित्र होता है और बहुत बड़ी विडम्बना है कि जो व्यक्ति दोषी है, उसको अपने गलत काम का फायदा मिल जाता है। जो व्यक्ति इनोसेंट है, जो अभियुक्त नहीं है, यानि सभी गैर बीजेपी पार्टियाँ उनको इसका खामियाजा उठाना पड़ता है कि उनके कैंपेन की अवधि 24 घंटे और कम हो जाती है।

हमको विस्तृत रुप से सुना चुनाव आयोग ने और हम बार-बार ये कह रहे हैं कि अगर सीधा कैमरा के आधार पर, वीडियो के आधार पर, आपकी सब रिपोर्ट्स के आधार पर ये हिंसा बीजेपी के लोगों ने की है तो उसका खामियाजा बाकी नॉन बीजेपी, नॉन एनडीए पार्टीज क्यों उठाए और इस बात का हमें पूरा संतोषजनक जवाब नहीं मिला है, चुनाव आयोग से और हम अपने सभी अधिकार क्षेत्र को जाने के अपने विकल्प रिजर्व करते हैं।

दूसरा मुद्दा था, दोस्तों 7 या 8 बहुत महत्वूर्ण हमने सेफगार्ड्स जो आश्वस्त करेंगे, जो हौसला बढ़ाएंगे, कॉन्फिडेंस बिल्डिंग उपाय हैं, ईवीएमस के विषय में, गणना के दिन की उनकी सूची वापस दोहराई, वापस याद दिलाया चुनाव आयोग को कि हमने ये 7-8 मांगे, लगभग 2-3 हफ्ते पहले की थी, उसके बावजूद चुनाव आयोग का अभी तक कोई संतोषजनक जवाब नहीं आया है। इन 7-8 मांगों में सबसे महत्वपूर्ण है ये कि उच्चतम न्यायालय के आदेश के अंतर्गत अगर 5 गुणा बढ़ गया है, वीवीपीएटी का सैंपल चैक करने का उत्तरदायित्व, तो अगर उनमें से कई वीवीपीएटी खराब निकली या जिनका मेल नहीं हुआ ईवीएम से तो उसके बाद आप क्या एक्शन लेंगे। आपको पूरी कॉन्स्टिट्यूएंसी में वापस रिपोर्ट करवाना चाहिए, इसके लिए आपने आज तक कोई गाइडलाइन, नियम घोषणाएं ही नहीं कि है। हमने ये मांग 15 दिन पहले की थी और साथ-साथ हमने यह मांग 15 दिन पहले की थी कि कौन सी मशीन किस बूथ में गलत या फॉल्टी पाई गई है, कौन सी मशीन ट्रांस्फर कहां से कहां गई है, कौन सी मशीन किस नंबर से, यानि मशीन का नंबर रिप्लेस हुई है, बदली गई है, इत्यादि, इत्यादि ये लिखित रुप से सूचित करना चाहिए, सभी पार्टियों को नहीं तो इस अदला बदली, इस रिपेयर मेंटेनेंस इस इवीएम्स को मूव करने, स्थानांतरण करने की प्रक्रिया में बहुत सारे घपेले हो सकते हैं। ये हमारे सात बिंदु, जिनको हम सेफ गार्ड्स बोलते हैं, जिनसे कि पूरा देश आश्वस्त होगा, आज 15 दिन के  बावजूद चुनाव आयोग ने इस पर कोई जवाब हमें नहीं दिया है, कोई भी नहीं दिया है, यद्यपि आज हमें आश्वस्त किया कि जल्द से जल्द जवाब देंगे।

तीसरी हमारा मुद्दा था, मुंगेर के विषय में, सीधा मुद्दा था ये कि मुंगेर में हमारे कहने पर दो पोलिंग बूथ, जहाँ की एफआईआर थी, वहाँ पर रीपोल घोषित किया गया। हमने कहा था कि 29 अप्रेल के चुनाव में गड़बड़ियाँ थी, घपले थे, उनको दो पोलिंग बूथ के विषय में मान कर उन दो पोलिंग बूथ पर पुनः चुनाव हुआ 6 मई को, लेकिन हमारी आज की कंप्लेन ये है कि इसी प्रकार से 4 और पोलिंग बूथ पर वैसे ही घपले हुए, उन्हीं प्रावधानों के अंतर्गत एफआईआर हुई और आपने करीब-करीब समान चीज के विषय में उन चार में पुनः पोलिंग का आदेश नहीं दिया है। इसलिए हमने मांग की है कि ये डिस्क्रिमिनेटरी है, अभी एक चरण बचा है, 19 तारीख को आप हमारी मांग मानकर वो बाकी चारों इलाकों में भी मुंगेर के 4 पोलिंग बूथ पर पुनः पोलिंग करवाई जाए।

चौथा हमारी एक बहुत विशेष याचिका थी, जो थी आंध्र प्रदेश से और मेरे आंध्र प्रदेश के कौलीग यहाँ खड़े हैं। आंध्र प्रदेश के विषय में हमने कहा कि समतल स्टैंडर्ड्स नियम लागू नहीं किए जा रहे हैं। जो आंध्र प्रदेश में हो रहा है वो पश्चिम बंगाल में उसके विपरीत कर रहा है चुनाव आयोग। जो पश्चिम बंगाल में चुनाव आयोग कर रहा है, उसके विपरीत कर रहा है आंध्र प्रदेश में और इसमें हमने कहा कि जहाँ पर चीफ सेक्रेटरी आंध्र प्रदेश ने एक रिपोर्ट भेजी, उसके आधार पर 34 जगह रीपोल कर दिया जबकि वहाँ पर कोई ऐसे तथ्य. नहीं थे, जबकि वहाँ पर कोई ऐसी जांच नहीं थी और जब पड़ोसी पश्चिम बंगाल में चीफ सेक्रेटरी ने लिखित रुप से कहा कि ये रीपोल आवश्यक है तो उसको स्थानांतरण कर दिया, उसको अपनी पोस्ट से हटा कर अलग जगह भेज दिया, तो ये किस प्रकार का दोगलापन है, अनुच्छेद 14 का उल्लंघन कैसे हो सकता है, एक चीफ सेक्रेटरी के गलत रूप से सुझाव को मान लेते हैं, दूसरे चीफ सेक्रेटरी का आप स्थानांतरण कर देते हैं, इसको उठाया मेरे सभी कॉलीग्स ने और ये बहुत महत्वपूर्ण मुद्दा है।

अंतिम बात रायबरेली से संबंधित रखी। रायबरेली में एक विचित्र बात है और हमने कहा जो मैं दोहरा दूँ कि चुनाव हो गया है रायबरेली में। चुनाव था 12 तारीख को, लेकिन 12 तारीख को और 14 तारीख को जो हुआ चुनाव के बाद रायबरेली में वो ट्रेलर है हमारे अनुसार उस बात का द्योतक है, उस बात को परिलक्षित करता है कि 23 तारीख को क्या होगा, यानि वो गलत काम का ट्रेलर है पहले से 23 तारीख के गलत काम का। क्या बात है, बात ये है कि हमने नाम लिया है, वहाँ पर एसपी हैं, विनीत सिंह जी, हमने कहा है कि उनका तुरंत स्थानांतरण होना चाहिए, मिनटों, सेकंडों में। वो बेशर्मी से, खुलेआम वहाँ के बीजेपी कैंडिडेट, जो हैं श्री दिनेश सिंह,  दिनेश सिंह जी का पक्ष ले रहे हैं।

तीसरी बात, इसका प्रमाण हमें 2 दिन चुनाव के बाद मिला। चुनाव हुआ 12 तारीख को, 14 तारीख को जिला पंचायत का चुनाव था, वहाँ पर, जहाँ इसी दिनेश सिंह, बीजेपी कैंडिडेट के सगे भाई श्री अवधेश सिंह खड़े थे। जिला पंचायत के चुनाव में श्री अवधेश सिंह के विरुद्ध अविश्वास का एक रेजोल्यूशन था, उस अविश्वास रेजोल्यूशन को पेश नहीं करने दिया। इन्हीं एसपी ने, इन्हीं के दस्तों ने अवरुद्ध कराया हमारी गाड़ियों को, अवरुद्ध कराया लोगों को पहुंचने से, तो अगर उस इलाके के एसपी का व्यवहार ऐसा है, एक जिला पंचायत के चुनाव के लिए, एक नंगा पक्षपात है, बीजेपी के कैंडिडेट और उनके भाई के विषय में तो हम क्या अपेक्षा कर सकते हैं। 23 तारीख को गणना क्या ऐसे व्यक्तियों के निरीक्षण, परिक्षण में     होगी। गणना की निष्पक्षता और स्वच्छता क्या ऐसे अफसर निश्चित करेंगे, तो इसलिए इसको सैनिटाइज करना, ऐसे व्यक्तियों को हटाना, सबको एक संदेश भेजना कि वहाँ पर बिल्कुल सफाई रहेगी और समतल जमीन रहेगी अति आवश्यक है और तुरंत करना चाहिए।

डॉ. अभिषेक सिंघवी ने कहा कि संघीय ढांचा नहीं है, संघीय सहयोग नहीं है, इस सरकार की सच्चाई है, संघीय फासीवाद, फासिज्म। सत्ता से लोलुप्त मोदी-शाह जोड़ी ने निश्चित कर लिया है कि भारत के सभी प्रदेशों की सांस्कृतिक पहचान पर बार-बार, बारंबार प्रहार करेंगे, बुल्डोज करेंगे। मोदी सरकार ने इस प्रकार की सांस्कृतिक पहचान पर प्रहार कर-करके भारत के संघीय ढांचे का मजाक अनेक बार किया है। ‘टीम इंडिया’ ये शब्द जो मोदी जी बार-बार इस्तेमाल करते हैं, उसको बनाने का नाटक कई बार एक्सपोज हो गया है, वो नाटक बेकार हो गया है।

हम भर्त्सना करते हैं, कड़े से कड़े शब्दों में निंदा करते हैं, जिस प्रकार से अपमानित किया, नष्ट किया बंगाल में एक राष्ट्रीय आईकोन ईश्वरचंद विद्यासागर को। एक ऐसा महान व्यक्ति शिक्षाविद, सुप्रसिद्ध, विश्व प्रसिद्ध शिक्षाविद, बंगाली एल्फाबेट और लिखने के तरीके पर इतनी शोध की, इतने परिवर्तन लाए, संस्कृत के मूर्धन्य ज्ञानी, एक अथक समाज सुधारक, विधवा पुर्नविचार अधिनियम में इतना प्रयत्न किया, ऐसे व्यक्ति के विषय में बीजेपी और संघ परिवार के इस प्रकार के तत्व, इस प्रकार की चीजें करते हैं, भारत देश में ऐसा पहले कभी हुआ नहीं। सच्चाई ये है कि आज इस सत्तारुढ पार्टी ने एक नई संस्कृति पैदा कर दी है – जंगल राज, मोबोक्रेसी। उसको जानबूझ कर प्रोत्साहित किया जाता है। हम सीधा आरोप लगाते हैं कि सांस्कृतिक पहचान, इस जंगलराज, मोबोक्रेसी के लिए 100 प्रतिशत मोदी-शाह जोड़ी, बीजेपी सत्तारुढ़ सरकार जिम्मेवार है।

संघीय ढांचा संविधान की बात नहीं है, संघीय ढांचा आदर सत्कार होता है, प्रादेशिक स्तर पर हर चीज के लिए। आदर सत्कार होता है भाषा के लिए, विभिन्नता के लिए, विभिन्न संस्कृतियों के लिए, खाने के लहजे और खाने की चीजों के लिए। सबसे ऊपर सर्वोपरी होती है पहचान उन प्रादेशिक स्तर पर, ट्राईबल स्तर पर जो निवासी हैं उनकी। संघीय ढांचे के इस हर तत्व पर जबरदस्त प्रहार किया है इस सरकार ने, जो पहले कभी 72-73 साल में नहीं हुआ। तीन नए डीज निकाले हैं, जो मैंने कहा – डिस्ट्रक्शन (destruction), डेमोलिशन (demolition), डेसिक्रेशन (desecration)। नष्ट करना, तोड़ना, अपमानित करना और बड़े सहज और बड़े सोचे-समझे, बड़े प्लान तरीके से ये अखिल भारतीय स्तर पर किया जा रहा है, पूरे राजनीतिक वातावरण को प्रदूषित करने के लिए, विष से घोलने के लिए।

इसके विपरीत कांग्रेस पार्टी सदैव और विशेष रुप से राहुल गांधी जी इस अथक परिश्रम में लगे हैं शुरुआत से कि सांस्कृतिक पहचान को कैसे बचाया जाए, प्रोत्साहित किया जाए, हर जगह। आप लोग समझते है कि दो जगहों पर सिर्फ चुनाव लड़ रहे हैं माननीय राहुल गांधी, जहाँ तक उनकी सोच है, वो भिन्न है इससे। उनके अनुसार अमेठी से वायनाड, उत्तर से दक्षिण भारत की पहचान को एक साथ पिरोना अति आवश्यक है। भारत की पहचान को एक कॉमन अंबरेला में दिखाना अति आवश्यक है और उस विभिन्नता को सैलिब्रेट करना। ये चीजें हम भूल जाते हैं, इसलिए मैं आपको कुछ उदाहरण देना चाहता हूं। ये अति आवश्यक है कि हमारी संस्थापित स्मृति को वापस उजागर किया जाए।

एक एच राजा हैं, बीजेपी के शीर्षस्थ नेतृत्व के, तमिलनाडु का हिस्सा, उनका वक्तव्य था कि मैं शपथ लेता हूं कि पेरियार की मूर्ति को हम नष्ट करेंगे। ये उन्होंने सार्वजनिक रुप से शपथ ली थी, आपने प्रकाशित भी की थी। श्री राम माधव उनसे भी ज्यादा वरिष्ठ व्यक्ति हैं, उन्होंने समर्थन करने का प्रयत्न किया कि क्यों कुछ मूर्तियों को हटाना चाहिए, क्या किसी भी व्यक्ति के विरुद्ध कुछ एक्शन हुआ, निलंबित, निष्कासन हुआ, जी नहीं, उनको प्रोत्साहित किया गया, चुप्पी से प्रोत्साहित किया गया, हंस कर प्रोत्साहित किया गया, आँख मूंद कर प्रोत्साहित किया गया। चेन्नई में हमारे सबसे बड़े आईकोन अंबेडकर जी की मूर्ति पर लाल रंग आप लोगों ने प्रकाशित किया कि मिला है। सबसे घृणात्मक अगर आप घृणा के अलग-अलग दर्जे देख सकते हैं, मुझे तो विश्वास नहीं होता है कि भारत में ये कैसे हो रहा है, 2018-19 में, नाथूराम गोड़से की मूर्ति को हार चढ़ाया जाता है, प्रशस्ति पत्र जैसे पेश हो रहा हो, तालियां बजती हैं और उसके बाद गांधी जी की एक छोटी मूर्ति को लेकर एयर पिस्टल से शूट किया जाता है। ये कितनी बार हुआ है 70-72 साल में, क्या ये हमारी सांस्कृतिक पहचान है, विश्व के सबसे बड़े लोकतंत्र, गणतंत्र की?

अब जरा संघीय ढांचे पर चलें संवैधानिक रुप से, आर्थिक रुप से। आपने जो ढोंग किया, जो 100 प्रतिशत मिथ्या प्रचार किया आंध्र प्रदेश के स्पेशल स्टेट्स के बारे में, विशेष दर्जे के बारे में, वो संसद में दोनों हाउस में कई बार एक्सपोज हो गया है। ना तेलंगाना को, ना आंध्र प्रदेश को ये स्पेशल स्टेट्स मिला जो पहली सरकारों ने, इस सरकार ने कई बार वायदा किया है। आप बात करते हैं मोदी जी सहयोग वाले संघीय ढांचे की, कॉम्पिटशन वाले संघीय ढांचे की, बड़े-बड़े लेक्चर देते हैं, इतने प्रखर वक्ता हैं आप, सच्चाई क्या है आपके संघीय ढांचे की? उस सच्चाई का नाम है अरुणाचल प्रदेश। आपने पढ़ा है कि उच्चतम न्यायालय ने क्या स्ट्रिक्चर पास किए थे? उस सच्चाई का नाम है उत्तराखंड, आपने पढ़ा कि उच्च न्यायालय को क्या कहना पड़ा? उस सच्चाई का नाम है गोवा और मणिपुर, जब बहुमत गायब और सरकार को येन, केन, प्रकारेण इंस्टॉल करना है, मेघालय। ये सच्चाई है आपके संघीय ढांचे की।

आपने अरुणाचल प्रदेश जैसे नाजुक बॉर्डर प्रदेश के विषय में परमानेंट रेजिडेंट सर्टिफिकेट्स जो वहाँ के निवासियों के विषय में आपने एक स्कीम की, वो 6 नोन ट्राईबल कम्युनिटी के लिए आपने जोर लगाकर करने का प्रयत्न किया है, कर दिया है, उससे वहाँ बहुत अशांति है। सिटीजनशिप अमेंडमेंट बिल, नागरिकता वाला विषय, हम सब जानते हैं उत्तर पूर्व में कितना आक्रोश है, वहाँ के लोग, जो मूल निवासी हैं वो इसको अपनी सांस्कृतिक पहचान पर सबसे बड़ा आघात मानते हैं, 70-72 साल में। जम्मू-कश्मीर हमारे देश का सबसे नाजुक प्रदेश है, राष्ट्रीय सुरक्षा का एक बहुत जबरदस्त, एक महत्वपूर्ण पहलू आपने मोदी जी 80,000 करोड़ के पैकेज का वायदा किया था, आपके प्रकाशित आंकड़े हैं, 31 प्रतिशत दिया गया है अभी तक, एक तिहाई से कम। इतने बड़े-बड़े भाषणों से सच्चाई नहीं छुप सकती। बिहार जहाँ आपको जीतने की इतनी तीव्र इच्छा थी, 2015 में आपने सवा लाख करोड़ के पैकेज की घोषणा की थी। अभी एक-डेढ़ साल से नीतीश कुमार जी की आवाज दबी-दबी रहती है, निकलती नहीं है, शायद अगले बदलाव के साथ उनकी आवाज भी निकलनी शुरु हो जाएगी। सवा लाख करोड़ रुपए में कितना रुपया बिहार को मिला है, जरा देश को बताईए। आप बार-बार कहते हैं कि 42 प्रतिशत हम प्रदान करेंगे, टोटल जो फंड होते हैं, यानि कि जो संविधान के अंदर केंद्र को प्रदेशों को देने होते हैं, 35 प्रतिशत डिवोल्व हुए हैं। सीएसएस और कई सेंट्रल स्कीम कम हो गई हैं, 75 प्रतिशत से 50 प्रतिशत, ये नई परिभाषा है, विकृत परिभाषा है संघीय ढांचे की, कॉपरेटिव सहयोग वाले ढांचे की।

मैं अंत में ये कहूंगा कि जो हमारे संविधान के मूल स्तंभ हैं, नेशनल डेवलपमेंट काउंसिल उसको भी आपने निरस्त कर दिया। सब चीज आप नीति आयोग से जोड़ते रहते हैं, जहाँ ब्यूरोक्रेट बैठे हैं, जो आपके स्पोकसपर्सन बनते हैं। अभी विद्यासागर जी के अलावा आपने जिस प्रकार से इतने प्यारे शब्दों का प्रयोग किया बंगाल के विषय में, कंगाल बंगला आपने कहा, ये आपकी समझ है, परिभाषा है, आदर है, सत्कार है, संघीय ढांचे के बारे में, सांस्कृतिक पहचान के बारे में, विविधता के बारे में, डिसेंट्रलाइजेशन के बारे में और इसी सच्चाई को हम एक्सपोज करना चाहते हैं।

बंगाल के विषय में अमित शाह के दिए बयान पर पूछे एक प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि अमित शाह जी कुछ ज्यादा ही व्यस्त रहने लगे हैं, समय नहीं मिलता उनको फैक्ट चैक करने के लिए। जब भी वो चाहें फैक्ट चैक करने के लिए हम बैठे हैं। जुमलेबाजी, फैंकुबाजी के लिए वो अपने प्रधानमंत्री से पूछ सकते हैं, फैक्ट चैक के लिए हमसे पूछ सकते हैं। आपने बोला कि बंगाल में हिंसा क्यों होती है, तो मैं फैक्ट चैक करा दूं उनके लिए कि अभी त्रिपुरा में चुनाव आयोग ने पूरा रिइलेक्शन कर दिया, पूरा चुनाव ही निरस्त हो गया है, वो क्या हिंसा के बिना हुआ?अभी इसी चुनाव में, दो हफ्ते पहले। केरल में क्या हिंसा का नाम नहीं सुना आपने? किस देश की बात कर रहे हैं अमित शाह जी, भारत में हैं या विदेश में? तमिलनाडु में हिंसा नहीं हुई क्या?कर्नाटक में आप लोगों ने इतनी रिपोर्ट की और इसके अलावा अभी कुछ दिनों पहले की बात है, हरियाणा में जो मंत्री महोदय मनीष ग्रोवर के विषय में आप सबने सुना, पढ़ा, बात हुई। बिहार में, झरिया में, जमशेदपुर में, मुजफ्फरपुर में, ये सूची तो अभी लंबी है अमित शाह जी, आप किस देश में रह रहे हैं? सच्ची बात क्या है, सच्ची बात ये है शाह साहब कि जहाँ-जहाँ बीजेपी का वर्चस्व शून्य है, जहाँ-जहाँ आप जलाकर और आवाजें निकाल कर अपने वर्चस्व और पहचान को बनाने के प्रयत्न में लगे हैं, जहाँ शून्य है, वहाँ हिंसा आप करवा रहे हैं, वहाँ हिंसा आप कर रहे हैं, वहाँ अपने आपको स्थापित करने के लिए, आपकी पहचान ना जाए इसके लिए कर रहे हैं और आप ऐसे अनभिज्ञ बन रहे हैं। मैं एक चीज सीधा बोल दूं मैं कड़े से कड़े शब्दों में किसी के द्वारा किसी प्रदेश में कहीं भी किसी प्रकार से हिंसा की भर्त्सना करता हूं, ये हमारा यूनिवर्सल सिद्धांत है।

एक अन्य प्रश्न पर कि खबरें आ रही हैं कि यूपीए चेयरपर्सन की तरफ से 23 तारीख को सभी विपक्षी पार्टियों को बुलाया गया है, डॉ. सिंघवी ने कहा कि इन सब चीजों पर बात इस प्रकार से करने का कोई औचित्य नहीं है। जब ऐसा होगा तो आपको सूचना देंगे और आपको आमंत्रित भी करेंगे। लेकिन इसके बारे में कुछ भी कहना अभी संभव नहीं है, ये मैं किसी तथा-कथित रिपोर्ट पर टिप्पणी नहीं करुंगा। बातचीत राजनीतिक प्रक्रिया का एक अभिन्न अंग है, बातचीत राष्ट्रीय चुनाव के दौरान अगर नहीं होगी तो कब होगी और अलग-अलग स्तर पर मैं नहीं कह रहा हूं, कांग्रेस कर रही है, मैं कर रहा हूं या आप कर रहे हैं, ये 24 घंटे का प्रोसेस होता है। जो आप प्रश्न पूछ रहे हैं, सूत्रों और प्रकाशित खबर के बारे में, उसके ऊपर मैं जवाब देने में असमर्थ हूं।

प्रधानमंत्री के बंगाल के विषय पर दिए बयान पर पूछे एक अन्य प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि मैं इसका जवाब दो बार दे चुका हूं। जहाँ तक दूसरे का सवाल है, वो आप उनसे और ममता बनर्जी जी से पूछिए, मुझे बीच में पड़ने की जरुरत नहीं है, ये राजनीति कैंपेन है, इसमें निश्चित रुप से हर व्यक्ति को ये लाजमी है कि राजनीतिक रुप से कुछ कहना हो, लेकिन जिस प्रकार से अपशब्दों का बार-बार प्रयोग किया जा रहा है, मैं उससे सहमत नहीं हूं, लेकिन ये मामला उनके और ममता जी के बीच में है।

एक अन्य प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि इस वक्त इन सब चीजों की बात करना पूरी तरह से प्रिमैच्योर है। वक्तव्यों के ऊपर टिप्पणी करना बिल्कुल अनुचित है, अनावश्यक है। आप आश्वस्त रहें कि 23 तारीख के बाद नोन एनडीए, नोन बीजेपी, नोन मोदी, नोन शाह सरकार इस देश में आ रही है। उस सरकार का क्या स्वरुप होगा, क्या कोंपनेंट होंगे, उससे हम आपको निकट भविष्य में अवगत कराएंगे। ये स्टेटमेंट बाजी से निश्चित कुछ नहीं होने वाला है।

Dr. Abhishek Manu Singhvi said – Indian National Congress strongly condemns the violent desecration of our national icon – Ishwar Chandra Vidyasagar, the great educationist, the man who changed the Bengali alphabet and type, Sanskrit scholar, reformer who brought in the Widow Remarriage Act and fought for women’s education orthodoxy. We are deeply pained that such a shameful incident took place.

A new politics where ‘Mobocracy’ is being actively encouraged and abetted by the ruling party- the BJP in the country has gained ground in the past 5 years. PM Modi & Shri Amit Shah led BJP are squarely responsible for systematically damaging the cultural identity of each state in India.

Federal Structure, Respect for Regional Aspirations, Culture, Language, Food Habits, and Identity of Indigenous People are under attack by the BJP in EVERY state of the country. This negative politics of ‘destruction, demolition and discretion’ are methodically vitiating the political atmosphere of the country. BJP wants to exert its monolithic supremacy and bigoted agenda on each state, thus weakening the federal polity.

Congress President, Shri Rahul Gandhi has taken upon himself to protect the culture, identity, language of the various states which make India. This is one of the strongest reasons why Shri Rahul Gandhi is fighting elections from both North India (Amethi) & from South India (Wayanad)- so that all parts of India feel united under the common umbrella of the Congress party.

Disrespect for National Icons and hegemony of their own ideology is reflective of the BJP’s mindset:-

We must recall that none less than a member of BJP National President, Shri Amit Shah’s team; Shri H Raja pledged to destroy the statue of great social reformer, Periyar. Later BJP Gen Sec, Shri Ram Madhav actively justified pulling down statues, but no action was taken against him. Later,

In February this year, members of a fringe Right Wing group associated with the SanghParivar shameless reenacted the scene of Mahatma Gandhi’s assassination by shooting the effigy of Bapuwith an air pistol after garlanding a picture of his assassin NathuramGodse  in Uttar Pradesh.

Condemnable policiesof the Modi Govt for various states have precipitated this situation:-

Modi Govt did not grant the Special Status to Andhra Pradesh, as per the AP Reorganization Act and adequate funds to Telangana were also not devolved.

Federal Structure is dead. Democracy was systematically mauled & kidnapped in State after state – Arunachal Pradesh, Goa, Uttarakhand, Manipur& Meghalaya.

BJP Govt in Arunachal Pradesh inflicted violence and played with the sensitivities of the people when it sought to impose the controversial Permanent Resident Certificates for 6 non-tribal communities

Modi Government politics of division was in full form, after it brought in the Citizenship Amendment Bill (CAB), which was opposed tooth and nail in many states of North East. This was a direct assault on the indigenous people of the North East.

Jammu and Kashmir was promised 80,000 Cr by the Modi Government, but only 31% of the package was delivered to the state by Modi Govt

During Bihar elections, PM Modi shamelessly bid for the future of Bihar and promised 1.25 Lakh Crore package for Bihar. But even after 2 years, not a single penny has been released.

Modi Govt claimed 42% devolution towards states, but not even in one year of its term , it has achieved that threshold! It has never breached the 35% mark.

Modi Govt’s so called ‘increased devolution’ turned out that to be a cruel joke as the Centre abandoned schemes and burdened the states. They cut the number of centrally sponsored schemes (CSS) from 70 to just 27 and also cut contribution in many CSS from 75 per cent to 50 per cent. This effectively means States are getting less as their share of tax revenue, and a pittance for the share of centrally sponsored schemes. What the Modi Government has ensured is that though the aggregate jump in devolution has been 10%, the corresponding cut in CSS has eaten away the so called ‘10%’ increase in devolution.

Further, PM Modi that paraded Co-operative Federalism as an ‘article of faith’  hasn’t even released the funds to states, with reports stating that the Centre has only achieved a third of devolution thereby starving states of funds needed for vital welfare schemes like education and health.

SC-ST Sub Plan for backward regions, funds of which were meant for states was abolished by the Modi Government.

Special incentives for Hill States & Himalayan States have also been discontinued.

National Development Council (NDC) has been dissolved and powers granted to NitiAayog

On the question as to whether the congress party is ready to take the lead,               Dr. Singhvi said as Shri Rahul Gandhi has been saying for the last two months, the people will take the lead and the people have taken the lead and the final part of lead will be known on 23^rd. Thereafter, Congress party is certainly very much in the forefront of that political campaign and therefore, where is the question of asking the rhetorical question.

डॉ. अभिषेक मनु सिंघवी ने पत्रकारों को संबोधित करते हुए कहा कि आज एक और उदाहरण मिला आपको, किस प्रकार मोदी सरकार, मोदी जी के झूठ, परपंच, अफवाहों की जो एक स्ट्रैटेजी है, उसको नकार रही है। खैर ये शुरुआत से हमें मालूम था और ना हम सुप्रीम कोर्ट के निर्णयों पर टिप्पणी करना चाहते हैं, लेकिन आज ही उच्चतम न्यायालय ने, ये जानबूझ कर चुनाव के दौरान उठाया हुआ, द्वेष से भरा हुआ आरोप नागरिकता वाला, उस पर एक और याचिका निरस्त की है, दो घंटे पहले की बात है। हमें उच्चतम न्यायालय के ऊपर टिप्पणी करने की आवश्यकता नहीं है, तथ्य आपके सामने हैं।

मूल बात में थोड़ा फर्क है, मूल बात ये है कि ये दर्शाता है कि द्वेष से, घबराहट में, भय से भरे हुए मोदी जी और उनकी सरकार येन-केन प्रकारेण, किसी प्रकार से, हर प्रकार का झूठा आरोप प्रोक्सी के द्वारा, थर्ड पार्टी के द्वारा, कभी किसी वर्कर के द्वारा, कभी किसी असंबंधित व्यक्ति के द्वारा लगाते रहते हैं। उनका हश्र आपने देखा, एक और उदाहरण है, आज किसी और व्यक्ति से जिसके बारे में कोई संदेह नहीं हो सकता कि वो बहुत निकट से जुड़ा है, पहले एक राज्यसभा के सांसद से शिकायत करवाई, उसके बाद 5 वर्ष निकाल दिए और उस शिकायत के विषय में ठीक चुनाव के बीच में मिनिस्ट्री ऑफ होम अफेयर से एक दस्तावेज निकलवाया। उससे पहले 5 वर्ष तक एथिक्स कमेटी (Ethics Committee) में कुछ नहीं करवा पाए, फिर भी इस चीज को वापस आगे लाना है किसी तरह से। ये सब क्या दिखाता है, ये दिखाता है- निश्चित हार का पूरा उनको यकीन है। जानबूझ कर इसलिए ऐसी अजीबों-गरीब चीजें निकाली जा रही हैं और इससे जिस प्रकार इस देश में, यह भारत देश मे सच के प्रतीक राजा हरिश्चंद्र हो गए हैं, उसी प्रकार से झूठ की प्रतीक ये सरकार हो गई है, ये सत्तारुढ पार्टी हो गई है, ये प्रधानमंत्री हो गए हैं। अगर झूठ, प्रपंच, अफवाहों को अगर गिनिज वर्ल्ड बुक में प्रकाशित करना चाहते हैं, तो दिन प्रतिदिन उसके नए उदाहरण और मील पत्थर माननीय मोदी जी आपको दे रहे हैं।

गोबेल्स जो विश्व में प्रसिद्ध है अफवाहों और प्रोपेगेंडा के लिए, उसकी सीमाओं को इन्होंने बहुत पहले ही पार कर दिया है। भाजपा को बहुत बड़ी झूठ पार्टी सिद्ध कर दिया है। मोदी जी ने अपने नामों के अक्षरों को प्रमाणित कर दिया है, एमओडीआइ (मास्टर ऑफ डिसइनफोर्मेशन)। आपने अभी ये नागरिकता का उदाहरण देखा, कल एक और देखा, हर दिन आपको उदाहरण मिल रहे हैं।

अब आप सोचिए 30 वर्ष बाद एक मृत पूर्व प्रधानमंत्री के विषय में ये टिप्पणी करना, जो कल की इन्होंने, उसका क्या संदर्भ हो सकता है? कभी आपने किसी चुनाव में, इस देश में चुनाव सबने लड़े हैं, बीजेपी के भी अन्य प्रधानमंत्रियों ने लड़े हैं, गैर कांग्रेसियों ने भी लड़े हैं, 30 वर्ष पुराने मृत प्रधानमंत्री श्री राजीव जी के विषय में विक्रांत जैसे एक मुद्दे पर ऐसे अपशब्दों का प्रयोग करने के पीछे क्या संदर्भ हो सकता है? आपको खैर आज कई लोगों से अवगत करवाया है, जो हमसे ज्यादा अधिकार क्षेत्र रखते हैं इसमें, जो नेवी से संबंध रखते हैं, शायद आज दिन में और बाद में अवगत कराया जाएगा, क्या मालूम पड़ता है? एक मृत प्रधानमंत्री, एक दिवंगत आत्मा जो भारत के सबसे सुरक्षित और सिक्योरिटी के दायरे में बहुत ज्यादा टारगेट व्यक्ति थे, जिन्होंने अपने देश के लिए अपनी जान दी, उनके बारे में एक विक्रांत ट्रिप के बारे में, विराट के बारे में बात कर रहे हैं, क्या आप निश्चित रुप से अपनी घबराहट और अपनी हार को इससे प्रमाणित नहीं कर रहे हैं?ये पता होना चाहिए आपको कि हमारे रक्षा मंत्रालयों से संबंधित मुद्दों पर सिर्फ ऑफिशियल ट्रिप होती है। एक सिटिंग प्रधानमंत्री वहाँ जाते हैं, उनके साथ जो जाता है, उसकी सूची होती है कि क्या राजनीतिक मुद्दा है, क्या ये रोजगार से संबंध रखता है, क्या ये नोटबंदी, जिससे आप दूर भाग रहे हैं, उसके, क्या ये कृषि और आपकी सब असफलताओं के ठीकरे को किसी और के सिर पर फोड़ने की ये प्रक्रिया एक ऐसे मृत व्यक्ति के बारे में, जो 30 वर्ष पुरानी बात है। हमने ये भी कहा है, आपको याद होना चाहिए कि आप उस सरकार के समर्थक थे, जिसने 4 दिसंबर, 1989 में श्री राजीव गांधी की सुरक्षा को डाउन ग्रेड कर दिया था, उनकी मृत्यु जरुर 2 वर्ष बाद हुई, लेकिन संसद के प्रश्नों में, कार्यवाही में ये प्रकाशित है कि दिसंबर, 1989 में इसके बारे में प्रश्न उठाए और कार्यपालिका में ये निर्णय हुआ कि उनको वो सिक्योरिटी नहीं दी जाएगी, जो उनके लेवल की, उनके लिए उपयुक्त हो। उसका परिणाम बाद में जरुर हुआ, लेकिन उसका परिणाम सीधा उससे संबंध रखता है, जिसके आप समर्थक थे। तो आप उनकी सुरक्षा तो नहीं कर सके, आज दिवंगत आत्मा को 30 वर्ष बाद गाली देने में लगे हैं।

मैं नहीं मानता जो व्यक्ति प्रधानमंत्री जैसे पद पर सुशोभित हो, इतना नीचे गिरकर ऐसे शब्दों का, ऐसी शैली का प्रयोग कर सकते हैं। हम सिर्फ इतना कहेंगे कि अंततोगत्वा आपके सब झूठ, फरेब, अफवाहें एक तरफ और सच्चाई की विजय एक तरफ होती है, because lies, propaganda and canards can never succeed beyond a very-very short shelf life. Truth has to triumph. Howsoever much the Master of disinformation (MODI), howsoever much The Bahut Jhooth Party – BJP – will try to spread disinformation, the people of India know the truth. They know that when a party revives a citizenship issue bang in the middle of April-May election, after 5 years in power, with not a shred of legal or factual finding against Mr. Rahul Gandhi, we know that you are only proving your own frustration, you have a very grave fear and you have certainty in your heart knowing your defeat. Certainty of defeat imprinted on your heart on the basis of 5 phases of election and the internal reports.

Today, we had another example and obviously set of persons, yet another proxy – goes to Supreme Court with the citizenship issue. It meets a short inglorious end. I have no doubt that it has not met an end as far as this Government is concerned. I am sure like a phoenix Mr. Modi and his Government will try to rise from the ashes every time on this issue.

But remember, today it was a proxy. Some years ago, it was their own Rajya Sabha Member who brought a complaint. It was their own former cherished ideal and now thrown out like a fly from milk Mr. Advani Ji who chaired that Committee. It was their own 5 year government which in May issues a MHA letter and today you saw that letter by the way was part of the Supreme Court record today, but, this is not new, this kind of disinformation makes Mr. Modi and his Government hold a Guinese Book of World record on lies, propaganda and canards. You showed another example yesterday, another example day before. You attack Rajiv Gandhi on Bofors omitting to even mention or show your ignorance about a 04^th February 2004 judgment which you never appealed because you knew that there was nothing to appeal. Technically, you appealed after 14 years and it was dismissed in 2018 by the Supreme Court.

You did the same thing yesterday talking about; it is quite incredible I cannot imagine how a PM in middle of elections in May 2019 talks about former Prime Minister who is dead for over 30 years and about his purported visit to a Naval Ship. Does this Government and this Prime Minister not even know that nobody can set foot unless he is a sitting person of that stature, unless it is an official trip, unless everybody accompanying him, his name is given and known in a list? But I ask you what relation it has today 2019 to the jobs which you promised, to the agricultural distress, which you promised to double farm income, to the demonetization which crushed our MSMEs, you should have had a 30 year old enquiry on why this former Prime Minister went to the Naval ship and perhaps you had a report on 30 year old enquiry now presented to the nation as your biggest achievement. It is nothing Mr. Modi and BJP except trying to hide your failure. It is an abject acceptance and surrender to defeat knowing the internal report and the booth report of the 5 phases which are over but in that process you have demeaned your office, you have demeaned the office of Prime Minister, you have regressed past from progressing from PM to CM to PM to Statesman. You have gravely and irreversible regressed and as far as your naval issue is concerned, you already have across the nation rebuttals coming from people much more knowledgeable than you, former (Retd.) Admirals, I am sure you will have further rebuttals from the court today – all that proves at the end is ‘Jhoot, Jhoot and Jhoot’, lies, lies and lies on stilts and such canard have led you to where you are which is the people of India reject you, they pity you, they think that there is here a dispensation which they can’t trust in anything except ‘Jumlebazi’ and ‘Fekubaazi’.

On the reaction of the Congress party on the letter of MHA, Dr. Singhvi said                I have said three things – I have said that the canard of citizenship which ought to have led to a conviction according to Mr. Modi, at least 2014 itself or 2015 because the heinous crime is raised for the first time in 2019 in a big way in the middle of election, it has met probably its fourth demise as you know there is an earlier round of Manohar Lal Sharma’s petition and as you know that earlier an Ethics Committee, as you know there is an earlier round of generally taking in press all over and as you know now that there is a MHA also. The MHA is by the same Parliamentarian – at the instance of same Parliamentarian – who found no traction in the Ethics Committee,                           Dr. Subramanian Swamy.

Today, all these letters have been made a part of petition and the Supreme Court has not found any merit just like the Supreme Court did not find merit in Mr. M. L. Sharma’s petition. Tomorrow Sunil Prabhu can file a petition. Day after tomorrow, he can file a petition. That does not increase the authenticity because you changed the names of petitioner. As far as our replies or lack of replies are concerned, that is completely a bilateral matter between the person who has sent the notice and the noticee, as per the time given, we have no hesitation in replying because there is absolutely nothing about which we can at all be concerned about.

एक अन्य प्रश्न पर कि आपको क्या लगता है कि बीजेपी द्वारा इस तरह की बातों को उठाने से क्या उनको ज्यादा फायदा मिलेगा, डॉ. सिंघवी ने कहा कि बीजेपी की तरफ से गाली-गलौच से भरे, भर्त्सना योग्य हमले दिनभर चल रहे हैं। वो हमले नहीं हैं, वो हमलों के लिए अपोलोजी है, वो हमले नहीं हैं, वो घबराहट और बौखलाहट का द्योतक है। जहाँ तक हमलों का सवाल है मैं सिर्फ इतना बता दूं कि तथ्यों के आधार पर जो 2 वर्ष चला, जिसके अंतर्गत उनकी सिक्योरिटी डाउन ग्रेड हुई या पूर्व प्रधानमंत्री, उनके विचित्र सर्क्मस्टांसिस वाले  पूर्व प्रधानमंत्री जो सुरक्षा के विषय में इतने संदिग्ध स्थिति में थे, इतने खतरे में थे, वो उपयुक्त नहीं थी, ये निर्णय 1989 में हुआ, चंद्रशेखर जी मुश्किल से 4-5 महीने थे, ये जो दुष्प्रभाव हुआ है, ये उसके दो साल पहले से शुरु हुआ और उस सरकार के समर्थक माननीय मोदी जी वाली पार्टी थी। हमने सिर्फ इतनी सिंपल बात कही है, हम पुरानी बातों पर विश्वास नहीं करते हैं। लेकिन आज सिर्फ यही देख रहे हैं, पिछले पांच दिन से। तो रिकोर्ड को सही करना, स्पष्ट करना हमारा कर्तव्य है, हमारा उत्तरदायित्व है। ये मैं नहीं बोल रहा हैं, आपके पास रिकोर्ड होगा, ये पार्लियामेंट में प्रश्न उठा है, ये जो मैंने बोला है ये पार्लियामेंट में कोटेड हैं, संसद के पटल पर है।

To a question on the opening up of appointment of Judges in Supreme Court, Dr. Singhvi said as I have said earlier we are not here commenting on the merits of the proposal at all nor are we concerned as a political party. This is a judicial process which must go on and can go on, but, Yes I agree with you that this Government, I am not taking individual example, has adopted as a tool, as a weapon, as a deliberate strategy that if you cannot oppose a judiciary directly, because constitution does not give you that power, then you must browbeat them into submission by obstruction. You must browbeat – do not actually but try by delay, by not allowing public interest thing to go on. You must try and create obstacle. Another example is that everything which comes, you must send it back. No reason is given as such. Some reason is given which is happening all the time that Mr. ‘X’ is so and so in All India seniority, Mr. ‘Y’ is so and so number.

So, I think people of India and the judiciary understands that when there are valid reasons, those valid reasons must be looked at and they are .looked at but when there are reasons in the routine way of sending back everything, then it smacks of obstruction, delay, and an attempt to pressurize an attempt to create an atmosphere whereby sheer delay leads to a default decision.

एक अन्य प्रश्न पर कि इस मुद्दे को लेकर रक्षा मंत्री कह रही हैं कि कांग्रेस घड़ियाली आंसू बहा रही है, डॉ. सिंघवी ने कहा कि ठीक है ये घड़ियाली आंसू मान लिए, उनके वक्तव्यों को मान लिया, can I say so what? What is the relevance on 09 May 2019? I would be very-very happy if the Hon’ble Prime Minister or the Hon’ble Defence Minister with piercing intellect and wisdom, enlighten us all and I am throwing a challenge through you, enlighten us in any which way the remotest relevance of this point except one to abuse and vilify for the sake of abuse and vilify. From the day Rajiv Gandhi is gone, or Nehru Ji is gone, or Indira Gandhi is gone, you must go to the life history of everything in May 2019. Who is serious, does it show, whose mentality does it show, whose thought process does it show and above all, does it behove the Government of India and the Prime Minister at the top of it to speak like this.

On the reaction of the Congress Party that Mr. Ashok Tanwar has called Prime Minister Ravana’, Dr. Singhvi said unlike Mr. Modi, we have specifically always disassociated. I agree with you that there are stray words and incidents which may come from parties other than the BJP whether the words are not up to the mark.

Number 2 – It is immediately followed by distancing, by denial or disassociation from this podium.

Number 3 – Please tell me a single instance where the BJP has done it. The BJP does the reverse. It supports the statement. It has supported each statement. In fact, in this case, Prime Minister has gone to support a second time his own statement and second day his own statement. Don’t you see a difference in it? We have, as far as lowered gutter level dignity of discourse is concerned, always responded, never initiated but even then I will say and I will urge all Congressmen to stick to the discipline of the Congress Party. We cannot be like our political opponent who has no regard for dignity of discourse and I will repeat that our ‘excesses’ or aberrations are few too far between and remote and in degree totally not comparable towards Modi Ji and his sarkar is doing.

एक अन्य प्रश्न पर  कि अमेठी में ईवीएम की सुरक्षा को लेकर एक बड़ी लापरवाही सामने आ रही है, डॉ. सिंघवी ने कहा कि आप बहुत महत्वपूर्ण प्रश्न उठा रही हैं और मेरा इससे निजी ताल्लुक है, वो इसलिए कि हमारा भय इसमें शुरु से है। आपको शायद मालूम नहीं है कि पिछले हफ्ते में हम 2 बार, जो बात आप बोल रही हैं, ये पूर्वानुमान लगाकर चुनाव के पहले और चुनाव के दिन अमेठी में चुनाव आयोग के सामने पेश हो रहे हैं। जो आप बोल रही हैं ये लिखित में हमने दिया है। दूसरा, हमने मौखिक रुप से कहा है कि पूरा देश जानता है कि अमेठी में एक ऐसी व्यक्ति मंत्री, जिनका कोई सरोकार अमेठी से नहीं है, जो निश्चित हार देख रही हैं, जिन्होंने कुछ काम नहीं किया है, जानबूझ कर प्रदेश और सौतेले व्यवहार का दुरुपयोग करके अपना वर्चस्व बढ़ाना चाहती है। ये हमने ऑन रिकोर्ड कहा है, प्रदेश भी आपका है, केन्द्र सरकार भी आपकी है। तीसरा, हमने उसमें उदाहरण दिए कि जब भी श्री राहुल गांधी या कांग्रेस पार्टी कुछ प्रस्तावित करती है तो दोनों सरकारें उसको अवरुद्ध करने का प्रयत्न करती हैं, विलंब करने का प्रयत्न करती है जिससे कि कांग्रेस पार्टी या राहुल गांधी को कोई श्रेय ना मिल जाए। चौथा, इसलिए हमने उस दस्वावेज में लिखित कहा है, बड़ी सरल चीज कही है कि हमें पूरा संदेह है, भय है कि समतल जमीन पर ये चुनाव नहीं होने दिया जाएगा, क्योंकि केन्द्र सरकार और प्रदेश सरकार इस चुनाव में एक मतदाता के रुप से नहीं, लेकिन एक कैंडिडेट रुप से खड़ी है. पूरी तरह से हस्तक्षेप कर रही है। तो हमने मांग की है कि जो-जो वहाँ आपके यंत्र-तंत्र होते हैं, उनको तिगुना कर दीजिए। हमने लिखित कहा है की अगर सीसीटीवी एक होता है तो 3 करिए, 3 होते हैं तो 9 करिए। सुरक्षाकर्मी जहाँ एक बटालियन होती है, वहाँ 3 करिए। आपके स्पेशल ऑब्जर्वर, लिखित दिया है हमने कि माईक्रो ऑब्जर्वर बढाईए और थोड़े स्टेचर वाले निष्पक्ष वरिष्ठ आदमी होने चाहिएं। उसके बावजूद आप देख रहे हैं कि किस प्रकार की रिपोर्ट आ रही हैं। तो हमारी जो पूरी जो चिंता थी, वो पूरी तरह से प्रत्यक्ष रुप से प्रमाणित हो रही है और इसकी सीधी पूरी की पूरी जिम्मेदारी चुनाव आयोग को लेनी पड़ेगी, क्योंकि हमें प्रदेश सरकार से कोई आशा नहीं है, वहाँ के सरकारी यंत्र-तंत्र से कोई आशा नहीं है।

एक अन्य प्रश्न पर कि नरेन्द्र मोदी जी बार-बार पाकिस्तान के विषय में बोल रहे हैं, आज भी अपनी रैली में सर्जिकल स्ट्राइक के बारे में कहा है, डॉ. सिंघवी ने कहा कि इसका रोचक प्रसंग पहले सुना है आपने, वो ये है कि इस वक्तव्य, इस रिसपोंस के द्वारा मोदी जी ने भर्त्सना पहले की है वाजपेयी जी की। हमने मेरे आईपैड से मैंने पढ़कर सुनाया है, 7 उदाहरण हैं, 2000, 2001, 2003, 2005, 2008, एक दो और हैं, तारीख दी हैं, पुंज रिवर, नीलम रिवर, पुंछ सेक्टर, सारा कोट, ये सब नाम आपको दिए हैं। तो पूरे देश में राजा हरिश्चंद्र एक है। दो पूर्व प्रधानमंत्री झूठे हैं, राजीव गांधी जी को छोड़ दीजिए, वाजपेयी जी भी झूठे हैं, जनरल विक्रम सिंह का स्टेटमेंट हमने उसमें कोट किया है, ये भी झूठे हैं। जनरल हुड्डा जो आपके साथ वार्तालाप कर चुके हैं, वो भी झूठे हैं। जब देश में आई, मी, माईसेल्फ की थ्योरी के आधार पर राजा हरिश्चंद्र एक होता है तो मैं समझता हूं कि देश का कोई भविष्य नहीं बचता, इस पर मुझे कोई टिप्पणी करने की आवश्यकता नहीं है, इसका निर्णय जनता करेगी। कोई सर्जिकल स्ट्राइक आप घर में बैठकर बच्चों की ड्राईंग फाइल पर ड्रॉ करके, फाइल बंद करके थोड़े ना बैठ सकते हैं, उसके लिए कोई अनुमति होती है, फाइल बनती है, रक्षा मंत्रालय से विदेश मंत्रालय जाती है, वहाँ से पीएमओ जाती है, लोग बाहर जाते हैं। सबसे बड़ा अपमान वाजपेयी जी का नहीं है, राजीव गांधी जी का नहीं है, राहुल गांधी जी का नहीं है, सबसे बड़ा अपमान तो हमारे सेना के अंगों का है। वो घर पर बैठकर चाय-कॉफी पी रहे हैं, ये 7 चीजें उन्होंने फाइल में लिख दी, ये कैसे प्रधानमंत्री हैं, ये कैसी सत्तारुढ़ पार्टी है? इस आरोप का, इस आक्षेप का सीधा मतलब ये है जो मैं कह रहा हूं।

So, these are matters where the ‘vivek’, the good sense of the President of India is applied and it is very clear that when there are 350 people standing even though some of them may be post-result, even then he is not going to follow a blind slotting machine system that I will call the 150 people, who is the single largest.
