एक चौथा उदाहरण आता है, जहाँ हमने नहीं पास किया माननीय वित्त मंत्री और इस सरकार ने बहुत हल्ले-गुल्ले के साथ आपको इलेक्ट्रोरल बोंडस के बारे में बताया। आपको पता है कि जब इलेक्ट्रोरल बोंडस नही थे कानून में तो 20 हजार से ज्यादा कोई भी व्यक्ति अगर देता था तो उसकी पूरी आपूर्ति करनी पड़ती थी या छुपा कर कैश में देना पड़ता था, जो गैर-कानूनी होता। इंकम टैक्स में है, आर.बी.आई एक्ट में है। अब ये रिप्रेजेंटेशनल ऑफ पीपल एक्ट को बदल कर जो प्रावधान लाया गया है ,उसमें सबसे विशेष बात ये है कि करोड़ों-लाखों दान एक ही व्यक्ति अपने डोनेशन को 10 बोंडस में डिवाइड करे। 10 अलग-अलग विभिन्न व्यक्ति अपने डोनेशन को अलग-अलग बोंडस में डिवाइड करे, कैसे दें 50 हजार करोड़ दें, वो आरटीआई से,आपसे, हमसे और सार्वजनिक रुप से छुपा हुआ है, कानून के द्वारा। अब ये अलग बात है कि सरकार को पता है कि वो कौन है। तो ये सरकार को डोनेशन लेने के लिए, कम से कम अभी उसका फायदा उठाने के लिए और अगणित अमाउंट लेने के लिए सबसे सहुलियत, का कारगर कानूनी तरीका निकाला गया है।

श्री आर.पी.एन सिंह ने पत्रकारों को संबोधित करते हुए कहा कि अभी सिंघवी साहब जी और गौड़ा साहब ने बताया कि भ्रष्टाचार की बात करने वाली भाजपा खुद किस तरह भ्रष्टाचार में लिप्त है। चुनाव के दौरान किसानों के बारे में, आदिवासियों के बारे में, जमीन के बारे में बड़े भाषण भाजपा के नेताओं ने दिए। सत्ता में और केन्द्र में जब भाजपा आई तो सबसे पहले उसने किस पर हमला किया- किसानों की जमीन पर हमला किया। वो तो कांग्रेस पार्टी के नेतृत्व ने वो लड़ाई लड़ी और 44सांसदों से बिल को हमने बदलने की ताकत दिखाई क्योंकि किसानों का मुद्दा था। उसी तरह से एक मुद्दा सामने आया जब झारखंड में भाजपा की सरकार बनी, आदिवासी, पिछड़े गरीब आदिवासियों की बात करने वाली भाजपा सरकार जब झारखंड में सरकार बनी, जब चुनाव थे वहाँ प्रधानमंत्री जी ने कहा था कि CNP और SPT एक्ट, छोटा नागपुर टेडेंसी एक्ट और संथाल परगना टेडेंसी एक्ट जो 1908 में मूलवासियों और आदिवासियों की जमीन को सुरक्षित रखती है। परंतु पिछले 8 महीनों से वहाँ के मुख्यमंत्री और सरकार ने पूरी कोशिश की उस टेडेंसी एक्ट में बदलाव लाने की, क्योंकि विधानसभा में उनकी संख्या बल ज्यादा थी, उस विधानसभा में उस अमेंडमेंट को पास करवा कर गवर्नर तक भिजवाया। कांग्रेस पार्टी ने गवर्नर के सामने पिटिशन रख विरोध किया और वहाँ जो हमारे मूलवासी और आदिवासी को सुरक्षित रखती है उन्होंने भी विरोध जताया सड़कों पर। गवर्नर साहब ने उसको वापस लौटाया और हमने लगातार विधानसभा के अंदर और सड़कों पर लेकर उसकी खिलाफत की। कल हमारा एक बहुत बड़ा धरना था झारखंड में, विधानसभा का घेराव किया था। जिस तरह से भाजपा प्रजातंत्र का गला घोटना चाहती है। पानी के गोले और लाठी चार्ज हुआ परंतु जिस तरह से संख्या में लोग आए, जिस तरह से उन्होंने मूलवासी और आदिवासियों को रोकने की कोशिश की, मैं कह सकता हूं आज कांग्रेस पार्टी में फिर से भले हमारे पास झारखंड में संख्या बल नहीं है, आज विधानसभा में भाजपा की सरकार ने उस अमेंडमेंट को वापस लेने की बात की है, मैं समझ सकता हूं कि कांग्रेसी आदिवासी की जमीन हो, किसानों की जमीन हो उसके लिए लड़ाई लड़ते रहेंगे और ये जीत जो हमारी ट्रायबल भाई ने,उनके लिए झारखंड में बहुत बड़ी जीत हुई है। क्योंकि अमेंडमेंट को उन्होंने कई बार बदलने की कोशिश की और आज वापस लिया है और ये बहुत बड़ी जीत है, आदिवासी और मूलवासियों के लिए झारखंड में।

एक प्रश्न पर कि कल मानसून सत्र का आखिरी दिन है और कामकाज ठप रहा, बिल पास नहीं हुए, क्या कहेंगे, डॉ. सिंघवी ने कहा कि इस बार तो हम सब जानते हैं कि संसद का कार्य आगे बढ़ाने का पूरा उत्तरदायित्व सरकार पर होता है। इस बार भगवान की कृपा है कि कोई बहाना भी नहीं है विपक्ष के अवरुद्ध या विरोध करने के लिए, नहीं तो बहाना मिल जाता है। इस बार वो नहीं है कि किसी प्रकार से अवरुद्ध हुआ है और जैसे हमने पहले आपके सामने आंकड़े रखें है-जब भी हम सत्ता में होते हैं और जब बीजेपी सत्ता में होती है, उस दौरान जो अवरुद्ध करने की प्रक्रिया होती है उसके आंकड़े बड़े स्पष्ट होते हैं कि अवरुद्ध बहुत ज्यादा करती है, विरोध की हैसियत से। कारण आपको बीजेपी से और सत्तारुढ़ सरकार से पूछना चाहिए। शायद ये रहा हो पिछले दो हफ्ते इस सत्र के थे या तो गुजरात में बहुत ज्यादा व्यस्त थे या चुनाव आयोग में मंत्री महोदय बहुत ज्यादा व्यस्त थे, ऐसा कोई कारण रहा हो हमें पता नहीं, लेकिन निश्चित रुप से संसद का काम काफी प्रभावित हुआ है।

एक अन्य प्रश्न पर कि प्रधानमंत्री जी ने अपने मंत्रिय़ों को काफी खरी-खोटी सुनाई है संसद सत्र को लेकर, क्या कहेंगे, डॉ. सिंघवी ने कहा कि ये तो इनकी आपसी बात है, ना हमें इस पर कोई टिप्पणी करने का अधिकार क्षेत्र है। बात ये है कि मैं नहीं समझता कि बीजेपी के और हमारे नीजि वार्तालाप जो भी होते हैं सैंट्रेल हॉल में, उससे ये दिखता है। मैं नहीं समझता है कि बीजेपी के कोई भी एमपी को स्वतंत्रता है या पार्टिसिपेशन है, इसलिए उनको वो लगाव सैंसर ऑनरशिप बिल्कुल नहीं है। अगर सबकुछ, आप हाईकमांड की बात करते हैं, तो सुपर हाई कमांड इस देश में किसी पार्टी में हो तो वो एक ही पार्टी में है- सत्ता रुढ़ पार्टी बीजेपी में और उसके रहते कोई भी सांसद अपने आपको जुड़ा हुआ नहीं समझता संसदीय प्रक्रिया में।

एक अन्य प्रश्न पर कि गुजरात चुनाव में जीत से आप क्या सबक लेते हैं, आने वाले चुनाव के लिए क्या तैयारी है, डॉ. सिंघवी ने कहा कि कांग्रेस पहली बात तो नतमस्तक है उन एमएलए के समक्ष जिनको प्रलोभन दिया गया ,उसका तुलनात्मक रूप से आप अहसास भी नहीं कर सकते। उनको सैल्यूट करना चाहिए। दूसरी बात हर प्रकार का प्रलोभन, कई हफ्तों तक। ये संस्थाओं की जीत है सबसे पहले। माननीय पटेल जी की जीत तो है ही, निष्पक्ष स्वतंत्र संस्था, कानूनी कार्यवाही के आधार पर निर्णय दे सके, उसका द्ययोतक है, उसका उत्तम उदाहरण है। तीसरा ये दिखाता है कि जब अहंकार की चरम सीमा होती है तो ऊपर वाले का न्याय अजीब होता है, उसको आप हिट-वीकेट कह लीजिए, सेल्फ गोल कह लीजिए, टू क्लेवर बाय हॉफ कह लीजिए, लेकिन उस न्याय की चपत बड़ी करारी होती है।500, 2000 रुपए के नोट पर पूछे गए प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि आपके समक्ष हमने तथ्य रखे हैं। हमें अगर दो नोट मिलेंगे तो हम आपके समक्ष रखेंगे। हमें अभी तक संतोषजनक जवाब नहीं मिला है और जब तक नहीं आता है हम बार-बार जवाब मांगेगे। वो मांग जारी है।

The first is the Whistle-blower’s Act. I was intrigued to find that I was the Chair of the Committee, which recommended the basic structure of this Act. The Whistle-blower’s Act in 2014, contrary to what the UPA, in its outgoing phase recommended, which passed through Lok Sabha and Rajya Sabha was amended in 2014 and the principal strategy adopted of diluting it, virtually swallowing it up, is by making a category which was excluded from disclosure.

A list of ten items under the Amendment, the 10 items are so broad, so subjective that the so-called exceptions will swallow the rule. It will make whistle blowing nugatory. So, you need to allow whistle blowing if first, it affects the sovereignty and integrity of India. The words are very wide. You do have sovereignty, security in the Constitution, but not such words, security, strategic, scientific or economic interest of the State. What kind of wording is this? That means you can prevent any whistle blowing. Cabinet papers including records of the Council of Ministers, of Secretaries of the Government and all other officers is very wide. Using a peg which is known to law, you have expanded it completely precisely, for the exception to swallow the rule. Information that has been expressly forbidden by a Court or contempt, that is alright, no problem. If the information would cause a breach of privilege; There is no anticipatory breach of privilege of Parliament. Parliament will decide whether it is a breach of privilege. It is not the Government Officers sitting here who will decide in advance, that you will not allow whistle blowing, because he thinks that Parliament may hall it up for breach of privilege. Look at the width of this that relates to commercial confidence, trade secrets, intellectual property, almost everything will be covered if you use such broad words. I have got 7 other examples, I do not want you to take to details, the paper will tell you.

The first important point is The Whistle Blowers Act – our Government, our Standing Committee and then the Parliament passed it. We brought it up, it was our idea because in all developed countries and many other countries, it is a major weapon in the fight against corruption. Whistle blowing, which has the twin objectives of protecting the whistle-blower and allowing access to important information which leads to and involves corruption and proof of corruption, is the heart and soul of an anti-corruption campaign. This Government is used to ‘Jumlas’, to making tall claims, but the reality, the difference between fact and fiction, between rhetoric and reality is that they have by the Amendment, reduced the scope almost to vanishing point. And how do you blow the whistle at all after this Act, is a matter of great mystery.

The second example is the very important – Lok Pal Act and again coincidentally our Committee with 31 Members and 17 Parties, passed a near unanimous recommendation on that. Shri Modi has successfully done at the Central Government, precisely what he did for 12 long years, as the Chief Minister of Gujarat.

We passed it, we brought it in the Committee. We then brought it from the Committee to Parliament. In 2011, after our Committee report, which was done in a record four months, with almost 150 witnesses and several hours of evidence. It was delayed in Rajya Sabha, by the BJP. It got it again referred in May 2012 to a Select Committee. The Select Committee report comes in the end of 2012 and finally the Bill is ascended and brought into force during our time in the end of 2013 and 2014. Even the delay from 2012 to 2014 was by the daily obstruction by BJP. And remember how they rode ‘piggy-back’ on the man whom they called an ‘old man’ Mr. Anna Hazare. They rode ‘piggy back’, they abused us, they used vituperative adjectives.

Now you reach 2014. From 2014 when Mr. Modi took over – for almost 36 months – he has tried everything available not to promulgate and put into operation this Act. Two examples and I do not want to quote to you Ms. Sushma Swaraj who said in those days before she was in Government, ‘an old man’ who keeps fasting to fight corruption and appeals to our collective conscious, the UPA let him down. And 36 months inaction, silence now.

Mr. Jaitley said, if fears and fair anger is there because the government UPA wants a ‘Sarkari Lokpal – the UPA is acting like a child’. These are people who spoke then and who are the Ministers who have done nothing for three long years, because no one dares open his mouth.

One objection takes a 30 second Amendment – one line 30 second amendment, to say the ‘single largest party’. The excuse of the NDA is amazing. It is the most precious and superficial of excuses I have heard that there is no LoP and the Act, because when it was passed, it was not anticipated that there would be 44 persons. The Act uses the word ‘LoP’. Therefore, we cannot operationalize because there is no LoP. Instead they have brought two other Amendments. They could have easily got this Amendment. They brought other amendments to the Lokpal Act, they (a) avoided bringing this Amendment and (b) they brought retrograde Amendments to the Lokpal Act. One major change they brought was in Section 44 which said every public servant must declare his assets and those of his spouse and dependent children. They have changed that altogether and said, that they will be required to disclose as the Government may prescribe. So, from a statutory status of disclosure, mandatory obligatory disclosure in the statute, it is now a Governmental executive prescription which may leave out what they like in the prescription. They made this very significant Amendment saying single largest party can nominate. Result is, we have no Lokpal after three years. Is it not utter hypocrisy and from 2001 to 2013 till Mr. Modi left Gujarat, he did everything possible to ensure that there would be no Lokpal in Gujarat.

The Hon’ble Supreme Court in that matter when the Gujarat Government and I have got the names, we took a briefing on this, I took the briefing myself. How it went in those days in Gujarat from the original Mr. Justice Soni in 2003, Mr. Justice Vyas in 2006, nobody became a Lokpal – all blocked – nominated by either Chief Justice or by the other consultee but never appointed by Mr. Modi. Then Mr. Soni and Justice Vyas went, then Justice Vora, then Justice Dhokalia and you reach 2011. And finally, when Justice Mehta was appointed in 2011, the Gujarat Government in an unprecedented action, went in Writ Petition. The Government filed a Writ Petition; normally a private citizen files a Writ Petition which travelled to Hon’ble Supreme Court saying why Justice Mehta should not be appointed. That judgment has passed strong remarks and strictures against those in authority who tried to avoid accountability through Lokpal. And then said you must appoint. Unfortunately, Mr. Modi got his view again because no self-respecting man would take up Local or Lookout as the case may be in Gujarat and Mr. Mehta wrote a long letter expressing his deep pain and anguish and resigned. Then Mr. Modi came here. So exactly what he did there, he is doing here. That is Lokpal for you.

Prevention of Corruption Act is the third example – Prevention of Corruption act, was a very old Act which our Government in 1988 consolidated and made into a new Act and the 88 Act was much wider than the original version of the 1940s and 1950s. Now in the 1988 Act, one of the crucial provisions which is now being diluted was that a public servant can be punished for accepting or attempting to obtain any reward for performing its function improperly. That is the heart and soul of that Act. It is inter alia Section 7 but there are other provisions in it. Now they have said this will not apply unless it is shown that he acted dishonestly. A very wide exemption is brought it in. It is virtually impossible in the way the Section is worded, to prove that which makes a big-big escape route and actually again just like the first example I gave of the Whistle-blowers Act, creates an exception which swallows the rule. The intent is to allow gate ways, to allow passages which will make corrupt people get away free. Remember, each of these are our initiatives, which are diluted.

Dr Singhvi said, it legitimizes legally a way of huge political donations without transparency. If you are allowing me to give you Rs. 50,000 crores as a Corporate House, the only question we are asking is why you are not allowing the country to know who it is. We know you are biases, we know your dialectics, we know your preferences. Allow us to know.

That ultimately, this is the height of hypocrisy, double standards, it is the height of selectivity, it is shamelessness actually and just yesterday, yet again we hear our Hon’ble Prime Minister giving us sermons from the pull pit about eradication of corruption. Does not our Prime Minister see his own Party President? Do you think what you saw in the last two weeks in Gujarat, was happening because tea leaves and fresh air was being dangled. Do you think that the expenditure of Uttar Pradesh came from cheques cut for electioneering? You do not see anything there. But anytime there is the slightest tactical violation, you have all the agencies. So, I would request the NDA, I would request our Prime Minister to look backwards, to look inside, to look inwards and do not preach without practice. Do not have this ‘chasm’ between your words and your deeds.

Prof. Rajeev Gowda said I would like to follow up what on what my senior colleague Dr. Singhvi has shared with you and point out that we have documents that we will be sharing with you today – one page Press Release – on all that we have talked out and by e-mail. We don’t kill thousands of trees because the nature of criminal records, the nature of scams that we are going to share with you, adds up too many-many hundreds of pages.

Now first – the issue of criminal cases against BJP MPs and Ministers – this is evidence that is there in the Affidavits that have been filed by these candidates when they stood for election. There may be many more scams and criminal cases against after that, but this focus is what they themselves have revealed. I want to remind you that Prime Minister Mr. Modi in his first speech here, talked about how he would fast track criminal cases and ensure that within six months, those people including MPs from his own Party, would be tackled, action would be taken against them and that the cases would be closed. It is now three years. What happened to that promise Mr. Modi. How come those criminals continue to sit in Parliament and sit in your Ministry? From this document, you will see the list of criminal cases taken from the Affidavit data.

Similarly, the Research Department which I head, has come up with a white paper on the systematic weakening of anti-corruption laws. He has talked about them. I want to add one point – the Electoral Bonds. There are two aspects there – one is about the anonymity of donations Rs 20,000 to Rs 2,000, how it has been brought down, but that makes no difference whatsoever. But the basic point is in a democracy you want to be able to follow the money. You want to know who has contributed to whom and what the end result in terms of policy change is. What the Electoral Bond’s proposal does is, it eliminates that, shouts everything in secrecy. How much ever money they make and they take and they can coerce using all the new powers given to Income Tax officials. None of us will be wiser; none of us will be able to question them and day this is what you took from this person or that person. We are objecting to that anonymity, it is against the interest of transparency and level playing field in democracy.

Third document that we are releasing is the BJP’s involvement in scams. This is something that will go on and on. We have organized this according to States. Chhattisgarh, the first one is CM’s son, our Lok Sabha colleague Abhishek Singh’s involvement in the Panama Papers Leak. Recently we have done a Press Conference about Forest Land grabbing by Mr. Aggarwal, the Minister there. We had the PDS Scam and the MNREGA Scam, Sand Scam.

Maharashtra, we have recently did a Press Conference on numerous scams involving multiple Ministers. The housing Minister and the Sum Rehabilitation scam. So, we have organized these according to series. That is the level of scams that have been taking place which the Prime Minister for all that information that he receives in this highly centralized Government, somehow this information seems to elude him. We want to make sure and through you, the Nation, we want to make sure is aware of the extent the depth and the magnitude of the scams that are going on across the length and the breadth of the country under the ‘BJP Sarkar’s’. Karnataka, we have already mentioned. You can remember that we also had at the height of demonetization a 500 Crore wedding hosted by one of our Reddy Brothers who is very-very famous in the country. Gujarat – we have the GSPC scam, the Bank Scam, Fishery scam, Land allotment scam. Numerous scams in Rajasthan that are coming out all the time. Going back to Lalit Gate and other such issues – Madhya Pradesh VYAPAM has already been mentioned. And this is material that we will also share with you.

And so finally, I want to point out that you will get these three documents – one on criminal cases on which no action has taken place – A white paper on the weakening of anti-corruption laws and finally this list of scams that we have been able to uncover so far. And we ask and urge Mr. Modi, to end the hypocrisy to please match actions to the words that he periodically tries to entice the people with when he says that he is fighting against corruption. The record shows that his fight against corruption, the action level is absolutely Zero and until he takes action against his own colleagues and demonstrates how he is able to send them to jail, we will not believe and that Nation will not believe a word further that he utters on the issue of corruption.

हमें हर दिन नैतिकता का एक सबक सिखाया जाता है और नैतिकता के आधार पर वो कहते हैं ना कि भ्रष्टाचार भी करो तो सफाई के आधार पर, तो वही हो रहा है। अभी हमने देखा उसका एक उदाहरण। पहले आपने देखा कि आप गणतांत्रिक, लोकतांत्रिक तरीकों से गोवा हारे, मणिपुर हारे और अनैतिक, अलोकतांत्रिक, अगणतांत्रिक तरीकों से सरकार बनाई। फिर आपने देखा कि अभी कल-परसों बिहार में भाषण दिए गए लंबे-चौड़े नैतिकता के ,क्यों, छठी बार मुख्यमंत्री बनने के लिए। ये तो सीएम पोर्टेबिलिटी है, जैसे मोबाईल नंबर पोर्टेबिलिटी होती है।

सिर्फ सर्विस प्रोवाईडर बदलता है, दूसरा रखे। ये तो सीएम पोर्टेबिलिटी हो गई 24 घंटो में। मुख्यमंत्री, मुख्यमंत्री रहे, जो उनका सर्विस प्रोवाईडर है ,वो बदल दिया उन्होंने। अगर इतने नैतिकता और भ्रष्टाचार के हमें सबक सिखाए जा रहे थे, तो केयर टेकर मुख्यमंत्री रहते कुछ दिन, चुनाव करवाते, जनादेश लेते बिहार का वापस। आप तो नहीं भूल सकते इतनी जल्दी कि चुनाव से पहले आपका एक पूर्व घोषित एक गठबंधन था, अनैतिक तरीका उसके आधार पर आपने वोट लिया। तो क्या फर्क पड़ता 4 महीनों के लिए, 3 महीनों के लिए आप केयर टेकर रहते, और तो कोई रहता नहीं। तो ये भ्रष्टाचार है, अनैतिकता है, मूल्य हैं, संविधान है इन प्रश्नों के कौन उत्तर देगा? ये बात रही बिहार की।

आज हम गुजरात में क्या देख रहे हैं। सुरजेवाला जी ने गुजरात में प्रैस कॉन्फ्रेस की है। वहाँ आपको बताया गया है। तीन मुख्य बिंदु वहाँ लिए गए हैं। बीजेपी की जहाँ तक नीति है, वो वही नीति है जो मणिपुर में थी, गोवा में थी, बहुत हद तक बिहार में थी, वही गुजरात में प्रयत्न किया जा रहा है कि – फूट डालो, अहंकार पालो, जनमत हरो और राज करो। एक अनैतिकत, भ्रष्टाचारी तौर तरीकों से राज करो। ये दो शब्द हैं अंततोगत्वा उद्देश्य वाले। उसके लिए –

वो उद्देश्य हमें स्थापित करने हैं और इसका आधार है 3 बल- सत्ताबल, धनबल और बाहुबल। तीनों का आपने एक नंगा प्रदर्शन देखा है गुजरात में भी और आपको बताया मेरे मित्र ने अहमदाबाद में, करोड़ों में खरीद-फिरोख्त की बातें चल रही हैं। पुना भाई कामिद का किस्सा भी सुनाया।अब 2 सीधे महत्वपूर्ण कानूनी आयाम आते हैं। पहला आयाम है Prevention of Corruption act. ये जो एम एल ए आजकल प्रयत्नशील हैं रुपए कमाने के तरीके में। उसके अलावा रुपए को आप भूल भी जाएँ और जैसा मैंने कहा कि अहमदाबाद में स्पष्ट रूप से बताया आपको कि कैसे करोड़ों रुपए में खरीद-फिरोख्त हो रही है। अगर आप रुपयों को साईड में रख दें तो सच्चाई क्या है, सच्चाई ये है कि-

अब मूल बात यहाँ हो गई है, ये इस्तीफे उतना ही भ्रष्टाचार है। मैं आपको पब्लिक सर्वेंट को लुभावन देकर किसका लुभावन या तो पैसे का और या एक टिकिट का, एक सीट का भी लुभावन होता है। पब्लिक सर्वेंट उस लुभावन से अपना इस्तीफा देकर आगे बढ़ता है तो ये भी Prevention of Corruption Act. में आता है। इसके अलावा बहुत तथ्य हैं जो सीधे रुपए की बात करते हैं, वो भी करोड़ों की। नहीं तो अचानक विभिन्न एमएलए का इस्तीफा लेना, मांगना ये कौन खरीद-फरोख्त कर रहा है, ये सत्ताबल, धनबल और बाहुबल के आधार पर बीजेपी सरकार गुजरात में कर रही है। वो सब एम एल ए सावधान रहें क्योंकि अनुच्छेद 7, 8, 13 है Prevention of Corruption Act. को PC एक्ट कहते हैं। उसके अतिरिक्त Section 120-B जो कॉन्सपिरेसी का Section है Indian Penal code में। ये सभी प्रावधान उन पर लागू होंगे और हम अपने सभी अधिकार क्षेत्र खुले रखते हैं ऐसी सभी कार्यवाही करने के लिए, जिससे आगे भविष्य में उनको काफी तकलीफ हो सकती है, देने वाले को भी और लेने वाले को भी और ये उस प्रधानमंत्री की पार्टी से भी हो रहा है जो बार-बार कहते हैं कि ना खाउंगा और ना खाने दूंगा, ये तो स्पष्ट खिला रहे हैं, प्रोत्साहन दे रहे हैं खिलाने का, लुभावन देने का।

तीसरा मित्रों ,इससे भी ज्यादा गंभीर दल-बदल का मुद्दा है। इसको हमारे संविधान में उच्चत्तम न्यायालय ने बार-बार Constitutional sin, संवैधानिक अनैतिकता कहा है। संवैधानिक बहुत बड़ी भर्त्सना योग्य चीज है और जब 1985 में 10वाँ शेड्यूल बना था पार्लियामेंट संसद द्वारा तो उसमें कहा गया था- Evil of political Defections को रोकने के लिए। दूसरा है-

इतना महत्वपूर्ण माना गया है 10वाँ शेड्यूल। जिसके आधार पर दल-बदली को एक संवैधानिक evil माना गया है। इसमें अन्य विभिन्न निर्णय हैं उच्चत्तम न्यायालय के। एक बड़ा प्रसिद्ध निर्णय है कीतो-पलिअंत, नागालैंड से आया था, वहाँ उन्होंने कहा कि जो कारण से आप अपने व्यक्ति को वापस बुला सकते हैं, सांसद हो या एमएलए हो, जिन कारणों से आपके पास राइट ऑफ रिकॉल हो, हमारे देश में तो नहीं होता है, कई देशों में नहीं होता है। उन्हीं कारणों के आधार बनते हैं दल-बदल प्रिवेंट करने के। अगर दल-बदल आप करते हैं तो उसका आधार वही है कि आप संवैधानिक सिद्ध कर रहे हैं। ये उच्चत्तम न्यायालय कहता है मैं नहीं कह रहा हूं। उसके बाद कहा कि-

अब एक रोचक प्रसंग है। Defection का एक मतलब होता है कि मैं खड़े होकर संसद में सांसद की हैसियत से कहूं या एमएल की कि मैं आज इस पार्टी को छोड़कर उस पार्टी में शामिल हो रहा हूं। Defection वो नहीं होता है सिर्फ। कानून में, 10वें शेड्यूल में Defection के कई आयाम हैं। बड़ा रोचक प्रसंग है। जो एमएलए अभी इस्तीफा दे रहे हैं अगर वो इस भुलावन में हैं, बरगलाहट में हैं कि वो दल-बदली के कानून 10वें शेड्यूल में नहीं आते तो मैं समझता हूं कि उन्हें अपने सलाहाकारों से बात करनी चाहिए।

रवि नायर का केस आया था उच्चत्तम न्यायालय में, गोवा से। वहाँ उन्होंने बड़ा स्पष्ट कहा कि-
सिर्फ चिट्ठी लिखकर इस्तीफे से नहीं होता, वो कुछ भी चीज करो आप जिससे कि आप स्वत:अपनी मैंबरशिप give up कर रहे हैं ,वो भी दल-बदली होती है। इसमें लिखा है। रवि नायर के उच्चत्तम न्यायालय के निर्णय से पढ़ रहा हूं-

अब एक और रोचक पहलू- इस प्रावधान में एक और संशोधन हुआ, वो था कि राज्यसभा के चुनाव के विषय में, मैं MLA की हैसियत से वोट देता हूं तो उस वोट को मुझे दिखाना पड़ेगा, चीफ व्हिप हमारी पार्टी को या पार्टी द्वारा अधिकारी व्यक्ति, उसको दिखाना पड़ेगा। ये संशोधन है कानून का, ये आम वोटिंग में नहीं होता है। इसको कुलदीप नायर साहब ने चुनौती दी उच्चत्तम न्यायालय में। एक तीसरे जजमेंट का जिक्र कर रहा हूं, 2006 का। उच्चत्तम न्यायालय ने कुलदीप नायर की चुनौती को खारिज किया, ये कहते हुए कि ये बात सही है कि संदिग्धता वोट की खत्म हो जाती है क्योंकि सिंघवी ने वोट दिया MLA का, राज्यसभा में, सिंघवी का वोट दिखाना पड़ता है सिंघवी वाले व्हिप को कि मैं वोट दे रहा हूं वोट। तो सिंघवी कह सकता है कि मेरे वोट की संदिग्धता, गुप्तता खत्म हो गई। तो उच्चत्तम न्यायालय ने कहा कि वो हो सकता है लेकिन उससे ज्यादा सर्वोपरी उद्देश्य है कि दल-बदली वाला संवैधानिक सीन हम रोकें। इसलिए हम इस प्रावधान, इस संशोधन को Valid, सही मानते हैं जिसके अंतर्गत राज्यसभा चुनाव में संशोधन द्वारा अपने वोट को आपको दिखाना पड़ता है, अपनी पार्टी के चीफ व्हिप को। क्यों, क्योंकि आप गलत वोट करके दल-बदली भी कर सकते हैं। दल-बदली इस्तीफे से होती है, गलत वोट से होती है, क्रॉस वोटिंग से होती है, व्हिप के निर्देशानुसार ना वोट करने से होती है। तो ये दिखाना पड़ता है और उच्चत्तम न्यायालय ने इसको भी सही माना।

ये सब चीजें जो मोदी जी गुजरात में MLA को प्रोत्साहित कर रहे हैं। ये वो मोदी जी और अमित साहब जी हैं जो MLA को प्रोत्साहित कर रहे हैं लेकिन ये नहीं बता रहे हैं इनको कि इसका दंड तो वो बेचारे MLA पाएंगे। ना मोदी जी और ना अमित शाह जी को मिलेगा वो दंड। दंड क्या होता है, वो सभी MLA सावधान रहें, 6 साल की Disqualification. Disqualification इस ऐसेम्बली से, इससे फर्क नहीं पड़ता 6 महीने में 6, जब मैं खुद ही इस्तीफा दे दूं तो Disqualification से फर्क नहीं पड़ता। लेकिन वो भूल रहे हैं कि Disqualification 6 वर्ष तक आगे होता है। यानी अगर मैं दल-बदली के लिए संदिग्ध हूं आज और कल मैं दल-बदली माना जाता हूं तो 6 वर्ष तक मैं Disqualification होता हूं, भविष्य के किसी भी चुनाव के लिए। क्या ये बताया गया उन लोगों द्वारा जिन लोगों ने आपको पैसे दिए दल बदलने के लिए। जिन लोगों ने आपको टिकट का लुभावन दिया, जिन लोगों ने आपको प्रोत्साहित किया भ्रष्टाचार में लिप्त होने के लिए। इसलिए आपको कानून समझाना आवश्यक था।

चौथा और अंतिम बिंदु- जो ये व्यक्ति हैं पुना भाई कामिद, जो अहमदाबाद में कांग्रेस के मंच पर बैठ कर कॉन्फ्रेस की, पुराने एमएलए हैं, SC-SC के क्षेत्र से आते हैं। उन्होंने पूरा रिकॉर्ड करके बताया कि किस प्रकार से वो कांग्रेस के अधिकारियों से बात कर रहे थे, किस प्रकार से एक ऊँचे स्तर के पुलिस अफसर आए, जो संदिग्ध हैं और जिन्होंने जेल में समय बिताया, इल-लीगल एनकाउंटर और किलिंग में और उन्होंने कहा कि आप यहाँ आकर बैठिए, हमारे साथ बातचीत कीजिए, चाय पीते हैं और चाय पीते हुए कहा कि साहब कांग्रेस को छोड़ दो, हम आपको टिकट दे रहे हैं, यहाँ टिकट किसी और को मिल रहा है और हम आपको नहीं जाने देंगे आप हमारे साथ रहो। ये पूरा बैठकर पुन्ना भाई गावेद, एमएलए ने रिकॉर्ड किया है। ये आज हालत हैं गुजरात में।

महज 15 घंटों में नीतीश जी की अंतर्रात्मा की आवाज ने उन्हें बिहार की जनता के जनादेश को ठुकराने की आकाशवाणी सुना दी।

आज आयाराम-गयाराम की नीति से भाजपा जनादेश की हत्या करने में लगी है। आज भाजपा जनादेश के साथ जोड़-तोड़ की राजनीति द्वारा गणतांत्रिक और लोकतांत्रिक ,सभी संस्थाओं को नष्ट करने में लगी है और साथ-साथ बिहार से गोवा, मणिपुर से दिल्ली, गुजरात तक हमें भाषण देती है, नीतिगत नैतिकता के आधार पर।

डॉ. सिंघवी ने कहा कि जीरो टॉलरेंस के फ्रेज को नए रूप से परिभाषित करुंगा। माननीय प्रधानमंत्री जी की डिक्शनरी में जीरो टॉलरेंस की ये परिभाषा है। इसके अनेक अनेक उदाहरण हैं।

एक प्रश्न पर कि जिस तरह से कांग्रेस विधायक पार्टी छोड़ कर जा रहे हैं क्या आपको डर है कि आप राज्यसभा का चुनाव हार सकते हैं, डॉ. सिंघवी ने कहा कि हमने ये प्रैस कॉन्फ्रेस की आपके सामने, ये एक्सपोज करने के लिए कि किस तरह से सस्ती राजनीति बीजेपी-एनडीए कर रही है, माननीय मुख्यमंत्री और बीजेपी अध्यक्ष के निर्देश पर और आदेश के अंतर्गत। इसका मतलब ये नहीं है कि हम किसी रूप से भयभीत हैं या हार की अपेक्षा करते हैं। ये अत्यंत आवश्यक है कि इनका सही चाल-चेहरा और चरित्र आपके सामने एक्सपोज किया जाए, नकाब हटाकर दिखाया जाए और साथ-साथ आपको कानून से अवगत कराया जाए। क्या खिलवाड़ अग्नि से कर रहे हैं ये। आप खेल किस खतरनाक तरीके का कर रहे हैं, अपने खुद के करियर के विषय में भी और कानून के साथ भी।

एक अन्य प्रश्न पर कि भाजपा ने ये आरोप लगाया है कि कांग्रेस को दूसरों पर आरोप लगाने से पहले अपने कुनबे को संभालना चाहिए, डॉ. सिंघवी ने कहा कि ये बड़ा अच्छा सिद्धांत है। इसके आधार पर तो 10वाँ शेड्यूल बनना ही नहीं चाहिए था, क्यों बनाया। हर व्यक्ति अपने कुनबे का ध्यान रखेगा। मैं अपने कुनबे का ध्यान रखूंगा, आप आकर उसको भ्रष्टाचार के रुप से प्रलोभन देंगे, रुपए देंगे और आप गलती करें और मैं अपने कुनबे का ध्यान नहीं रख रहा हूं। कुनबे के ध्यान में ये किसने लिखा था कि बाहर के लोग आकर प्रलोभन देंगे, सीट ऑफर करेंगे, रुपए ऑफर करेंगे, पुलिस अफसर को भेजेंगे, जिनका नाम मैंने पढ़ा पुना भाई कामिद, जिनके पास भेजे गए, स्टेट के सभी अफसरों का इस्तेमाल, दुरुपयोग किया जाता है। ये कुनबे का ध्यान रखने की बात करते हैं। ये आपके चाल-चेहरा और चरित्र को एक्सपोज करती है ,उस प्रधानमंत्री के, जो कहते हैं कि ना खाऊँगा ना खिलाऊँगा। अपने प्रदेश में, बड़े स्पष्ट रुप से, आदेश पर, क्या ऐसा हो सकता है बिना उनके आदेश के?

एक अन्य प्रश्न पर कि राजनीतिक लड़ाई को आपने कानूनी तरीके से समझाया, क्या आप अपने एमएलए को समझा नहीं पाए, डॉ. सिंघवी ने कहा कि जो प्रैस वालों के पास स्पेशल मीटर होता है, एडिटिंग इस्तेमाल करने का, हमारे पास नहीं है। ये थर्मामीटर मुझे भी दे दीजिए। ये आपके पास हो सकता है। लेकिन जब मैं किसी और को एक्सपोज कर रहा हूं तो मैं डीमोटिवेट नहीं हूं, ये कौन सी भाषा है। ये खुली खरीद-फरोख्त कर रहे हैं, ये सुनने वालों को होना चाहिए या मुझे?
गुजरात में हुए कांग्रेस विधायकों के इस्तीफे को लेकर पूछे गए प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि बहाने तो जिंदगी भर कर सकते हैं, इस बात से वो अवगत आज हुए, 28 तारीख को। कांग्रेस पार्टी के अफेयर से उनको सभी चीजों का आभास अब हुआ। तो उनके बहानों और कारणों से हमें अवगत न कराएं। ये बहानेबाजी चलती रहती है जो मैंने बताया। भ्रष्टाचार का आयाम और दल-बदल का आयाम वो मूल मुद्दा है। मैं आपको 50 बहाने बता सकता हूं कि क्यों दल-बदल करना चाहिए और क्यों नहीं करना चाहिए। तो उसका कोई मतलब नहीं है।

पनामा केस को लेकर पाकिस्तान के पीएम ने इस्तीफा दिया, क्या इसको भारत के परिप्रेक्ष्य में देखा जाएगा, डॉ. सिंघवी ने कहा कि पहली बात तो लाहौर और अमृतसर में कितने किलोमीटर का फर्क है, मुझे ध्यान में नहीं। लाहौर में या इस्लामाबाद में जो हो रहा है वो हजार किलोमीटर दूर छ्त्तीसगढ़ में भी होना चाहिए। पनामा का जब आप नाम लेते हैं, तो अगर पड़ोसी देश, जो पूरी तरह से गणतांत्रिक तो नहीं मानते हम, उस पड़ोसी देश के प्रधानमंत्री का इस्तीफा है तो हम चाहेंगे कि मुख्यमंत्री हमारे देश के उसी आधार पर इस्तीफा दें, उसी रिपोर्ट में उसी पर्चों में, उसी बैंक के उसी अकाउंट में, मिस्टर रमन सिंह साहब के पुत्र का नाम आया था। उसके बाद माननीय प्रधानमंत्री और एनडीए ने पूरे देश में लालू जी से लेकर कई और व्यक्तियों के विरुद्ध कई और अभियान कर दिए, कभी आपने छत्तीसगढ़ का नाम सुना, क्या कार्यवाही हुई? दूसरा जांच तो निश्चित हो इस्तीफा हो गया, आप जांच की क्या बात कर रहे हैं। सिलेक्टिव जांच नहीं हो सकती है। अपॉर्चुनिस्टिक जांच नहीं हो सकती है। आपने क्या सुना सिर्फ लालू जी को पकड़ा गया, उदाहरण बनाया, 4-5 और बनाए तो उससे क्या आप सिलेक्टिव नहीं होते हैं?

एक अन्य प्रश्न पर कि रमन सिंह के पुत्र के अलावा पनामा मामले में बच्चन परिवार का भी नाम आया, डॉ. सिंघवी ने कहा कि सिलेक्टिविटी देखिए। मैं किसी एक व्यक्ति की बात नहीं कर रहा हूं। मेरा कहना है कि मापदंड वही रहेगा, ऐसा नहीं कि इसमें कांग्रेस का नाम नहीं आएगा, मापदंड कैसे बदल सकता है? अगर किसी कांग्रेस एमएलए का नाम आता है तो आपको उसी मापदंड से करना होगा। आज ये नहीं कर सकते कि एक तरफ तो नीतीश कुमार जी कहते हैं कि सिर्फ एफ.आई.आर के आधार पर मैं बीजेपी में शामिल हो रहा हूं क्योंकि तेजस्वी जी ने पूरा एक्सप्लेनशन नहीं दिया एफआईआर का और दूसरी तरफ माननीय उमा भारती जी चार्ज शीट होने के बाद 4 साल के आॉफेंस में, एफआईआर पर नहीं, उच्चत्तम न्यायालय के आदेश में डे-टू-डे ट्रायल चल रहा है फिर भी कैबिनेट में हैं। ये कौन सा आयाम हुआ। ये जो सिलेक्टिविटी की बात हो रही थी, आप देखिए तेजस्वी जी के विरुद्ध एफ.आई.आर है, इसका मतलब होता है First Information Report.उमा भारती जी और बहुत दिग्गज नेता हैं जो अभी मंत्रीमंडल में नहीं है, जिनके विरुद्ध ट्रायल चल रहा है और उच्चत्तम न्यायालय के निर्णय ने 2 महीनों पहले कहा है कि इस ट्रायल को जल्दी खत्म करना है, फिर भी वो मंत्रीमंडल में हैं ,कैबिनेट मंत्री हैं। तो इसमें मापदंड का कहाँ सवाल उठता है?

एक अन्य प्रश्न पर कि गुजरात मामले पर आप कोर्ट में जाएंगे, डॉ. सिंघवी ने कहा कि सब ऑप्शन मतलब सब-राजनीतिक, सामाजिक, सबसे जरूरी जनता से संबंधित और कानून।एक अन्य प्रश्न पर कि गुजरात नतीजे पर क्या प्रभाव पड़ेगा, डॉ. सिंघवी ने कहा कि डिफेक्शन की बात मैंने आपको विस्तार से बता दिया कि कानून क्या होता है। जहाँ तक परिणाम का सवाल है हमें विश्वास है कि, संदेह नहीं है। लेकिन साथ-साथ ये भी अति आवश्यक है कि इन्हें एक्सपोज करना और दूसरी तरफ उन सब व्यक्तियों को अवगत करना इन सब परिणामों से।

Unprincipled defection is a social and political evil. This is an awkward erosion and a grotest manifestation which is the bane of our times.Now a days, we have fallen to the morass of a personal and political degradation which is why the evil, the Constitutional sin or defections must be stopped.Voluntary giving up of a Membership in any form is defection.

In the judgment in the case of Shri Ravi Naik, Hon’ble Supreme Court said, “the said paragraph provides for disqualification of a Member of a House belonging to a political party, if he is voluntarily giving up his Membership of that political party, the word “voluntary giving up’ his Membership are not synonymous with resignation only and have a wider connotation. If a person may voluntarily give up his Membership of a political party even in the absence of a formal resignation, and so long as an inference can be drawn that he is not supporting his party, then also there is a defection.

Dr. Singhvi said undermining and subverting the authority of an elected Government has become the hallmark of BJP. The BJP believes in shamelessly denigrating, decimating and deprecating every Institution of democracy and those Institutions include Assemblies, Parliament, MLAs, MPs and all the Constitutional provisions against corruption and defection.

Dr. Singhvi said we have seen in the recent past lectures on morality and anti-corruption, which are in inverse proportion to practice by the BJP and the NDA. Their words and deeds have a difference of the sky and under world. Their preaching and practices are completely divergent.

You have seen it in Goa having lost the peoples’ mandate; every possible attempt was made to gobble a Government by undemocratic, illegal and immoral means. The same story was repeated in Manipur. This great Bihar lecture though we have been receiving whereas actually it is a conspiracy and collusion between our Prime Minister and a person seeking continuous sixth term CMship, Mr. Nitish Kumar.

I was amused when I found that Shri Nitish Kumar lost his CMship today evening to regain it tomorrow. It reminded me, as I said, a Number portability. I can transfer my number only my service provider changes. The service provider of Shri Nitish Kumar has suddenly changed and overnight his antaratma

Now this portability for what – the CM portability – that the mandate of the people was based on a pre election declared ‘Gathbandhan’. It was not a expedient post election ‘Gathbandhan’.

Let me summarize quickly the two vital issues that are small issues but vital issues of corruption and of defections and they go together.Our colleague held a Press Conference in Gujarat today at 3.30 pm that Crores are exchanging hands for blatant day light changing of loyalties and defections in the most brazen misuse of ‘Dhan-bal’, ‘Bahu-bal’ and ‘Satta-bal’.

Now, in case those MLAs are not made aware by the people who are trying to bribe them, apart from money, my offer to you as a public servant , a sitting MLA to resign his seat in exchange for a future seat is itself corruption because the language of Section 7, 8 and 13 of the Prevention of Corruption Act is ‘any public servant receives any gratification in cash or kind as a reward or a motive for doing or not doing or forbearing to do. So a public servant namely an MLA receiving the offer and promise of even a ticket to leave his Membership is a corrupt act and all the Sections will apply in addition to conspiracy charge of 120-B of the IPC.

I do not know if these MLAs who are trying to be very brave on the advice of BJP are being made aware of the consequences of 7 to 10 years punishment under the Prevention of Corruption Act. But even much more serious is the Anti-Defection Law the Xth Schedule brought in 1985, the statement of objects by Parliament said, the evil of political defections which must be stopped like a scourge because it undermines the foundations of our democracy. Repeatedly the Constitution of India and more importantly Hon’ble Supreme Court in diverse judgments has called it a ‘Constitutional sin’.

Now 2-3 very interesting aspects – one – if you give up Membership of your party voluntarily, that is defection. If you cross vote, that is defection. If you act contrary to the whip of the party, that is defection. If you do any act contrary to the interests of the party like hobnobbing with other parties, that is defection. It does not require formal resignation. Now defection, it is all very well for these people to be befooled and trapped by the BJP, by Shri Amit Shah and Shri Modi. However, were they told by Shri Amit Shah and Shri Modi that if they are disqualified, if the Xth Schedule is applied by a Court of Law, on our complaint, and after three to six months or even a year, if the MLA is disqualified for 6 years, after that he cannot hold any elective office? He can’t fight an election, he can‘t be MLA or MP. Have they been told of these criminal consequences?

In Ravi Naik’s case, from Goa, the Court clarifies that voluntarily giving up Membership in any manner or in any form constitutes defection. It has a very wide connotation. Now another very interesting aspect – an amendment was brought to this law in the interest of anti-defection. The Amendment was that in Rajya Sabha election in particular, where an MLA casts his vote, the voter must show i.e. the MLA must show his vote to the Chief Whip of his party or to the authorized official of the party.

Shri Kuldeep Nayar challenged it saying this is violation of confidentiality of the vote. The Hon’ble Supreme Court upheld such a drastic provision on the ground that the Constitutional sin of defection requires higher premium even higher than the confidentiality of the vote and therefore, today those MLAs who will defect, not vote, leave their Membership, join another party, cross vote or hobnob, all of them are liable under defection law, which means for 6 years they cannot stand for office, they cannot be MPs or MLAs. I hope and trust that these severe consequences have been made known to them by those who are trying to subvert democracy by those who has DNA to subvert Institutional and Constitutional democratic Institutions.

On the question whether the Congress Party will invoke anti-defection law, Dr. Singhvi said we reserve all our rights. This is only the beginning. The election is still 8–10 days away. I am telling you the true contours and boundaries of the dangerous game being played by the BJP upon MLAs who may be relatively innocent or unaware of the drastic consequence. As far as invocation and action is concerned, let me assure you all options are open to us, none are closed.

On the question if this is a warning from this forum, Dr. Singhvi said facts constitute warnings, facts constitute consequences, facts constitute reality and facts constitute truth taken in whichever adjective you like. Facts cannot be ignored unless you are ostrich who puts its egg in the sand. So, we are making you aware of legal fact, political fact.

On the reaction of the Congress party on the statement of Chief Minister of J&K today in Delhi, Dr. Singhvi said the divergence of opinions between these two coalition partners and the Centre and within the partners, is so great as to be like the sky and the bottom of the ocean. This is just a camouflage of words to hide their difference. What the country wants, what the principal opposition wants, is an answer on the substance, not on words which camouflages this difference.

Today, it is an open secret that not a single policy of the Central Government currently underway is accepted or implemented in a genuine spirited sense by the J&K State Government. They believe that questions are different and answers must be different. In this terrible-terrible divergence, who is suffering – the most vital part of India and India and every Indian.

On a supplementary question on Panama Papers and Zero tolerance on corruption claim by Shri Narendra Modi, Dr.Singhvi said zero tolerance as far as mere allegations and FIR qua opposition only. However, 100% tolerance is qua non-opposition leaders who may be in the same list with the same charge.

What is the right to privacy?

We all know the proverbial elephant but cannot easily define it. It is different things to different persons in different contexts. The simplest and best definition is the right to be left alone. Its diverse manifestations include one’s honour, reputation, not to be eavesdropped, one’s home being one’s castle, personal belongings and data being inviolable, personal choice in all aspects of living, a protective arc against arbitrary intrusions and so on.Without such rights and protections, there be no true liberty, freedom, civilised existence and, indeed, no t r u e d e m o c r a c y.George Orwell’s nightmare state of Big Brother would be the alternative realit y without such a right.

Is this right constitutionally recognised in Indian law?

Gobind (1975) and Maneka (seven judges, 1978) were the clearest enunciations of privacy as a constitutional, Part 3 right. They based their derivation mainly on the right to life (Article 21) as also a teleological reading of all other fundamental rights in Article 19. After these two seminal judgments, innumerable apex court pronouncements have reiterated the existence of an Indian, constitutional Part 3 right to privacy. An illustrative list includes Malak (1981), Rajagopal (1994), PUCL (1997), District Registrar ( 2005), Suchita ( 2009), Selvi (2010) and Nalsa (2014).

Why, then, this hullabaloo and doubts on the existence of a constitutional right to privacy and why the setting up of a new ninejudge bench?

During the hearing of an Aadhaar-related case over a year ago, the attorney general argued that the aforesaid rich jurisprudence should be overturned as per incuriam (contrary to law) because they had not considerednot given effect to the binding consequences of two earlier judgments by much larger benches, viz MP Sharma (1954, eight judges) and Kharak Singh (1963, six judges). Hence, only a still larger combination of nine could decide whether to affirm the two last cases on the government’s inter pretation qua privacy or clarify the earlier long list of cases as valid, operable law.

There are several reasons why the government’s stand is wrong.

It is an axiomatic principle of Indian law that, in the absence of any specific statutory mandate to the contrary, international treaties, international customary law and the corpus of international jurisprudence will be used as valuable aids for interpretation in Indian decision-making and substantive adoption in Indian jurisprudence. The right to privacy has a respectable and unbroken legacy, finding detailed elaboration right from the Universal Declaration (1948), International Covenant (1966, which India signed and ratified) and almost all human rights conventions, including the American and European ones.

What’s more, spe cific, narrow, calibrat ed and focused legisla tively sanctioned inva sions of privacy (for example, under the Postal Act or Tele graph Act) permitting interception of postal articles or telephonic communications un der controlled condi tions are themselves a clear recognition of the constitutional right to privacy.

What are the limitations on the constitutional rights to privacy?

Part of the government’s conceptual confusion arises from a misplaced fear that a constitutional right would make citizens inviolable and invincible and the government impotent. A privacy right is, like all constitutional fundamental rights and freedoms, subject to reasonable restrictions. It is obviously derogable for public welfare, public interest, law & order, public order, national security, sovereignty & integrity considerations.Use of privatepersonal material in public interest in judicial or legislative proceedings, subject to compliance with legal preconditions, is another example of permissible derogation from privacy rights. Hence alarmist reactions to the consequences of adopting a constitutional privacy right is an ostrich in the sand attitude.

India awaits unequivocal, definitive and binding clarity on this vital theme, especially in the context of India’s proud occupation of prime spot as the nation with the most dynamic and avant garde legal concepts (like basic structure theory, public interest litigation) and the most advanced boundaries of judicial review.

इसके तीन पहलू हैं और मैं राष्ट्रीय सुरक्षा की व्यापकता की बात नहीं कर रहा हूं, मैं आज अभी चीन तक सीमित कर रहा हूं। जहाँ तक हमारे सबसे पुराने, बहुत ही महत्वपूर्ण दोस्त का पहलू है – भूटान का, जिसके प्रति हमारी कट्टिबद्धता पर कोई संदेह या प्रश्नचिन्ह नहीं उठ सकता और ना ही उठना चाहिए। दूसरी तरफ ये चीन का सबसे ज्यादा आक्रामक स्टांस जो देखा है हमने 40-50 वर्षों में वो पहलू है। तीसरा बार-बार हमारी बातचीत होती है, फोटो अपोर्चुनीटि होती हैं, यात्राएं होती हैं, अफ्सर जाते हैं, प्रधानमंत्री जाते हैं, आते हैं और झूला झूलते हैं और नतीजा, लगातार संबंध खराब होना। ये तीन पहलू हैं जिनको सरकार तुरंत ठीक करे। ये अति आवश्यक है देश के लिए।

इसके साथ हम आपको याद दिलाना चाहते हैं कि अगर पुराने एग्रीमेंट की हाल में जो नींव है, वो इतनी ठोस है, इतनी मजबूत, इतनी व्यापक है कि उस नींव के उपर भी अगर ये सरकार इमारत बनाने का प्रयत्न करती तो इतनी तकलीफ नहीं होनी चाहिए थी। मैं आपको दुबारा याद दिला रहा हूं, अप्रैल 2005 का करारनामा, जिसको ‘लाईन ऑफ एक्चुअल कंट्रोल’ करारनामा कहते हैं, चीन के साथ। उसके बाद हाल में अक्टूबर, 2013 का बॉर्डर डिफेंस कोरपोरेशन करारनामा, चीन के साथ। ये सब चीजें उस वक्त बहुत सीमित थी, कम थी। आज अचानक इसमें जबरदस्त चौंकाने वाली वृद्धि कैसे हुई?

मैं आपके सामने आश्चर्यजनक आंकड़ा रखता हूं कि पिछले 45 दिनों में 120 चीन के incursions हुए हैं, लगभग 3 प्रतिदिन। ये औपचारिक आंकड़े हैं, मेरे आंकड़े नहीं हैं और अगर आप 2017 को लें, जो अभी आधा हुआ है उसमें 240 ऐसे incursions या transgressions हैं। ये बहुत ही दयनीय हालत है और ये पहले कभी नहीं हुआ।

बहुत अरसों से नहीं हुआ कि मानसरोवर की यात्रा नाथूला के जरिए ऐसे आक्रामक रुप से बंद की गई हो। पहले नहीं हुआ जो अभी हाल में 4 जून को हुआ कि 2 चीन के हैलिकाप्टर चमोली तक पहुंच गए, उत्तराखंड में। उससे कुछ महिनों पहले 2 और हैलिकाप्टर साढ़े 4 किलोमीटर भारतीय टैरिटरी, उत्तराखंड में पहुंच गए और जैसे मैंने व्यथा व्यक्त की थी कि इन सब संदर्भ में, उन लाल आँखे, 56 इंच छाती की बात छोड़िए, वो लाल आंख हमें दिखती नहीं है और 56 इंच छाती इनविजिबल हो गई है। लेकिन इन सबके बीच हमारे मंत्री महोदय ने क्या वक्तव्य दिए हैं। हाल में माननीय गृहमंत्री ने कहा- Chinese incursions is only perception. माननीय राज्य रक्षा मंत्री ने पार्लियामेंट में कहा- No Chinese incursions, only transgressions. जैसा मैंने कहा कि वकील भी सक्षम नहीं है इस प्रकार का वक्तव्य बनाने में। इसके साथ वो बताते की मतलब क्या होता है, ये बिना फर्क वाले फर्क का।

ये सब कब हो रहा है? ये सब तब हो रहा है जब दिन-प्रतिदिन माननीय प्रधानमंत्री, वरिष्ठ अफसर, मंत्री चीन के लोगों से मिल रहे हैं, फोटो अपोर्चुनीटि हो रही है, मीटिंग हो रही हैं, अहमदाबाद में झूला झूला जा रहा है, आदान-प्रदान हो रहे हैं। साथ-साथ इतने जबरदस्त तरीके से मसूद अजहर को आतंकवादी घोषणा करने के मामले में विरोध हो रहा है भारत का, न्यूक्लियर सप्लायर ग्रूप NSG में बार-बार, हर दिन, हर हफ्ते विरोध कर रहा है। संयुक्त राष्ट्र काउंसिल में खुले रुप से भारत का अपमान कर रहा है। कॉरिडोर का जो मुद्दा था जिसको आप CPEC कहते हैं उसमें भारत बहुत दयनीय दृष्टि से आईसोलेट क्यों हुआ, अकेला क्यों खड़ा पाया गया, अगर आपको विरोध करना है जमकर कीजिए, अकेले मत दीखिए?

ये सब महत्वपूर्ण प्रश्न हैं, ये सब वो प्रश्न हैं जो हर जागरुक, जिम्मेवार और देश से प्रेम करने वाला, देश प्रेम से ओत-प्रोत नागरिक पूछेगा और हम इसे बहुत ही जिम्मेदारी के साथ पूछ रहे हैं? हम ये भी पूछ रहे हैं कि क्या इस देश की वो किस्मत है कि लगभग साढे 3 वर्ष में देश के पास दो ही प्रकार के रक्षा मंत्री होंगे, या तो Reluctant रक्षा मंत्री या पार्ट टाईम रक्षामंत्री। मैं किसी व्यक्ति विशेष की बात नहीं कर रहा हूं, मैं बात कर रहा हूं ऐसे महत्वपूर्ण करार पर खड़े देश के लिए, पार्ट टाईम रक्षा मंत्री से काम नहीं हो सकता।

अंत में एक दुर्भाग्य की बात है, खेद है ये कहने में कि जब यूपीए सरकार ने 64 हजार करोड़ रुपए का 90 हजार नए एडिशनल ट्रूपस का Mountain Strike Crops करने का पूरा प्रस्ताव पारित कर दिया, बजट बना दिया। चौंकाने वाले आंकड़े हैं- 90 हजार नए ट्रूपस और 64 हजार 678 करोड़ रुपए, वो MSC 90 प्रतिशत भारत चीन की बांउडरी सीमा पर ही होते। हम आपसे जवाबदेही चाहेंगे- क्या हुआ उसका, कहाँ चला गया वो, कार्यांवित क्यों नहीं हुआ, पारित क्यों नहीं हुआ? उसमें से आंशिक रुप से खड़ा क्यों नहीं हुआ, क्या वो आज जबरदस्त रुप से कारगर सिद्ध नहीं होता, ये सब महत्वपूर्ण प्रश्न हैं और हम दुख, खेद और जिम्मेदारी के साथ पूछ रहे हैं, सरकार से? अगर ये सरकार ठोस और सही एक्शन लेती है तो हम उसके साथ पूरी तरह से खड़े हैं, समर्थन के लिए, तुरंत इन सब विषयों, पहलुओं पर सही एक्शन लिया जाए।

अकबरुद्दीन औवेसी के बयान पर पूछे गए प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि हमें कोई झिझक नहीं है ये कहने में कि आप उस व्यक्ति, उस पार्टी का वक्तव्य पढ़ रहे हैं जिसको मैं आपके सामने बेबाक होकर, औपचारिक रुप से बीजेपी की B टीम कहता हूं, ये बीजेपी की बी टीम का वक्तव्य है। ये उस ऐजेम्डे वाला वक्तव्य है, जो बीजेपी ने बार-बार इस्तेमाल किया है। ऐसे ऐजेण्डे को फैलाने के लिए, जो विभाजन का ऐजेण्डे है, शत्रुता का ऐजेण्डा है, एक घृणात्मक वातावरण बनाने का ऐजेण्डा है और बीजेपी ने बार-बार औवेसी जैसे व्यक्तियों का उपयोग और दुरुपयोग किया है ऐसे ऐजेण्डे के लिए। उसका एक और उदाहरण आप देख रहे हैं। ये जो डर्टी ट्रिक्स विभाग है बीजेपी का, ये बार-बार चुनाव और चुनाव के अलावा स्ट्रेटेजिक क्षणों में, जब देश की समस्याओं का हल ढूंढने में आप नाकामयाब हों, जवाबेदही मांगी जा रही हो, इसका दुरुपयोग करते हैं और इसका एक ही उद्देश्य है कि आप हिंदु को मुस्लिम के विरुद्ध खड़ा कर दें। विभाजन का ऐजेण्डा पूरे देश में फैला दें, कास्ट बनाम कास्ट हो जाए, धर्म बनाम धर्म हो जाए, प्रदेश, प्रांत बनाम प्रदेश, प्रांत हो जाए और ये एक दुर्भाग्य है कि बीजेपी बार-बार करती है इसलिए इसको एक्सपोज करना इन स्पष्ट शब्दों में आवश्यक है। ये औवेसी बंधुओं को छोड़ दीजिए, ये बीजेपी का काम है।

नितीश कुमार जी के कांग्रेस के संदर्भ में दिए बयान पर पूछे गए प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि मैं स्पष्ट कर दूं कि जहाँ तक राष्ट्रपति के चुनाव का सवाल है, वो मामला खत्म हो गया है। हमने पहले भी और माननीय कांग्रेस अध्यक्ष ने बड़ा स्पष्ट किया था कि अंततोगतवा हर पार्टी का ये अपना स्वत: निर्णय है और जो इसमें अगर पार्टी कोई भी निर्णय करती है जो पार्टी होगी वो उस स्वायत का निर्णय होगा। इसका हमारे बिहार के गठबंधन से ना तो कोई संबंध है और ना ही किसी रुप से उसको कमजोर करता है। हम मजबूती के साथ, साथ खड़े हैं और जो माननीय नितीश कुमार जी ने बार-बार कहा है, कल भी कहा है, इसलिए इसे इस संदर्भ में देखा जाए।

एक अन्य प्रश्न पर कि सूरत में GST के खिलाफ कुछ व्यापारी प्रदर्शन कर रहे हैं, उन पर लाठी चार्ज किया गया, क्या कहेंगे, डॉ. सिंघवी ने कहा कि ये प्रश्न आप गलत व्यक्ति से पूछ रहे हैं, ये आपको उनसे पूछना चाहिए जिन्होंने घंटो मध्यरात्रि के भी बाद जश्न मनाया था। आपने सूरत का उदाहरण दिया, मैं आपको 5 उदाहरण दे सकता हूं, जहाँ लाठी-चार्ज हो रहा है, जो अभियान कर रहे हैं। तो ये सवाल आप उनसे पूछिए जो अच्छे आईडिया को कितने अच्छे तरीके से खराब कर सकते हैं। हमने बार-बार कहा कि GST एक बहुत ही प्रभावशाली और अत्यंत आदर्श आईडियल है। लेकिन अच्छी चीज को कैसे गलत रुप से कार्य़ांवित किया जाए, उसके लिए एनडीए-भाजपा के पास जाएं। 40 प्रतिशत वस्तुओं से रिवेन्यू हटा दिया। आज आप कहते हैं GST – वन नेशन, वन टैक्स। वन नेशन कहाँ है और वन टैक्स कहाँ है, 40 प्रतिशत GST में है ही नहीं। पैट्रोल, एल्कोहल नहीं है तो वन नेशन, वन टैक्स कहाँ हुआ? जिन देशों ने सफलता से इसको कार्यांवित किया है वो एक रेट रखते हैं और एक रेट जिसे डीमैरिट रेट कहते हैं। आज की सरकार ने 7 रेट बनाए हैं। जिसको वन नेशन, वन टैक्स कहते हैं। वन टैक्स 7 रेट, तीसरा कार्यांवित करने के लिए आप इतने नाम ले रहे हैं, सूरत का या और जगहों का, ये वो सब लोग हैं जो पूरी तरह से टैक्स पे करते थे, आज भयभीत हैं कि कल हमें आरोपी बना दिया जाएगा, मैं आपना काम नहीं कर पा रहा हूं ना कम्प्यूटर से ना फार्म से। इनकी व्यथा उस जश्न मनाने वाले इस सरकार के लोगों के कानों तक उस दिन रात को नहीं पहुंची और अब भी नहीं पहुंच रही है क्योंकि ये सरकार ईवेंट मैनजमेंट बनाने में माहिर है।

एक अन्य प्रश्न पर कि बीजेपी के राष्ट्रीय अध्यक्ष ने गोवा में एयरपोर्ट परिसर के अंदर ही मीटिंग कर दी, क्या कहेंगे, डॉ. सिंघवी ने कहा कि बीजेपी समझती है कि हम सरकार में है तो हर स्थिति, हर क्षेत्र, हर प्रोपर्टी उनकी पार्टी की है और दूसरा बीजेपी की ये एप्रोच है कि हर चीज में राजनीति होनी चाहिए, एयरपोर्ट में हो या बाहर हो। केन्द्र में उनकी सरकार, प्रदेश में उनकी सरकार, एयरपोर्ट की अथोर्टी उनकी सरकार के अंदर आती है, अफ्सर उनके, हम क्या जवाब दें? अगर इस तरह की गैर-जिम्मेदारी दिखाई जाएगी वो भी राष्ट्रीय अध्यक्ष के द्वारा तो वो बहुत दुखद प्रसंग है, कुछ लोग शिकायत करेंगे लेकिन जो रक्षक हैं वही उस सार्वजनिक प्रोपर्टी के भक्षक हो जाएंगे तो देश का क्या हो सकता है?

These three facets, I want to discuss with you. We all know that perhaps in the last 55 years such a serious standoff has not occurred and I am not talking merely of destruction of a bunker here or bunker there but this very serious eye ball to eye ball confrontation. This has been preceded with a humongous number of Chinese incursions and violations and I am startled to find this figure which is on the official website that in the last 45 days alone, 120 Chinese incursions i.e. almost at the rate of 3 a day and if you take the whole year of 2017 which is less than half over – these incursions have been 240, which is much more than one per day. Unfortunately, it appears this Government has been caught napping and has not been able to implement significant accords of recent vintage of recent origin – forget the old ones which the UPA Government did. We were able to contain and control the situation. I have to give more details but I will cite only two agreements for such.

The Line of Actual Control in the India-China Border Area Agreement – Title is this – of April 2005 – other is Border Defence Co-operation Agreement of 2013. This base existed and therefore, not only a violation of these has happened by the repeated transgressions but violation near the most sensitive part which is the area known as ‘Chicken Neck’. We say this with great responsibility and restrain but we would be abdicating our responsibility if we did not say. We have not had only these transgressions, we have not only had destruction of bunkers, and had but after a long-long time, a complete stoppage of the ‘Mansarovar Yatra’ from one entry point.

The Chinese have posted photographs of destruction. You have perhaps forgotten June 4, 2017 – a few weeks ago – two Chinese Army choppers violated Indian Air space in Chamoli District in Uttarakhand. On an earlier occasion which we shared with you, Chinese helicopters came more than 4-1/2 Kms. into Indian territory, again in Uttarakhand.

We are highly alarmed and concerned because the responses of the Government in one or two cases have been actually very-very pitiable – I quote the Minister of State for Defence, in written reply to Parliament said “No Chinese incursions, only transgressions’. Perhaps the Ministry of Defence should have supplied us a dictionary – the dictionary which tries to point out the different without a distinction or distinction without a difference when we say ‘No Chinese incursions only Transgressions’. Even a Lawyer will blush with such a distinction.

Then Shri Rajnath Singh, the Hon’ble Home Minister said ‘Chinese intrusions are only perception’. It is alright, we can get away with these statements but when you have such a serious standoff or face-off, the responses by Indian very senior Minister assume very great significance.

I am not going to remind you in details but all this happens in the backdrop of Chinese Daredevilry, Chinese unconcern and Chinese complete lack of sympathy what to talk of empathy for issues like Masood Azhar, persistent objection and obstruction, for issues like NSG, persistent repetitive obstruction, issues like UNSC Membership. This is much worse because I am sorry to say that our longest term ally Russia extended support to China on the Corridor issue.

Few days after, we were treated to all kinds of optics and photo opportunities and then comes India’s isolation. When we object and take a stand, we should not seem to be isolated. But we regretfully inform and remind you about India in isolation on the so-called CPEC Economic Corridor issue – 54 Billion US $ under our nose and we appear to have become an isolated object or who is standing on the silence watching helplessly.

I started and am ending by reminding you and telling this is said with responsibility and restrain but it is to be reminded to this country that nothing is more precious than our country’s National security and National integrity, territorial integrity. I am asking myself whether this Government’s three years can be described in terms of either a reluctant ‘Raksha Mantri’ or a ‘Part-time Raksha Mantri’. India deserves better. It is not the question of Mr.. A or B, I am not alleging personalities with some serious issues, it is just not possible for ‘Part-time Ministers’ to deal with such issues and unfortunately the Nation has lurched from a reluctant ‘Raksha Mantri’ to ‘Part Time Raksha Mantri’ and vice-versa.

I must inform you also with great regret and deep regret about the Mountain Strike Corps. The Government of India, under the Congress Party, devoted a scheme of Rs. 64,678 Crores with 90,274 additional soldiers for what was to be known as ‘Mountain Strike Corps’. ‘Mountain Strike Corps’ – basically 90% would be manning the ‘Indo-Chinese Border’. We have asked through you earlier and I ask again, why it is kept in deep freeze, where is the scheme gone. What has the BJP done – Rs. 64,000 Crore and 90,000 additional troops precisely in the area where we are having these very-very serious problems?

On the statement of Owaisi, Dr. Singhvi said let me make it clear – I have no hesitation in saying so. This is yet again the BJP ‘B’ Team, their name may be ‘Owaisi Brothers’. The party may be different but nothing; it is BJP’s ‘B’ Team. This is that Team which the BJP time and again in the past and now again has used to promote and to implement an agenda of polarization, of hate and envy, of mutual enmity and destruction, using or misusing the ilk of people like Owaisis. This is the ‘Dirty Tricks Department’ of the BJP which spreads this to create polarization for cheap politics and cheap votes. The object of this is only one – to create Hindu Vs Muslim, Caste Vs Caste, Region Vs Region, Indian Vs Indian and if affects Everybody Vs Everybody. I am shocked and aghast that the party which is in power stands exposed and every time they do so, we will expose them again.

 2006 में दतिया में जबरदस्त दुर्घटना हुई थी, उसके लिए H.K Pandey न्यायिक समिति बनाई गई, आज 11 साल हो गए हैं, कोई रिपोर्ट H.K Pandey समिति की नहीं आई है। 2012 में AK-47 फाईरिंग हुई थी रायसेन के पास,माननीय सुषमा स्वराज की Constituency के पास, एक न्यायिक कमीशन बनाया गया, आज कर कोई रिपोर्ट नहीं देखी किसी ने। स्थगित करना झुठलाना बस। झबुआ में 90 लोगों की मृत्यु हुई, न्यायिक समिति बनी, लेकिन आज तक कोई रिपोर्ट नहीं बनी। तो हम ये पूछना चाहते हैं मोदी जी से कि इनकी सरकार ने कृषकों के विरुद्ध क्या कोई जंग छेड़ रखी है? मैं आपको कुछ आंकडें दूंगा।

 2014, 2015, में 12 हजार 360 कृषकों की मृत्यु, 12 हजार 602 और 2016 का आंकड़ा है- 14 हजार। ये ट्राँसलेट होता है 35 प्रतिदिन। ये सिर्फ 2-3 साल हैं इस सरकार के, जिनका मैं आपको बड़ा स्पष्ट विवरण दे रहा हूं।

 पृष्ठ 44 में entry पढ़ने का मैंने जिक्र किया लेकिन हालत ये है कि 50 प्रतिशत से ऊपर प्रोफिट पर आपने स्पष्ट कह दिया उच्चत्तम न्यायालय को कि हम नहीं कर पाएंगे। जो Procurement Price दी है आपने गेहूं और चावल की,जो 50 प्रतिशत से बहुत कम है, उसमें भी आप कम मात्रा प्रिक्योर कर रहे हैं यानि जितनी उपलब्ध है, जितनी करनी चाहिए हर वर्ष, आपके शासन काल में Procurement की मात्रा गिर रही है। उसके भी आंकडें हैं- गेहूं 288 मैट्रिक टन से 229 मैट्रिक टन, यानि 60 मैट्रिक टन कम हुआ है Procurement. प्राईस अलग बात है, Procurementकी, मात्रा भी कम हुई है। चावल में 342 से 304 हुआ है। 37 लाख मैट्रिक टन कम। जितनी भी स्कीम है, वो अलग बात है हमने शुरु की थी- नेशनल फूड सिक्योरिटी मिशन, राष्ट्रीय कृषि विकास योजना, National Horticulture Mission, Rainfed Area Development Programme, और इनकी पूरी सूची है हमारे पास। ये सब स्कीम करीब-करीब हमने शुरु की लेकिन 2014, 2015, 2016 और 2017 में हर वर्ष इनके ऊपर जो एक्च्वुअल खर्चा है वो कम हो रहा है। एक तो दूसरा आयाम ये है कि आप बजट में कटौती कर रहे हैं। जो बजट दे रहे हैं उसमें भी खर्चा कम हो रहा है। सब आंकड़े हैं।

नेशनल फूड सिक्योरिटी मिशन का उदाहरण लें तो लगभग आधा हो गया है, 1799 करोड़ से लेकर 998 करोड़ हो गया है, ये दयनीय स्थिति है इस सरकार की। जिस प्रदेश ने मांग की है, अकाल के आधार पर वहाँ या तो जीरो दिया गया है, या 7-8 गुना कम दिया गया है, मांग से। तमिलनाडु में 40 हजार करोड़ की मांग की गई, उनको मिला जीरो। आँध्रप्रदेश में 2 हजार 281, मिला क्या जीरो। कर्नाटक में लगभग 1/6 हिस्सा मिला, 8000 की तुलना में 1784 के लगभग।

 ये कैसा साथ है, क्या ये किसान का साथ है? ये कैसा विश्वास है, क्या किसान को आप पर विश्वास है? ये कैसा विकास हो रहा है, क्या किसानों की बढती हत्याएं, उस विकास की परिभाषा की बात कर रहे हैं आप? तो ना साथ है, ना विश्वास है ना हो रहा विकास है। किसान का दर्द पुराने शीर्षक में दिखता है- ‘किसान का दर्द है- आमदनी अठ्ठन्नी,खर्चा रुपया‘।

बात है किसान के उत्थान की और पिछले 24 घंटों में प्रधानमंत्री जी ने एक ट्वीट किया है, सिर्फ उत्तान मंडूकासन के बारे में, चुप्पी साध रखी है, किसानों की बदहाली पर, आत्महत्याओं पर, हत्याओं पर।

एक प्रश्न पर कि किसानों पर हुई फायरिंग को लेकर भाजपा का बयान आया है कि ये सब कांग्रेस ने करवाया है और दूसरी तरफ भाजपा प्रवक्ता ने दिल्ली में कहा है कि कांग्रेस के हाथ में कोई दम नहीं है, श्री सिंघवी ने कहा कि जहाँ तक कांग्रेस के करवाने का सवाल है, ये अगर इतना दर्दनाक वाक्या नहीं होता तो बड़ी मजाक करने वाली बात होती। ये बात उनके खुद के गृहमंत्री साहब ने मानी है कि ये फायरिंग पुलिस ने करवाई है। जहाँ तक हमें मालूम है मध्यप्रदेश का शासन कांग्रेस नहीं चलाता। तो इस प्रकार के मजाकिया वक्तव्य आते हैं, गोलियों के ऊपर, फायरिंग के ऊपर, मृत्यु के ऊपर, ये उनका अपमान करते हैं। ये अंसवेदनशीलता दर्शाते हैं सरकार की। दूसरा आपने पूछा तो हम कहेंगे कि इतना ज्यादा अहंकार 3 साल में कहाँ से आ गया कि हाथ में कोई दम नहीं है? जब उसी हाथ से आपको राजनीतिक चपत लगी थी 10 वर्ष तक केन्द्र सरकार में, आपको तो 3 वर्ष ही हुए हैं। 30 प्रादेशिक चुनावों में उसी दौरान, तब आप हारे और हम जीते थे। तो हम समझते हैं कि अहंकार की भी एक सीमा होनी चाहिए और एक संतुलन होना चाहिए।

 एक प्रश्न पर कि प्रधानमंत्री जी ने कैबिनेट बैठक के बाद एक बैठक बुलाई थी, इस पर, श्री सिंघवी ने कहा कि कहाँ अंदर बैठते हैं, कब बैठते हैं, क्या बैठक लेते हैं, उस पर हम क्या टिप्पणी करें। हम तो जमीनी सच, नीतिगत सच या परिवर्तन सच पर टिप्पणी कर सकते हैं। क्या कोई कोई परिवर्तन जमीन पर देखा, हमने कुछ नहीं देखा, ना तमिलनाडु में, ना महाराष्ट्र में और ना मंदसौर में। जहाँ तक कोई नीति, ऐसी घोषणा सुनी आपने, वो ये हैं कि यहाँ फायरिंग ही नहीं हुई, फायरिंग कांग्रेस ने करवाई, राहुल गाँधी जी आंदोलन में भाग लेने जा रहे थे, तो मैं किस पर टिप्पणी करुं। आपका प्रश्न है वो पूछा जाना चाहिए संवेदनशील ऐसी सरकारों से जिनका एक तालमेल है अपनी जनता-जनार्दन से प्रश्नों के साथ, एक संवेदनशील संबंध है। यहाँ इस प्रकार के अपमान से भरे बयान मैं सुन रहा हूं सरकार से कि इस्तीफा तो दूर एक राहत मिल जाए, कोई हल मिल जाए तो बहुत बड़ी बात है। जो आत्म मुग्धता से मदमस्त सरकार होती है सत्ता अहंकार से, जो बहाने बनाती है, जो हर चीज में सस्ती राजनीति देखती है, फोटो ऑपौर्चुनीटि की बात करती है, इंटरनेट बंद करती है, लोगों को जाने से मना करती है, अगर पत्ता हिलता है तो कहती है कांग्रेस ने हवा चलाई है। इस्तीफा वहाँ दिया होता है जहाँ कुछ शर्म होती है, आत्मसम्मान होता है, लेकिन यहाँ ऐसी कोई चीज नहीं है।

What was sad and sorry was not merely the terrible deaths and opening of fire in Mandsaur. As you know 6 farmers lost their lives, 8 others have been injured but what was particularly insulting and sad was the complete denial, ostrich in the sand like denial and if it was not tragic it would be amusing, the denial was that there was no firing at all. For a long time we got a denial, there is no firing at all as if there was firing from the sky or automatic firing from the ground but ultimately even the Home Minister of Madhya Pradesh accepts that the authorities – the Police – did fire on the farmers although I repeat, sadly and insultingly there was denial first.

Shri Rahul Gandhi wanted to go and express solidarity with the bereaved but was denied permission and instead a canard and rumours were spread. Former Member of Parliament Ms. Meenakshi Natarajan was arrested. All this is not just limited to Mandsaur.

One of the largest agricultural State, Maharashtra has been virtually on strike for over five days rather touching a week. Have you ever heard of internet being stopped outside Kashmir violence? I want to ask you how many times internet has been disconnected. I have never heard of internet disconnected for farmers’ protest. That is what this Government is doing.

The Government is not looking at their demands, it is turning a deaf ear, it is not giving a healing touch. On top of that, it is throttling their voice. It is preventing communication. Take any criterion – adequate ‘Fair Price for their crops’, ‘Doubling their farm income’,’ Fasal Bima Yojana’ – none of them have come true. And you have to see it in the context that demonetization – most and foremost – hit the farmers. It hit everybody but it hit the farmers the most. It reduced their incomes by 50% minimum – some people estimate it to be at 70%. They were forced to destroy the produce in their fields and throw them on road. This you are still seeing in parts of Maharashtra.

Maharashtra incidentally tops the list of farmers’ suicides. In 2015, the astonishing number of 4291 suicides in Maharahstra – roughly 12 per day, Madhya Pradesh – yesterday’s place of incident – had 1290 farmers’ suicides annually – roughly 4 per day. Of course, the All India average is extremely sorry figure – 35 farmers’ suicides per day.

To add insult to injury, to insult the intelligence of farmers and to insult the public of India, the Central Government, today releases two page advertisements in all the Newspapers and it is really like turning the knife in the wound, repeatedly. It claims these are benefits we have brought in three years and similar ads are released in Madhya Pradesh Newspapers ironically just below the reporting of this terrible incident of Mandsaur firing. It is depictive of the most insensitive Government approach.

We want to ask the Prime Minister many questions but I will limit it to two or three.

First – why has the Prime Minister, yet 24 hours or 36 hours after the tragedy – not said a word about the terrible tragedy in Mandsaur.

Second – this lot of ‘Hoopla’ and ‘Hullah-Gullah’ about starting ‘Kisan DD Channel’. Mr. Prime Minister – did the ‘Kisan DD Channel’ or ‘DD Kisan Channel’ show this Mandsaur incident?

Third – Mr. Prime Minister in case you have forgotten – there is small little booklet which you proudly called ‘BJP Manifesto’, at ‘Page 44 of your own BJP Manifesto’ – in case you have forgotten – where you have made a solemn promise that we give MSP + 50% profit. It is written in black and white in your Manifesto.

On MSP your same Government, shortly after winning the election on this Manifesto, made a statement on Affidavit in the Hon’ble Supreme Court that it is not possible to give this price.

Mr. Prime Minister, Mr. BJP you have forgotten the word ‘Agriculture’ in your craze for anti-Congress culture. That is the only culture you remember. The ‘NAMO Policy’ apparently stands for ‘NAMO’ – No Agriculture-Mal-Governance only’.

This agitation is not limited to Mandsaur – it has spread from Mandsaur to Dewas because you cannot fodder a spontaneous agitation but more than that you cannot throttle pain which is genuine – from Mandsaur to Dewas, from Dewas to Ratlam, Dhar, Neemuch – many Districts.

Dr. Singhvi further said that this cold-blooded murder, attempt and murder of farmers yesterday come from the same State which has become famous for VYAPAM which affected 77 lakh lives and took over 50 deaths in that scam.

Dr. Singhvi said the farmers have not been killed only by bullets but they have been killed and they have been lynched and they have been shamed by pages upon pages of lies published in Government advertisements. This is one of the most pitiable situations and I conclude on three points –

Ground reality of facts and figures which we have given you in Booklet which has been circulated and otherwise also you have, on any of the four or five parameters is distressing.
Physical mal-treatment of which you have seen the worst example yesterday in Mandsaur.
Complete abdication of promises including written promises in written Manifesto.
Continuing eloquent silence, imperious, arrogant, eloquent silence of the Hon’ble Prime Minister.

On the question that BJP is saying that the Congress Party is only looking for Photo-Opportunity, Dr. Singhvi said I think this kind of cheap insensitive political statement ought not to be dignified by a reply. We do not give these kind of cheap political statements like BJP in the context of such deaths of poor farmers struggling or which they are thinking of, did it make for a very nice photo opportunity to see these deaths and firing. Attend to your own photo opportunity within your own State first.

He further said that he has no doubt that the thick-skinned political management and dispensation we have in BJP-ruled States completely insensitive, completely thick-skinned, and completely uncaring- these kinds of demands are worse than water off a duck’s back.

The resignations you are talking happen when there is self-respect. When there is a feeling of empathy, even merely some sympathy – none of these adjectives apply to the BJP-ruled State Governments insensitive administration.
