One is perennial, habitual, repetitive ingrained tendency of this Government to act as Big, Big, Big, super big brother and to watch you, to intrude into every aspect of your life, body, every aspect of your privacy. As you know we not only have a comprehensive 9 Judges Bench on Privacy. We have Article 21 – a bull work, we have Article 19 of our Constitution on Human Rights including Privacy. We have IT Act, we have many other laws. You cannot peek into my life except in exceptional cases with specific authorization not below the rank of ACP level officer. We find that a very curious center a tender given to a private agency for which bids are invited at Rs. 42 Crores. This is a worst example of using the taxpayers’ money to snoop on the taxpayers. The tender is for so-called Social Media Communication Hub creation. The portions I have read from the tender make it clear that it is officially stated to try, to get software, to try and create platform which will be deployed in  the private data center to not only listen to the standard digital channels which are listed but to consolidate them and convert them. The Standard digital channels listed are all FaceBook, Twitter, You Tube, Google, Instagram etc. I am not naming them all.

This is very strange because in the entire tender of 66 pages which each of you will get on your e-mails also, there is not a single safeguard I have been able to find. Now for example – a simple question – it does not tell you how that you get encrypted data because data has to come in some form – how will it deem be not encrypted or unencrypted. There is a line; there about Meta Data should also be supplied. There is seeking all additional Meta Data but it does not tell you how Meta Data cannot be unencrypted. There is not a single safeguard against such strong and tall rules and law which we have in favour of Privacy. The reason why this is even more serious, there could normally be because the proven track record of this Government of snooping shamelessly, of attempting to shamelessly enter everybody every aspect of your life which include established laws and rules. I have from this podium itself given you many examples earlier. One obvious example is Namo App. Namo App is issued but in the name of App, 22 pieces of information are sought with all kinds with audio, video, contacts of your friends, family, location etc. etc. Nobody till now has explained and we have asked from this podium why a Namo App has to ask so many questions.

Secondly, when 13 lakh NCC cadets were to be addressed by the PM not even physically, every possible data was asked including personal mobile phone, e-mail ids etc. by the PMO. What is this mad obsession with collecting data? When a Chandigarh journalist of your Biradri demonstrated how one Crore Aadhar details could be collected in less than ten minutes for Rs. 100 Rs. 500, instead of plugging leaks, instead of plugging the holes, they filed an FIR against her. You have seen that one of the arguments offered by no less than Attorney General of the Supreme Court that the data is secured in Aadhar because it is behind is a 13 high and 5 foot thick walls. There are many cases of breach and I have not naming them but we know very well how foreign agencies have actively campaigned for BJP, Analytica is an example, campaigned for the BJP in 2014 Lok Sabha elections and in several States in Jharkhand, Bihar, Maharashtra, Delhi and Haryana.

In the light of all this, Dr. Singhvi said that this Government has Sri Krishna Report. It is expected anytime in the near future. The basis of that report should be the Prevention of Data Collection Act. For this report what is the need and urgency to have very strange kind of Social Media Communication Hub unless you integrate Data Protection Laws. It is not very surreptitious over clever method of intruding in a different form.

Therefore, my questions are –

(1)  Why doesn’t Social Media Communication Hub tender does not clarify that the data which the said tool is accessing is at all or per say be encrypted?

(2) PM Modi and his Minister of information & Broadcasting should let us know where are the safeguards in building such a tool?

(3)  Why was there no consultation with the stakeholders in the IT and Data Industry before launching such a ‘Social Media Communication Hub’ or publishing such a tender?

(4)  Page No. 30 of the Tender states “Conversation Archive” – why is maintaining this Conversation Archive necessary?

(5)  Why is the BJP Government spending Rs. 42 Crore of our own taxpayers’ money to snoop us which is merely to convert consolidate and manage social media conversation and the whole object is listening and responding capability. The platform is expected to not only listen to the channels listed below but also enable in the extension to integrate proprietary data sources like Mobile insight Platform. This is very serious because what is the level of these things is still a mystery. Such a big move is taken and no safeguards are apparent. You will give an oral safeguard but that is not   enough. What you say or Minister says is not enough. It has to be inbuilt into the process.

We have this great generous recent magnanimous Government giving us one paise a few days ago. Today they have done 5 times better and 6 times better. I congratulate them. There is not 5 paise or 6 paise reduction in petrol and diesel. We are really overwhelmed. We do not know whether to die of happiness or to bend down and prostrate ourselves before this Government. But why are they giving this great bonanza and jackpot with the right left hand. We have LPG – 20 crore customers take LPG cylinders per month in this country in a family of five – Imagine it virtually covers the whole system. Now the subsidized gas cylinder price has been raised yet again by Rs. 2.34 per cylinder – non subsidized has been increased by Rs. 48 per cylinder. In the last three years of this Government, Rs. 81 increase has been in subsidized gas cylinders from Rs. 412 per cylinder in 2014 to Rs. 493 per cylinder today i.e. Rs. 81 increase. In contrast, the UPA Government gave a subsidy of Rs. 449 per cylinder.

During their tenure it is 30% international crude cylinder prices of gas prices are lower. This is the duplicity, the hypocrisy, the utter thick-skinnedness and insensitivity of this ‘Sarkar’ to the necessities of the Aam Aadmi. This is their definition of ‘Achhe Din’.

On the question of privacy, Dr. Singhvi said let me tell you that we reserve all including all our legal rights after all privacy is a constitutional right, privacy is now a Supreme Court asserted comprehensively asserted rights and all those are available. But the first and foremost obligation in a democracy is to bring it to the news in the public domain by you and me but not Journalists but public at large and we are doing that first. And we are asking questions and which reserve answers and we want to know that when you design at least you share a basic object and straightaway point out the palpable once you can touch and feel the safeguard not just a lecture, just a clarification by some Minister that normally everything will be alright. If you point a safeguard, we are here to support you in public interest there is no problem. But you suddenly take out a tender, I do not find a single such thing as Meta Data will also be given. No safeguard is being given, so to answer question first and foremost must know, the country must know about this. You can ask from them. Of course, these are legal rights.

To another question on farmers’ agitation and whether the Government is on back foot, Dr. Singhvi said I do not know the Government is on the back foot. They are thick skinned. They should view the fact but when you are so thick skinned and insensitive, you have ignored farmers’ interest for four years.  Three fact standout – 1.9 to 2% agricultural products, fraud and laughable statement of doubling farm income by 2022, the prices of food products as far as our table is concerned is rising, as far as poor farmers’ MSP, no MSP increase. In the fourth year you say there is a dramatic change – one crop less – we will increase MSP. For four years, you forget manifesto at page 44. Now today it is reached a crescendo. Shri Rahul Gandhi is only expressing sympathy and empathy but the pain, the frustration is coming from poor farmers. They are throwing their produce on the road. Your channels are showing I have nothing to do with it. Now which farmer will throw his produce? It is more costly to produce than to throw it. Today there is a ‘Bandh’ proposal for 6^th of June. A Bandh is rare. I think very clear and loud message is sent but not to insensitive souls for those who deliver little. We will not bring it to the Mandis. If you want you can come and buy from lour local areas and we are prepared to destroy it better not to sell it. In the foreseeable past, this kind of ‘aakrosh’ is there. Do you think it is political ‘aakrosh’. Do you think, it is artificially created ‘aakrosh’? This is the truth. If you want to live in an ivory tower, all I can ….

On the agitation of farmers in Madhya Pradesh, Dr. Singhvi said there is no one size fits all approaches at all. There is no blanket approach at all. The basic object remains the same whether this is that part or that part of the country. The basic object is that whether you call if farmers’ alliance or you call it strategic seat adjustment, or seat understanding, the object will be everywhere whether by poll or triangular or quadrangular to prevent vote division of the anti-BJP votes. This is what the BJP is terrified about it. This is what you will see every election from UP to Karnataka to any other State shows how the BJP benefits from vote division but how we will do, what we will do in state X, may different from  state Y but you can rest assured that it will be achieving that one single object of prevention of vote division.

On another question raised by the Samajwadi Party whether the opposition parties should field one common candidate for the Prime Minister in 2019 against Shri Modi, Dr. Singhvi said early days as yet but I do not see any reason to doubt the principle and the spirit to what he has said. I do not want to go in to details. Rather it is early but you must read the spirit – what you think and  I think it is the spirit. I am not talking about the names. I am talking spirit behind it.

ये जो following digital challenge restrict below हैं, उसमें लिस्टिड है, Facebook, You Tube, Twitter, Instagram, Google +, LinkedIn, Flickr, Tumblr, Pinterest, Playstore, E-mail, News, Blogs, Forums, Complaint Websites, अब मैं तकनीकी चीजों में नहीं जाना चाहता, लेकिन मूल बात क्या है – एक टेंडर बनाया गया 42 करोड़ का, कि हमको सॉफ्टवेयर दीजिए; कि हम सभी सोशल मीडिया प्लेटफॉर्म पर listen कर पाएं, consolidate कर पाएं,analyse कर पाएं, सुन पाएं और वो कौन से सोशल मीडिया प्लेटफॉर्म हैं, जिनके 12-15 नाम मैंने अभी पढ़े हैं।

अब प्रश्न ये उठता है कि नंबर एक, इसमें कोई प्रावधान सावधानी बरतने का, सेफ गार्ड कौन सा है? अगर आपका उद्देश्य सुनना, consolidate करना है, तो आपने कौन सा प्रावधान रखा है, जिससे encrypted चीज decrypted हो जाए? अगर decrypted हो जाती है तो निजता कहाँ बची? ये प्राईवेट कॉन्ट्रेक्टर को कहा गया है कि ये आप करिए, ये टेंडर बनाते वक्त क्या आपने ध्यान दिया कि इतना व्यापक 9 जजों का निजता वाला निर्णय जो अभी आया है, कुछ ही महीनों पहले। आप जानते हैं कि इन मामलों में हमारी निजता कानूनी तौर पर, सैद्धांतिक तौर पर बरकार है। क्या आपने ध्यान दिया अनुच्छेद 21 का – संविधान का, जो जबसे संविधान बना, तबसे हैं? क्या आपने ध्यान दिया अनुच्छेद 19 का, आपको सब मानवाधिकार दिए हुए हैं उसमें? क्या आपने ध्यान दिया आईटी एक्ट का, उसके प्रावधना सेक्शन 3, सेक्शन 6, सेक्शन 9, कोई आदमी आपके डेटा पर हस्तक्षेप नहीं कर सकता। अब इस टेंडर जिसके पूरे 66 पृष्ठ मैंने देखे हैं और आपको जो दिए जाएंगे, उन्होंने पेज 40 पर लिखा है, मेटा डेटा भी मिलना चाहिए। तो मेटा डेटा भी मिलना चाहिए, वो एडिशनल चीज हुई, पर ये कहीं नहीं है कि जो मेटा डेटा मिलेगा आपको वो decrypt नहीं हो पाएगा। जब आप इतना समेटेंगे, इतना सामूहिक रुप से बटोरेंगे, तो ये decrypt होगा तो हमारी निजता कहाँ रही और इसमें तो सभी सोशल मीडिया लिस्टिड है, Facebook, You Tube, Twitter, Instagram, मैंने 12 प्लेटफार्म पढ़ दिए आपके लिए। 

ये अत्यंत गंभीर चिंताजनक विषय है और ये इसलिए चिंताजनक ज्यादा है कि पिछले 4 वर्षों में हमने बार-बार इस सरकार, इस सत्तारुढ़ पार्टी की एक निरंतर नीति देखी है कि किसी रुप से आपके घर के अंदर घुस जाएं, आपके मन के अंदर घुस जाएं, आपके बदन के अंदर घुस जाएं, आपके सभी औजारों और यंत्रों, तंत्रों के अंदर घुस जाएं। इसके उदाहरण पहले भी हमने इसी मंच से दिए, मैं आपको सिर्फ याद दिला रहा हूं, संक्षेप में – आपको याद है एक नमो एप की शुरुआत की थी, मैंने ही प्रेस वार्ता की थी इस पर। नमो एप क्या था वो, कि नमो एप के नाम पर आप मुझे 22 बिंदुओं पर, 22 कसौटियों पर, 22 मापदंड पर मुझे अपने सूचना और तथ्य दीजिए। अब नमो एप के लिए आवश्यक नहीं कि 22 बिंदुओं पर आपको तथ्य देने की आवश्यकता हो। उसमें लिखा है, contact, video, friends, family location, उसी वक्त आपको याद है हमने बताया था आपको कि 13 लाख NCC कैडेट जो कि सिर्फ एक interaction था प्रधानमंत्री जी से, उसके लिए पीएम के ऑफिस ने उनका सबकुछ मांग लिया। आईडी क्या है, एड्रैस क्या है, ये जो अजीबो-गरीब जो अप्रोच है, आपको पता है कि पंजाब और उत्तर में एक चण्डीगढ़ के जर्नलिस्ट के विरुद्ध एफ.आई.आर. फाईल कर दी गई, क्योंकि उसने ये साबित कर दिया कि एक करोड़ आधार के डिटेल 10-15 रुपए में निकाल कर अगर 500 रुपए दे दो, वो तो सिर्फ एक स्टिंग करके प्रमाणित कर रहा था, असलियत में वो घूस नहीं खा रहा था। 500 रुपया, 100 रुपया लेकर, एक करोड़ डिटेल निकाल रहे हैं। उसके पीछे पूरी व्यापक जांच करना तो दूर, उसके खिलाफ एक एफ.आई.आर. दायर कर दी। आपको एक उदाहरण दिया था कि 4 मई, 2017 को, करीब एक साल पहले माननीय अटॉर्नी जनरल ने खुद ये स्वीकार किया कि आधार डेटा में भी breach हो सकता है और उन्होंने कहा कि जब breach नहीं होता सिर्फ इसलिए कि 13 फुट ऊँची और 5 फुट मोदी दिवार है, तो किसी ने मजाक किया कि दिवारों से अगर ये breach रुक जाते तो, आपत्ति क्या थी? हमारे पास और बहुत उदाहरण हैं, मैं आपको अभी नहीं दे रहा हूं। कैम्ब्रिज एनालिटिका का भी इदाहरण है जिसने हमारे अनुसार बीजेपी के लिए 2014 में लोकसभा में और झारखंड, बिहार, महाराष्ट्र, दिल्ली और हरियाणा में पूरी तरह से कैंपेन किया था। 2018 में फरवरी 23 को यानि इसी वर्ष पंजाब नेशनल बैंक डेबिट – क्रेडिट कार्ड डिटेल 10,000 कस्टमर के लीक हुए थे, इत्यादि-इत्यादि।

इस संदर्भ में हमारे सीधे कुछ प्रश्न है, माननीय सरकार से, प्रधानमंत्री जी से, सत्तारुढ़ बीजेपी से।

पहला, क्यों ये Social Media Communication Hub के नाम से टेंडर निकाला है?  क्यों इसमें एक सरल वाक्य नहीं है, कि कुछ भी हो ये हो या वो हो, किसी रुप से encrypted डेटा के अलावा कुछ नहीं होगा। यानि डेटा encrypted नहीं हो सकता। डेटा encrypted रहेगा, uncrypted नहीं रहेगा। डेटा decryptनहीं हो सकता। जैसा encrypted है, वैसा ही रहेगा।

दूसरा, क्या स्पष्ट सेफ गार्ड समिति ने, कमीटी ने जिसने भी ये टेंडर बनाया है, क्या लिखें, क्या देखें, क्या प्रस्तावित किए, क्या लिखे, जरा ये बताएं देश को, ये मैं सीधा प्रश्न पूछ रहा हूं?

तीसरा, क्या इस विषय में टेंडर फाईनलाईज करने से पहले कोई भी विचार, विमर्श आम आवाम से, स्टेक होल्डर से, जनता जनार्दन से किसी रुप से किया गया?टेंडर किसी बाहरी सरकारी अफ्सर ने बना दिया। आपने किसी रुप से आदान-प्रदान मतों का, सिविल सोसाईटी के साथ किया की नहीं?

चौथा, पृष्ठ 30 में उस टेंडर की लिखाई, शब्द, conversation जो भी हमको Archive किया जाए, तो ये Archive मैंटेंन करने के क्या उद्देश्य हैं, ये जरुरत क्यों हैं, ये आवश्यक क्यों हैं, देश को बताएं?

पाँचवा, इस चीज के लिए 42 करोड़ रुपए का कॉन्ट्रेक्ट दिया जा रहा है, जिस कॉन्ट्रेक्ट से टैक्स पेयर जनता जनार्दन के पैसे के द्वारा, जनता जनार्दन की निजता पर प्रहार होने वाला है। आज अगर आपको करना भी है तो आप ही ने सुप्रीम कोर्ट के आदेश के अनुसार एक समिति बनाई है, श्रीकृष्णा समिति, कम से कम अभी चल रही है, निकट भविष्य में आशा-विश्वास है कि निकट भविष्य में उसकी रिपोर्ट आएगी और उसके आधार पर आपको डेटा प्रोटेक्शन एक्ट बनाना है। जब आप इतना रुक गए हैं तो कुछ और वक्त नहीं रुक सकते थे आप? क्यों जल्दी थी, इस एक्ट, इस समिति की रिपोर्ट के लिए आप क्यों नहीं रुक पाए?

ये इसलिए है क्योंकि बार-बार आपका उद्देश्य ये है कि निजता पर परोक्ष रुप से, चालाक रुप से किस प्रकार प्रहार किया जाए और इसलिए देश जवाबदेही मांगता है।

एक और मुद्दे पर मैं बात करना चाहता हूं कि आज आपने बार-बार देखा है कि पेट्रोल और डीजल की कीमतें कहाँ पहुंच गई है, वो अलग कहानी है कि इतनी ऊँचाईयाँ छूने के बाद, आकाश छूने के बाद आपको एक पैसे की छूट दी गई और आज 5, 6 पैसे की रियायत फिर से दी गई। हम बहुत शुक्रगुजार हैं, हम नतमस्तक हैं, हम पैरों पर गिर पड़े हैं आभार प्रकट करने के लिए कि कम से कम 6 पैसे की छूट दी गई। हमारे दादा जी बताया करते थे कि उस 6 पैसे में कितना मिलता था उस समय में। आज हम आपको निमंत्रण देते हैं कि 6 पैसे में जाकर जमाना लूट लीजिए, लेकिन जो LPG की बात है, ये जो 6 पैसे की रियायत दी गई है आपको, उसके साथ-साथ जो LPG की कीमत ने ऊँचाईयाँ छू ली है, वो आपको नहीं बताया जा रहा है कि राईट हैंड से मैं आपको एक बूंद दूंगा और लेफ्ट हैंड से मैं आपका पूरा सागर खींच लूंगा। वो सागर क्या है- आज 20 करोड़ लगभग प्रति माह कस्टमर गैस सिलेंडर खरीदते हैं। उसको वो सब्सिडाईज गैस सिलेंडर को ढाई रुपए या 2.34 पैसे से बढ़ाया गया है और नोन- सब्सिडाईज को 48 रुपए से। यानि 50 में 2 कम। उसकी कुल गिनती क्या है, लेकिन 2 रुपए 34 पैसा एक सब्सिडाईज गैस सिलेंडर और जो नॉन- सब्सिडाईज के लिए 48 रुपया। आज होटल और रेस्तरां में जहाँ सबसे ज्यादा प्रयोग होता है उसका। इस वृद्धि का परिणाम है कि 77 रुपए द्वारा रेस्तरां, होटल में गैस सिलेंडर की कीमत बढ़ गई है। अब माननीय मोदी सरकार के साढ़े 3 वर्ष का रिकोर्ड देंखें तो कुल मिलाकर साढ़े तीन वर्षों में 81 रुपए + पर सिलेंडर बढ़ा दिया है। मेरे पास आंकड़े हैं, 412 से 493 रुपए, लेकिन जो वृद्धि है वो 81 रुपए, 81.55, आज गैस की कीमतें, मैं सिर्फ तेल की बात नहीं कर रहा हूं, जो एसोसियेट गैस निकलती है तेल के साथ, उसकी कीमत 30 प्रतिशत गिरी हुई है अंतर्राष्ट्रीय स्तर पर, पेट्रोल-डीजल का भी यही हाल है, वहाँ तो भी गिरी हुई है। ये 30 प्रतिशत गिरी हुई है और हमारे समय में ये कीमतें ज्यादा थीं अंतर्राष्ट्रीय स्तर पर, इसलिए हम सब्सिडी देते थे 449 रुपए की, 449 पर सिलेंडर और इसका तुक मैं समझता नहीं हूं कि एक तरफ 5 पैसा, 6 पैसा, दूसरी तरफ ढाई रुपया और 48 रुपए की वृद्धि, तीसरी तरफ 3 वर्ष में 81 रुपए की वृद्धि गैस सिलेंडर पर, चौथी तरफ हमारी सब्सिडी 450 रुपए की गायब।

तो आप निर्णय कर लें अपने आप कि ये सरकार जो है कैसी है? एक पैसे की भाजपाई सरकार है, मुनाफाखोरी में व्यस्त है और आम आदमी त्रस्त है।

एक प्रश्न पर कि केन्द्रीय कृषि मंत्री का बयान आया है कि देश के किसान संतुष्ट हैं और जो विरोध कर रहे हैं, वो षडयंत्र कर रहे हैं, डॉ. सिंघवी ने कहा कि मैं समझता हूं कि जो सरकार पूरी तरह से सहानुभूति शब्द का अर्थ भूल गई है, जो सरकार क्रूरता से प्रहार एक के बाद एक कर रही है कृषकों पर, जिस सरकार के पास ना कान है, ना आँख है, कृषकों की हालत देखने की तो यही ही नहीं, आप समझते हैं कि मंदसौर से लेकर सभी बड़ी-बड़ी मंडियों पर पूरे अखिल भारतीय स्तर पर किसान बंद अगर किया गया है, अगर आप समझते हैं कि लोग अपना सारा उपजाऊ सामान जमीन पर फैंकने के लिए तैयार है, अगर लोग कह रहे हैं कि हमें एमएसपी नहीं दे रहे हैं आप, हमारी जो पैदा करने की कीमत है, वो ज्यादा है, नष्ट करने से, तो क्या वो कांग्रेस कर रही है, वो षडयंत्र कर रहे हैं आप और हम? ये तो तबसे से शुरु हुआ जब आपने अपने पृष्ठ 44 में एमएसपी की बात की और उसके डेढ़ महीने के बाद उच्चतम न्यायालय में जून, 2014 कहा कि हम नहीं करेंगे, नहीं कर सकते, ना करने वाले हैं। 4 वर्ष रुके हैं आप, एक फसल बची है जब, डेढ़ फसल बची है जब, तब आप कह रहे हैं कि हम सब करेंगे। और वो सबकुछ कहने के बाद हमने प्रकाशित किया है इस मंच में, जो एमएसपी दी है आपने, 2018 में, वो एमएसपी जो होनी चाहिए उससे 50 प्रतिशत है। क्योंकि आपने कीमत की परिभाषा दी, वो गलत है। तो इस प्रकार के षडयंत्र सरकार कर रही है, सरकार बहुत बड़ा षडयंत्र कर रही है, किसान के विरुद्ध, माननीय प्रधानमंत्री षडयंत्र कर रहे हैं ये कहकर कि हम आपकी इंकम 2022 तक डबल कर देंगे। किसी ने कहा कि इस रेट पर 1.9 या 2 प्रतिशत के प्रतिवर्ष के रेट पर 2052 में भी नहीं कर पाओगे आप।

एक अन्य प्रश्न पर कि उपचुनाव के बाद क्षेत्रिय दल कह रहे हैं कि चाहे बीजेपी हो या कांग्रेस उन्हें भी गठबंधन में सहयोगी माना जाए, डॉ. सिंघवी ने कहा कि one size fit all कहीं अप्रोच नहीं होती। एक जहाँ सब जगह फैलाने की कोई अप्रोच नहीं होती है। ये क्षेत्रिय रुप से सोच-समझ कर, स्ट्रैटिजिक रुप से अलांयस सीधा एम्बिशन होता है। आप आश्वस्त रहें, उद्देश्य एक ही रहेगा। उद्देश्य है कि बीजेपी विरुद्ध वोट का बंटवारा ना हो या न्यूनत हो। उसके लिए अलग-अलग प्रदेश में अलग-अलग नीति होगी और किस प्रदेश में किसके साथ अंडरस्टेंडिग होगी, उसके लिए आपको इंतजार करना होगा।

एक अन्य प्रश्न पर कि भाजपा की उपचुनाव में हार पर सुब्रहमण्यम स्वामी ने कहा है कि ये राम मंदिर ना बनने और ना ही कालाधन वापस आने की वजह से हुआ है, डॉ. सिंघवी ने कहा कि ये मत, विचार सबके अलग-अलग होते हैं, लेकिन जो आपने मुद्दा उठाया है, उसके ज्यादा व्यापक आयाम हैं, आप सुब्रहमण्यम स्वामी को छोड़ दीजिए, वो तो पता नहीं क्या-क्या बोलते हैं, बीजेपी में हैं या नहीं हैं, पता नहीं किसमें हैं। लेकिन जो बीजेपी के साथ हैं उनकी बात करिए, अभी आपने पिछले 3 दिनों में सुना की जेडीयू क्या कह रहा है, आपने सुना कि शिवसेना क्या कह रही है, आपने सुना कि पूर्व सांसद बीजेपी के क्या कह रहे हैं, मैं नाम नहीं लूंगा, आपने सुना कि आकाली दल कुछ दबी आवाज में क्या कह रही है, आपने देखा है कि टी.डी.पी ने क्या कर दिया और क्या कह रहे हैं? अब एनडीए आप बोलते हैं तो अजीब लगता है सुनने में, एनडीए मतलब बीजेपी और एनडीडीपी है क्या सिर्फ? 

एक अन्य प्रश्न पर कि कांग्रेस नेता डीके शिवकुमार और डीके सुरेश  के घर पर छापे मारे गए हैं, क्या ये प्रतिशोध की भावना से किया जा रहा है, डॉ. सिंघवी ने कहा कि इसमें हमें कोई आश्चर्य नहीं है। जैसे-जैसे विपक्ष की मजबूती बढ़ेगी, वैसे-वैसे बीजेपी के पैसे के नंगे नाच से राजनीति को प्रभावित करने का प्रयास दिखेगा। कांग्रेस इसका विरोध करेगी। जिस तरह से तोड़-फोड़ की राजनीति नहीं चलने दी गई कर्नाटक में, उससे भाजपा बिल्कुल बौखला गई है। उन्होंने यही प्रयास चुनाव के पहले भी किए थे, और अब चुनाव के बाद भी वहीं दोहराया जा रहा है। इस बार प्रय़त्न कर्नाटक के बाहर से हो रहे हैं, क्योंकि कर्नाटक में सरकार उनकी बनी नहीं। तो मैं नहीं समझता कि इसमें कोई आश्चर्य करने वाली बात नहीं है, इससे तो उनका चरित्र सामने आ रहा है और जिस प्रकार से आपने जो नाम लिए हैं, उन्होंने खड़े होकर, मजबूती से बीजेपी को दिखाया और बताया कि उनके जो साम-दाम-दंड-भेद के प्रयत्न थे, वो कितने विफल हुए हैं, वो अच्छा तमाचा है उनके चेहरे पर।

(1)  Why is our oratorical eloquent and treat a moment Prime Minister yet silent, still silent on this terrible disaster? Not a word – we all want to know and to use the word of those who tried to use the words nationalism on their sleeves, the nation wants to know.

(2)  Right in the middle of foreign tour, the Prime Minister has plenty of time to throw challenges and to throw counter-challenges. But Yes, the fitness challenges has priority enough in his mind to respond but un fortunately Hon’ble Prime Minister, Government of India ruling Party President you are all running on a treadmill but not getting anywhere. You may be all fit for cameras or fit for ‘Jumlas’ but are you fit for governance, the answer is clearly No. Because both the Government and governance has retired hurt. It is a strange Prime Minister who on one hand maintains silence from fuel challenge to Tuticorin challenge to women security challenge but throws a very proud counter-challenge of a fitness challenge. This is deplorable and this reflects the true mindset of this Government.

(3)  It is very important. In the UPA year 2013, we made a very significant change of rule that industries could bypass public consultations only if the industrial parks they were to being built inside had an environmental clearance. That was the amendment from the pre-existing law which the UPA made in 2013. If the industrial park had not been assessed for environmental safety and under the 2006 regulations, then the industries coming up inside it would necessarily have to consult the people.

This was reversed by the NDA Government in 2014 December. The reversal meant that if a plant is located in an industrial zone, it requires no environmental clearance merely by the fact that it is located in an industrial zone – whether that zone has an environmental clearance or not, does not matter. This was a significant change, why was it significant – because it required clearance then the clearance has to be preceded by public consultation. Why are public consultations important – public consultations do not make veto, do not mean a right to obstruct or refuse but if you are mandatorily required to have public consultation, then the Central Government and the State Governments cannot give you the permissions unless they meet the specific points raised in the public consultations but the entire requirement of public consultation is done away with it in December 2014 by the NDA Government. Once you require no Environmental Clearance, you require no public consultations merely because you say that this smelter is located in industrial zone.

You have seen what has happened? You have seen a comments that video, the firing. Simple question – not a suspension, only transfers? Suspensions are done far less; suspensions as you know in law do not even require a Show Cause. Suspensions are done pending enquiry. Nine people have lost their lives, plant is running without permission or doing activity without permission, there is central and state Governments issue and not single person is suspended.

(4)  You have appointed a judicial retired Judge enquiry but that has no time limit. Is your intent to ensure that it goes into the oblivion of public memory – no time limit? Of course, we are not at all satisfied with a mere enquiry. That is the different issue but if you have an enquiry, there should be some very strict narrow and short time limit. Of course, I do not make any directive for any person, but in a lighter vein, I had told you earlier, it has been defined as a group of unfit appointed by the unwilling, to do the unnecessary. I hope this enquiry does not become as yet one of another one of its kind.

(5)  Has anybody found out, checked up, fixed accountability on which officers was responsible to readily picked this project in Tamil Nadu when a few months before it shifted to Tamil Nadu, it was rejected and evicted from Maharashtra. The same project, the same central project – It started in Maharashtra and the Government ordered to be wound up when the same public protest happened within a few months and the same project was shifted to Tamil Nadu where it was welcome with open arms at least now ex-post facto somebody should fix accountability.

(6)   There was a condition imposed. That if you have in Tamil Nadu, even if you have in a industrial zone, it has to be not less than 25 Kms. away in the gulf of Mannar in which there are 21 islands, it must clear those islands by 25 Kms. It is now established by several reports including foreign report that 5 or 6 of those islands are well within 25 Kms. – not beyond. No enquiry on to fixing of responsibility.

(7)  Will the Hon’ble Chief Minister, who has lots of some time to confer with or seek advice from the PM and vice-a- versa, explain why he has not visited the site up to today.  Indeed parts of the comments on government machinery suggest that the firing was inevitable but there is no visit.

(8)  Will the Hon’ble Prime Minister tell the Nation that apart from giving so much of advice to the ruler of Tamil Nadu, apart from allowing coordinated disruption of Parliament from Tamil Nadu legislatures when it suits this Government? Does the Prime Minister that the CM of Tamil Nadu is ‘Fit’ – I emphasize the word ‘Fit’ to be dismissed? This is another kind of filing challenge which we throw for the Prime Minister. Is he of the view that the CM of Tamil Nadu is fit to be dismissed? Remember, the CM of Tamil Nadu is also the Home Minister of the State.

(9)  Has responsibility been fixed as to who gave this order and who controlled this file. There is a protocol for the things. There is scope for these things. There is SOP Standard Operating Procedure and if you are first four – because this is not a terrorist area, this is not a J&K attack, a SOP requires that first of all you don’t use gun at all,  you use to, and you are to start with something like pellets or something like rubber and then you have to do other things. This is a last resort. Who ordered this under whose supervision, whose authority, when or with or in what manner and you have seen in video. There are recorded views, at least one has to die. At least ultimately ten died or 11 died.

(10)   This is 100 day old protest – 3/1-2 months – and many days ago, this is very interesting – it was announced that on 22nd of May, this protest will take place. So this was no surprise element. The Police, the law and order agencies, the administration were all informed. It was going on for 100 days already and this was announced as a major protest day on 22^nd of May. Then, even after that you have to resort to such brutality. Ultimately, all the people of India want answers, if you can’t answer my 11 questions, at least answer some of them. If you can’t answer some of them, at least answer them fractionally but I am convinced that this ‘Jumla Sarkar’ can only answer and coin and quote ‘Jumlas’. They can’t deal with cold hard facts. They can’t answer which demand cold hard objective facts. The Tamil Nadu Sarkar has forfeited the political, moral and ethical right to rule. The least it should do is to apologize unqualifiedly to the people of this country, of their State so also the Central Government because this is clear and massive complicity. Instead of ensuring a life with dignity, they have ensured no life at all.

To another question, Dr. Singhvi said, that I have asked one level above question. Before I asked that question, in the interest of natural justice, we are asking one more question from the Prime Minister and that is – Hon’ble Prime Minister what is your opinion, do you think that Tamil Nadu Government is ‘Fit’ to be dismissed. We will wait for one or two days and then tell you about the second question.

 On the question that based on natural justice on EVM and come to ballot paper, Dr. Singhvi said these are all specific complaints about the specific areas. We have made this complaint in the past also. Our point is two-fold – one we are not making a blanket complaint against very EVM everywhere in the country. This is a common misconception which the BJP promotes. Secondly, we are saying that it is enough to skew the result of election by a few strategic distortions of strategically placed marked machines. Few is enough. Thirdly, and this is the important Parmeshwar has been making – in view of the recurring complaint of this nature whether  in Gujarat or in Karnataka or earlier in UP, we are now of the view without suggesting that there is a blanket problem with all EVMs. It may be better to have paper ballots. That is all we are saying.

किसी भी कारण सच्चा-झूठा, मिथ्या प्रचार करके कांग्रेस की निंदा करने का कारण है। लेकिन इससे ज्यादा आप गंभीर चीज देखिए, आपको इतनी ज्यादा लालच है कि हर वाक्य में कांग्रेस को आप भर्त्सना करें तो कम से कम साथ-साथ कर्नाटक के इतने गौरवशाली प्रदेश के बैंगलूरु के गौरवशाली नागरिकों को आप साथ-साथ अपमानित क्यों कर रहे हैं? आपने एक ही वाक्य में इस शहर को, उस प्रदेश को गारबेज तो कह दिया, क्राईम सिटी भी कह दिया, साथ-साथ valley of Sinभी कह दिया, यानि अनैतिकता से भरपूर immorality, Sin का मतलब immorality से भरपूर शहर। जबकि उस शहर की पहचान है, जन्म दिया है उसने पूरी हमारी आईटी इंडस्ट्री को। जो विश्व स्तर के आईटी के इंडस्ट्री है, वो वहाँ जन्मे हैं। वो एक टेक्निकल हब है, वो एक स्टार्ट अप हब है और मोदी जी वाला ‘मेक इन इंडिया’, ‘स्टेंडअप इंडिया’ वाला हब नहीं है। ये  वास्तविक, सच्चा स्टार्टअप हब है। आप एक तरफ रोजगार नहीं बनाते, एक तरफ कृषकों पर प्रहार करते हैं और दूसरी तरफ आप अपमानित करते हैं बेंगलूरू जैसे शहर के विकास को, कर्नाटक जैसे प्रदेश के विकास को।

मैं माननीय प्रधानमंत्री जी को याद दिलाना चाहूंगा विनम्रता से कि हाँ, ये शहर ‘SIN’ का है, लेकिन जो sin आप समझते हैं ये वो नहीं है। ये वो ‘SIN’ है, आप समझते हैं, आपके अनुसार ये एक बहुत significant insult  है, लेकिन वस्तविक रुप से ये ‘SIN’ है – Superior Information Technology और Novelty का, ‘SIN’. वास्तव में में ये ‘SIN’ है Super Highway का, I का IT और N का Network, ये समझने में बीजेपी, सत्तारुढ पार्टी असमर्थ है। उनको तो समझ आता है कि Internet वैदिक समय से था, जो मुख्यमंत्री बताते हैं, उनको ये समझ नहीं आता है कि बेंगलूरु इसका जन्म स्थान है। लेकिन मैं बहुत विनम्रता से कहूंगा कि आप हमको गाली-गलौच दीजिए, कर्नाटक के लोगों का ऐसे अपमान मत कीजिए, वोटों के लिए, राजनीति के लिए और इसके लिए आपको करारा जवाब मिलने वाला है, हफ्ते– 10 दिन में।

ये घबराहट, ये भय प्रमाणित है भद्दे मानहानि से भरे और फौजदारी मुकदमा करने के लिए उपयुक्त वक्तव्यों द्वारा। जानबूझ कर समुदाओं और धर्मों के बीच में एक खाई बनाने वाले वक्तव्य। हमने कल एक उदाहरण दिया, चुनाव आयोग को। मैंने उस डेलिगेशन का नेतृत्व किया था। जिस प्रकार से लिखा गया है – देशभक्तों के मर्डरर, उस विज्ञापन में और ऊल्टा चोर कोतवाल को डांटे स्टाईल में ‘कि सांप्रदायिक्ता कांग्रेस कर रही है’। जिस पार्टी के लोग अनंत हेगड़े जैसे व्यक्ति हैं, जो हमेशा इतनी अमृतवाणी करते हैं, वैसी पार्टी के लोग आज आरोप लगा रहे हैं, कर्नाटक के चुनाव के संदर्भ में, हमारे ऊपर।

उस विज्ञापन में मजाकिया बात ये है कि कांग्रेस अध्यक्ष राहुल गाँधी जी की छाया से भी घबराए हुए हैं बीजेपी के लोग। उसमें एक छाया दिखाई गई है और उसके बाद ये वक्तव्य बनाए गए हैं। तो मैं समझता हूं कि वो राहुल गाँधी जी की छाया से भी घबराए हुए हैं।

आज ये सब क्यों हो रहा है, ये सब हो रहा है इन कारणों से कि ध्यान आकर्षित करना है कहीं और, सच्चे, सही मुद्दों से ध्यान डॉयवर्ट करना है। लोगों को बरगलाना है, मूर्ख बनाने की प्रक्रिया चल रही है और वो कौन से मुद्दे हैं, जिनकी तरफ से ध्यान डॉयवर्ट करना है, मैं दो-तीन उदाहरण दे रहा हूं, ऐसे बहुत से उदाहरण हैं।

पहला कि कावेरी के विषय में, कल ही 24 घंटे पहले, आपको चेतावनी मिली उच्चत्तम न्यायालय से और आप असमर्थ सिद्ध हुए, जहाँ तक कर्नाटक के इंट्रस्ट का सवाल है। कल की बात है। ना आप समन्वय और संतुलन रख पाए, फैडरलिज्म के विषय में, कर्नाटक और तमिलनाडु के बीच में और कर्नाटक के इंट्रस्ट का सीधे रुप से, हानिकारक रुप से उसका ध्यान रखा है, जो कल उच्चत्तम न्यायालय ने उसके विषय में एक आदेश भी किया है।

उससे ज्यादा गंभीर जो घड़ियाली आँसू बहाते हैं आप, बड़ी-बड़ी इमारतों और प्रतिमाओं का उद्घाटन करते हैं आप, लेकिन जो दाग लगा है आपके दामन में,वेमूला से लेकर, ऊना से लेकर, अलवर से लेकर अखिल भारतीय स्तर पर, उसे मिटा नहीं पाते हैं और उसका सबसे बड़ा प्रमाण था कि कुछ हफ्तों पहले आप असमर्थ हे अपना पक्ष सही रुप से रखने के लिए उच्चत्तम न्यायालय के समक्ष। जिस कारण से SC-ST Atrocity Act के अंतर्गत FIR दायर करने के विषय में उच्चत्तम न्यायालय ने कई ऐसे आदेश दिए जो आजतक कि भारत सरकार की नीति के विरुद्ध है और उससे ज्यादा असमर्थ हुए आप कल। एक तरफ तो माननीय प्रधानमंत्री जी कर्नाटक में उपदेश देते हैं, SC-ST के बारे में और आप पूरी तरह से असमर्थ हुए SC-ST के उन विषय के उन मामलों पर उच्चत्तम न्यायालय से अपना मत बदलने में या बदलवाने में। उच्चत्तम न्यायालय ने वो मत कल नहीं बदला है। तो आपने गलती की और उस गलती को दोहराया। ऐसे कई उदाहरण हैं,जहाँ से आप ध्यान डॉयवर्ट करना चाहते हैं।

एक तीसरा उदाहरण है कावेरी के अलावा, SC-ST के अलावा। आपके खुद के RBI  जो सबसे एक शीर्षस्तरीय संस्था है, वहाँ के एक रिसर्चर का एक बहुत ही आंकड़ों से भरा हुआ रिसर्च पेपर आया है। अभी हफ्ते, 10 दिन, चार-पाँच दिन पहले। मैं quote कर रहा हूं, There is being significant deceleration in rural wages since 2014. ग्रामीण आय वेजिस में बहुत जबरदस्त कमी हुई है, 2014 से और आगे कहते हैं, वापस में quote कर रहा हूं, because of spell of high inflation growth in real wages has slipped into negative territory. Negative territory तो एक गंभीर आरोप होता है। क्योंकि आपको एक वास्तविक मिलने वाली आय तो हो सकती है 10 रुपए, 10 रुपए का मूल्य जो है, वो दोनों पर है, ये होती है negative territory और ये भी ध्यान आकर्षित या उसको डॉयवर्ट करने का तरीका है। जब आपने मनरेगा को आपने इतनी गालियाँ दी, मनरेगा के विषय में सौतेला व्यवहार किया। मनरेगा को कांग्रेस की स्कीम समझा, ये नहीं कि विश्व भर की सबसे ज्यादा, व्यापक, समाज कल्याण की स्कीम समझा, नहीं, कांग्रेस की स्कीम समझा। तो यही बड़ा गंभीर परिणाम होने वाला था, जो 2008 जैसे ग्लोबल स्लोडाउन में नहीं हुआ, ग्रामीण सेक्टर में हमारे देश में, जो 2010-11 में नहीं हुआ। लेकिन आज significant deceleration in rural wages.

अंतिम उदाहरण है कि पेट्रोल और डीजल के विषय में आपकी सरकार आने के बाद कच्चे तेल की अंतर्राष्ट्रीय कीमतों में गिर कर लगभग 66% to 67 % पहुँच गए हैं । ये तो हम सोच भी नहीं सकते, हम स्वप्न भी नहीं ले सकते। कोई भी देश विश्व का ये स्वप्न लेता है कि अंतर्राष्ट्रीय कीमतों में दो तिहाई गिरावट आए, 67% और उसके साथ-साथ पेट्रोल और डीजल की 2014 की बात कर रहा हूं, सिर्फ उसके बाद के समय की। साथ-साथ वहाँ 67% गिरावट है और यहाँ पेट्रोल और डीजल कीमतें 110% ऊँचाई पर हैं।  आज हम 4 साल से चिल्ला रहे हैं, रो-पीट रहे हैं, हल्ला कर रहे हैं, संसद के अंदर और बाहर कि कम से कम अब पेट्रोल-डीजल और हम तो कह रहे हैं कि रियल एस्टेट और एलकोहल को GST में डाल दीजिए। GST में तो हमें बहुत त्रुटियाँ मिली हैं, हम उसकी बहुत निंदा करते हैं कि आप 28प्रतिशत तक टैक्स कर सकते हैं और 18 प्रतिशत पीछे करते हैं, लेकिन 18 प्रतिशत भी जो आप का टैक्स लग रहा है पेट्रोल और डीजल, उससे तो बेहतर है। पेट्रोल और डीजल की कीमतें 110 प्रतिशत बढ़ गई हैं, जबकि अंतर्राष्ट्रीय कीमतें दिन-प्रतिदन गिर गई हैं।

 अब इसका क्या उत्तर है आपके पास? आप एकसाथ नहीं करना चाहते तो दो फेज में कर दो। कांग्रेस स्टेट थोड़े कर सकता है ये। आज आपने GST काउंसिल बनाई है, GST काउंसिल में सब स्टेटस हैं, अंततोगत्वा वहाँ बहुमत द्वारा निर्णय होता है। अब ये थोड़े ना है कि ये कांग्रेस स्टेट है, प्रणव झा और ये एक बीजेपी स्टेट है, इसने मना कर दिया तो वीटो कर दिया। वो तो सब लोग सहमति से लेते हैं ना निर्णय। तो आज आप ये कह रहे हैं कि हम केन्द्र सरकार हैं, GST काउंसिल हमारी है, लेकिन हम कांग्रेस रुल स्टेट के ऊपर डाल रहे हैं ये बात कि हम पेट्रोल नहीं कर सकते हैं। आपने उनकी कितनी बातें मानी हैं? आपने हर प्रदेश के वित्त मंत्रियों की कितनी बातें मानी हैं और कितनी बातों से आप असहमत रहे हैं? फिर भी कार्यांवित किया है ना आपने। हमारे तो आधे से ज्यादा प्रदेश कह रहे थे कि आप दिसंबर में कार्यांवित कीजिए। तो ये तो आप जानते हैं, बहकाने की चीजें हैं, लोग घास नहीं खाते हैं। आज कुछ भी हो, जब कांग्रेस ने इस मंच से, कांग्रेस का स्टेंड बता रहा हूं आपको, कि आप लागू कीजिए तीनों को GST में, तो कौन सा प्रदेश है, क्या फर्क पड़ने वाला है। ये कांग्रेस का स्टेंड है।

पाकिस्तान के ऑफिशियल ट्वीट से टिपू सुल्तान पर किए ट्वीट संबंधी एक अन्य प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि वहाँ से एक ट्वीट आता है और यहाँ से एक वक्तव्य से आता है, ये तो टेंडम वाला डांस हो रहा है और ये टेंडम वाला डांस मैं समझता हूं कि पाकिस्तान के हमारे बहुत निकट मित्र जो हैं, इतने दशकों से चुप रहे और टीपू सुल्तान के बारे में अचानक से उनको कैसे याद गया, ठीक कर्नाटक चुनाव के एक हफ्ता, 10 दिन पहले और उस याद आने के स्मृति के 30 सेंकड बाद। हमारी सत्तारुढ़ पार्टी की टिप्पणी भी पढ़ दी आपने, मैं समझता हूं, I rest my case, I leave it to the whole people of this country to judge for themselves. ये सस्ता है, ये सनसनीखेज है, ये शोभा नहीं देता है एक सत्तारुढ़ पार्टी को और जब एक सत्तारुढ़ पार्टी ये करती है तो मेरे शुरुआत वाले 3 F वापस हो जाते हैं- Fear, Frustration and Follies प्रमाणित हो जाते हैं, भय, बौखलाहट और गलतियाँ, दिन प्रतिदिन रात चौगुनी बढ़ रही हैं।

एक अन्य प्रश्न के उत्तर में डॉ. सिंघवी ने कहा कि उसकी बात थोड़े ना हो रही है, उनको मरे हुए 200 – 300 साल हो गए, पाकिस्तान को बने हुए आज 70साल हो गए हैं। 70 साल में जो चीज नहीं हुई, आप लोग ज्यादा जानते होंगे, आपकी संस्थापित स्मृति ज्यादा है, कभी हुआ हो, मुझे तो याद नहीं आता है।  

एक अन्य प्रश्न पर कि समाजवादी पार्टी के प्रवीण निषाद ने जिन्ना की तुलना महात्मा गाँधी जी और नेहरु जी से की है, डॉ. सिंघवी ने कहा कि जो कुछ भी ऐसा कोई करता है, किसी पार्टी का व्यक्ति है या पार्टी के बाहर अराजनैतिक व्यक्ति है, मैं बड़ा स्पष्ट कह दूं, मैं इस मंच से निंदा करता हूं, भर्त्सना करता हूं। जो आप उसका शब्द इस्तेमाल करना चाहें. किसी रुप से हमारे देश के वो आईकॉन नहीं हैं, ना माने जाते हैं और ना मानते हैं। लेकिन ये जो मुद्दा और कृत्रिम मुद्दा बनाया जा रहा है अलीगढ़ में, ये दो अलग चीजें हैं। आज कोई जय-जयकार नहीं करता है जिन्ना की, ना करने की आवश्यकता है। लेकिन ये बताईए मुझे कि ठीक चुनाव से 10 दिन पहले पुरानी 10 सों साल पहले एक तस्वीर किसी के यहाँ टंगी हुई है और कोई राजनैतिक दल उसके अंदर जाकर वहाँ तोड़ फोड़ करता है तो ये सीधा उद्देश्य नहीं है कि जानबूझ कर उत्तेजना फैलाए, प्रवोक करे, उसका एक मुद्दा बनाए। मैं अगर आज आपके आइडेंटिटी आपको याद नहीं दिलाता हूं, तो सबकुछ ठीक है। मैं अगर जानबूझ कर घूंसा मारकर कहता हूं तो ऊल्टा आपका विपरीत रिएक्शन होता है और वो विपरीत रिएक्शन निकालने के लिए ये सब चीजें की जा रही हैं। दो अलग-अलग मुद्दे हैं।
