100 days are left for the Lok Sabha elections to take place, and PM Modi has suddenly woken up to the fact that the GST implemented by his Government is poorly implemented.

The Congress party which was the original proponent of the GST, has been hammering the fact from day one, that the GST implemented by the Modi Govt is NOT ‘One Nation, One Tax’ but ‘One Nation Seven Taxes’ with rates as – 0.25%, 3%, 5%, 12%, 18%, 28% and 40% (which was later shelved) and possibly more!  Congress President, Shri Rahul Gandhi has been at the forefront of demanding a SINGLE Tax Rate for GST- not exceeding 18%. Congress party leaders had been demanding the same since 2015, but Mod Government did not listen to the voice of people.

After a deep slumber and when the alarm bells for the BJP have started ringing in the Hindi heartland, PM Modi has suddenly woken up. In a media conclave, yesterday, he has ‘hinted’ that 99% of all items would be taxed at 18% or at less. This is still a ‘HINT’ and NOT a ‘DECISION’.

Since the rollout of GST from July 1 last year, the GST Council has undertaken four rounds of rate rationalization — October 6, November 10, January 18 and July 21. Thanks to Gujarat elections, GST rates on many items reduced from 28% to 18% and Thanks to Gujarat elections, Modi Govt was also forced to heed advice of the Congress party and experts on flaws in implementation of GST.

It is important to note that the back in 2017, before the flawed implementation of a poorly crafted GST, the Chief Economic Adviser to this government had clearly recommended a GST rate of 15-15.5 per cent and demonstrated that it was a revenue neutral rate. But an arrogant Modi Government drunk with power, refused to heed to its own CEA. Infact, a midnight celebration of enforcing taxes on the people of India was held by the Modi Government in Parliament.

Flashback on PM Modi, FM Jaitley & their Govt’s statements on Congress’ rightful remand of ‘One Nation, One Tax’ Rate for GST:-

1. On July 1 2018, on the first anniversary of the flawed implementation of GST. Finance Minister argued that the idea of a SINGLE tax rate GST is a ‘flawed’ one.

He wrote and we quote

“Rahul Gandhi has been advocating a single slab GST for India.  It is a flawed idea.  A single slab GST can function only in those countries where the entire population has a similar and a higher level of paying capacity.  Being fascinated by the Singapore model is understandable but the population profile of a state like Singapore and India is very different.  Singapore can charge 7% GST on food and 7% on luxury goods. Will that model work for India? Since GST is a regressive tax, the poor have to be given a substantial relief.  Thus most food items – agricultural products and the Aam Aadmi used products have to be tax exempt.”

We want to ask Shri Arun Jaitley- What changed in the past 5 months, that now the Modi Govt is forced to adopt the ‘Flawed Idea’ of Single Tax Rate? Was it the absolute drubbing they received from the hands of the electorate in 5 states or was something else?

2. In July, this year, PM Modi exhorted that “Milk, Mercedes can’t be taxed at single GST rate.”

He said “Can we have milk and Mercedes at the same rate? So, when our friends in Congress say that they will have just one GST rate, they are effectively saying they will tax food items and commodities, which are currently at zero or 5% at 18%,”

We want to ask PM Modi, what forced this stupendous reversal & roll back!

3. In July, this year; Union Finance Minister Shri Piyush Goyal stated that the demand for a single rate in Goods and Services Tax (GST) was a ‘ridiculous suggestion’. He also found it amazing when the demand for a single GST rate is raised.

Unfortunately, what Mr Goyal seems to forget is, the same government, which he represents, had at midnight on 30 June 2017 launched GST as ‘One Nation, One Tax, One Market’.

4. On Nov 29 2017, during the Gujarat Election Campaign, PM Modi made an outrageous remark stating that Congress President, Shri Rahul Gandhi’s demand for a Single Tax rate in GST is “Grand Stupid Though’. Acronym Expert, Modiji is however not an ‘Economic Expert’. Yesterday he almost forced to concede to Shri Rahul Gandhi’s demand.

‘Modi-nomics’ is the art of backstabbing people with flawed economic decisions, ruining their livelihood with unwitting announcements, stealing their jobs with economic mismanagement and forcing the small businesses to shut down by unleashing economic anarchy.

A latest survey by All India Manufacturers’ Organization (AIMO) points out that – Traders and micro, small and medium enterprises (MSMEs) across the country have reported steady job loss and declining profits since 2014 and demonetization, the roll-out of GST are among the reasons for the slowdown. The survey reveals that the operational profits of traders across the country have dropped drastically by about 70% since 2014. It underlines that the job loss were reported at the rate of 43% in the trader segment, micro-segments reported job losses of 32%, small segments reported 35% and medium-scale industries reported 24% job losses.

To a question on alliance, Dr. Singhvi said, No, I don’t agree with your analysis.. These are early days. We are in December. There is no question of stitching alliances, closing doors or opening doors. I think that level of discussion and interaction has now started. Certainly you are right in saying that there is an understanding on alliance  of some sort between two parties in UP. That is not to say that we have been or other parties have been part of that process at the moment. That is neither to include nor to exclude. At best you can say this issue is open. I can only say that in the near future and in the coming months and weeks, You will find that though at the moment no initiative, no formal talks, no semi-formal talks have happened. Everybody here realizes the importance of minimizing and preventing vote  division and you have to wait for the story to unfold in January and February. I think this is premature to come to any conclusion yet. I am not saying in the affirmative or in the negative.

To another question, Dr. Singhvi said, the Congress Party is certainly keen and ready to be part of any secular, non-communal, reasonable alliance, understanding, adjustment by whatever name is called, I do not like the words ‘Gathbandhan’, ‘Mahagathbandhan’ or ‘Mini-gathbandhan’. But, Yes it is – provided (a) it is respectable (b) it does not cause harm not only to the other parties but also to Congress Party and (c) it is effective in preventing vote division; that is the mantra of getting together but we are now talking of a process which has not yet started. We have neither been included nor been excluded.

On another question on Uttar Pradesh, Dr. Singhvi said, I did not say ‘keen’ on alliance; I said we are open to give an alliance provided these conditions are met.

To a further question, Dr. Singhvi said, let us not mix up social courtesies with political decision making which is a hard, solid, reason, logic decision making. I do not know his programme, I cannot say whether I will go there or not go there but I can certainly tell you that the Congress Party, Shri Rahul Gandhi and Smt. Sonia Gandhi in particular have maintained the highest levels of social courtesies of all kinds of proper conduct and what to talk of Mayawati Ji  and Akhilesh Yadav Ji and their respective parties. Even those who are antagonistically opposed to us, which these parties are not really in any major sense, even there we have maintained these  social courtesies.

To another question, Dr. Singhvi said, these are matters of detail. You know what                  I mean, you have to allow that process to unfold and let me tell you today it remains the BJP and Shri Modi’s biggest terror that different state-wide adjustments, understanding, alignments will happen. This does not mean that there is some kind of an all India big word which you are using but state-wide, state-level, constituency wise, and region level and that is the biggest terror which the BJP and Shri Modi are reeling under.

On another question, Dr. Singhvi said, I can’t use an unqualified word like ‘support’. It is definitely an improvement. It is definitely taken care of some of our concerns and I cannot hesitate but say that it took a long time for them to realize the correctness just like it took three years to realize the correctness of our GST rate which I have just spoken about. There may still be some teething problem. We will look into details but if it is otherwise Okay, we are prepared for constructive action, I can’t say ‘support’ at the moment but we will look into.

To a further question on Privilege Motion, Dr. Singhvi said, I think there are lots of ifs and buts. There may be lot of ifs and buts there because we do not have the report yet. The last I heard is lot of different viewpoints given in the Committee. That is only on the basis of newspaper reports. I think that matter is important as this, will come to Parliament in a very reasoned long debate when we get the time but the basic point which appears to be staring in the face as to what extent people support something which appears to be discriminatory and to what extent that discrimination is based on religion. These are issues of law, constitutional validity of logic of reason as we have seen to go into it. Certainly there are lots of parties here who might not want to react to discriminatory or region based distinction.

On another question related to the no electoral victory, Dr. Singhvi said- I agree with you that no electoral victory and no electoral defeat, it is a single point agenda or a dual point result. To that point agree. It is not that you win or lose by only point A or only point ‘B’. But, let me tell you that the General Akrosh anger resentment against the Government is based on multiple factors and the cumulative impact of that is important, two of which contributing in a big way for cumulative impacts are certainly GST and Demonetization.

Let me flip your point the other way round. There is no major victory by them except in UP. By which time actually the effects of these two had not really pended it out. Gujarat was a whisker. They were ultimately not able to get majority in Karnataka. Tripura, yes they made gains. Across the country, they have lost many elections after that. Do you think, Goa was a victory? Do you think Manipur was a victory? Gujarat technical victory, technical knock out. Even the BJP does not consider it to be a victory. Karnataka, these three states, so as the effect unfolds, people realize the true effect of these.

On a question related to UP Elections, Dr. Singhvi said- it is not a question of waiting. These are hard issues of logical concentration. They take time. You can rest assure that if it is so to happen, it will happen within a reasonable time frame. Let me not speculate on this. But by the end of the day, if things don’t turn out, we are a national party; we have fought elections on our own. In U.P. we will fight fully and totally but, we would like only because it should not benefit by vote division to the BJP. That is the basic object of trying to lean over backwards in getting the best for the country.

Because we find that the Modi Government is providing repeatedly escape clauses for inaction and non-action, providing flimsy and sad excuses for inaction whenever they want to protect their “collaborators in violating the constitution”. One of them is the CVC, the government selectively and discriminatorily expresses helplessness in taking action and I want to share an example of that because unfortunately in this particular example the CVC has become, not only so well called earlier from this podium a collaborator with the government for violating the constitution (CVC), but now again CVC which is a “colossal veil to cover corruption”.

There is a very detailed complaint of over 1,000 pages by one IFS Officer Shri Sanjeev Chaturvedi. He has attached 1,000 pages of documents, detailed complaint more than 1.5to 2 years ago, listing with great detail the attempt to stall, cover up, not allow to proceed a Rs. 7,000 crore allegation of corruption relating to infrastructural work. This written complaint submitted by him in 2017 (roughly in July 2017) and thereafter he has given regular reminders in August 2017, in January 2018. He has written later in the 2018, he has sent to DoPT, to the PM, the President saying that the CVC Shri Choudhary acted so as to not act and protect further action in this Rs. 7,000 crore infrastructural corruption scam.

Now that is on the merits, we are not concerned with that. The question I am asking is, that on this complaint you should take action against CVC for not taking action despite proof in this scam. On this the Government does what? no wonder, you scratch my back, I scratch your back. So, the Government sleeps, does nothing. July 2017 onwards is complaint that you are not taking action, you are blocking legitimate complaints, you are not looking into it, the CVC as you know is the mega policemen, the watchdog on corruption and if this Rs. 7,000 crore allegation does not lead to enquiry by CVC, where does the complainant go? So, the Government instead of acting on Mr. Chaturvedi’s complaint, takes absolutely no action. 6 months passes, a year passes, almost 1.5+ year pass and now they come up with this remarkable defence after almost 2 years or under two years that we have not yet framed guidelines and no guidelines exist which permit us to take action against the CVC. This is the official explanation, delightful explanation by the Government of India published by all of you a day ago, a couple of days ago.

Dr. Singhvi further said I think this is a long yet another very clear example of how this Government has demeaned, devalued and weakened every Institution. That list is rising every day. One day it is the CBI, one day it is the CVC, one day it is the CBDT. Just yesterday my colleague has told you, he has told you how a remarkable order is passed; I wish all of you could have that benefit- I really wish I do not think any of you or anybody I know, against whom this government is proceeding has done this. I am repeating of course, but it is a very small repetition.

A man who happens to be the brother-in-law of a powerful CBDT Chairman. The CM of our biggest State in India writes have a SIT, the SIT is under proceedings, it is written a SIT must sit. Within one week of this order, suppose I put SIT against you, can you ever imagine one week after an order is passed, please maintain status-quo on that SIT? It is passed because of brother- in-law? Is it passed because these are powerful people who are blue-eyed boys and favourites of the Modi Government? According to Modi Government all wrong in this country is done by the opposition leaders and opposition parties. जहाँ तक भाजपा के कार्यकर्ताओं का सवाल है, या सरकार के जो गलत काम करने में सशक्त हैं, उनका सवाल है, वो कोई गलत काम नहीं करते और उनके विषय में कोई भी आरोप, कोई भी प्रोसीडिंग, कोई भी सीबीआई, कोई भी सीबीडीटी, कोई भी ईडी नहीं होगी।

Therefore, this is the over-all picture and nexus which we want to expose before you. We want to tell you that this is become yet another colossal veil to cover corruption rather than be a corruption watch dog and policeman. I think it is most deplorable that such very high level statutory institutions have been brought to such a passé and entirely by this government which has absolutely no regard for law or convention or principle.

On a question that the application by the government on the Ram Mandir issue,       Dr Singhvi said- We have nothing to do with this matter which is yet to come up in court, the court will decide, application will be allowed, application will be dismissed, application will be modified, that is between the Supreme Court and the applicant. I want to say only two or three points and you will draw your own conclusion, the country will draw its own conclusion and this is all lost because people do not look at facts unless they are underlined. What is important is that this application is moved on 29th of January 2019, 16 years afterwards – in a matter of 2003 where the main writ of 2003 is pending. In that an Interlocutory Application (IA) is moved or an application is moved, it seeks in the prayer a modification of an order already passed by the Supreme Court 16 years ago on 31 March 2003.

That order says that while the main title dispute of Ayodhya is being decided or is subjudice or is yet to be decided, till such time as it is finally decided, a status-quo will be ordered and maintained on all land including land which is so-called undisputed and acquired by the Central Government  namely Central Government which has maintained status-quo. This status-quo has been continued for 16 years. Suddenly and I am certainly no soothsayer, you will know it better, whether it is because of election or some other reason, we do not know. 16 years later, they say please give me permission two months before elections to give that land to anybody and for that purpose please modify that order. So, I have given you the facts, you judge for yourself. Ultimate judge is the Supreme Court.

Dr. Singhvi said we do not have an opinion and we do not intend to have an opinion on an application by you to be decided by the Supreme Court, Why should I have an opinion? You have to ask this to the Central Government that moved it after 16 years and you have to wait for the Supreme Court to decide.

On the question of purpose for acquiring the land, Dr. Singhvi said which is why the purpose of this application should be equally clear to you.

Highest ever reduction in number of poor below the poverty line happened during the UPA- I and the UPA II and you know it, more than Mr. Javdekar, all of you know it. Now what he has done is, because one report has come now and I am not suggesting it that there is no poverty reduction after 2014, I am not like Mr. Modi or his government; I am not like them that I will say that there is no poverty reduction after 2014 to 2018. It is very good for the country that poverty reduction is a continuing process but to suggest that ये पावर्टी आपकी हमारी या ये हमने किया, गरीबी हटाओ तक पहुंच गए वो। मैं ये भी दावा कर रहा हूं उन्होंने एक फ्रेक्शन रुप से भी 2014 और 2019 के बीच में वो एक फ्रेंक्शन भी रिडक्शन नहीं किया है जो हमने 2004 और 2014 के बीच में किया है और मैं आपको चुनौती दे रहा हूं।

On a question about the MLAs of ruling Aam Aadmi Party – has said that there is delay in the appointment of Lokayukt, Dr. Singhvi said you have to ask them, how you are asking me? There is an Act, there is a Lokayukt, the Lokayukt is appointed in consultation with the state government, I do not see any reason why this is not being done. There is only one reason I can think of; something to hide. I do not see any particular logic in this but it is really something which you have to ask the AAP as to give you a logical reason for this. It is only a submission of a return and as the Lokayukt has said if Judges and other people are submitting to the Lokayukt then it is very difficult to believe that MLAs are refusing to do so enmasse, as if they are under some kind of a genera instruction or direction or diktat.

On the question of on-going alliance in Karnataka that Sidaramaiah has to give a statement, Dr. Singhvi said I think there are cases of individual strains and sometimes it may happen but there is absolutely nothing of the seriousness as it is made out in the Press. There are strains because some individual may say something but it is not an institutional response. what is much more serious in is Karnataka is the kind of absolute extinct perverse statements you are hearing from sitting Union Cabinet Ministers of the BJP from Karnataka. That is really what you will call perverse.

Dr. Abhishek Singhvi said as I have told you already this is going to be a fight of Modi Vs India. This is now a fight of Modi’s ‘Thagbandhan’ with the ‘Janta’s Janbandhan’. When I heard the Hon’ble Education Minister talking of anarchy after Modi and after us namely the Government, I was reminded of Emperor Louis the XV famous remarks his wife made it “Apres nous de luge” (after us the deluge- the flood !). We all know what happened to King Louis XV and his wife they lost the war, they were completely insulted and thrown into the dustbin of history.

Today, all of the BJP the   Ministers, every part of that organization is running around trying to fulfill the I, Me, Myself syndrome of one man. They are, therefore, forced to become court jesters and Yes, puppets because I, Me, Myself must be freed out net and that is the reason behind remarks like ‘After us Anarchy’. Before us there was anarchy for 60-70 years, we have ruled only for 4-5 years now and a few years earlier. After us there will be anarchy! It is this arrogance of power this completely misplaced sense of infallibility, indefeasibility and arrogance which led to, you all know what happened to ‘Humpty- Dumpty’ and what fall he had. Incidentally, since political memory is short, we need to remind ourselves starting very recently in this term itself that is why we are awake at the mastery at which the Prime Minister misleads the Nation, making casual comments, poking fun at alliances- understandings, seat adjustments, using politically cheap words for them- forgetting that he has just come out of the world’s most unholy alliance in J&K. I repeat the words, the most unholy alliance. And not only did he enter into the world‘s most unholy alliance, he ditched the alliance midway after running for four years two Governments – one in Jammu and one in Kashmir. It is this Prime Minister, this BJP which is lecturing us, sermonizing us on alliances. Of course, we cannot expect their memory to go back from 1977-79 when they were very happily in alliance with Left, of course, that is Mr. Modi’s dictionary called unholy alliance.

They forget the alliance of Vajpayee had and, of course, they want to forget although they themselves are in alliance of many-many parties. Those parties are now scurring up to desert a sinking ship. 14 have left and the queue to leave is getting longer by the minute as we speak. So, friends, if Mr. Finance Minister is right about legacy of chaos, and if the Hon’ble Education Minister is right about lack of vision and legacy of chaos, well, then there must have been chaos in J&K earlier with Vajpayee Ji, earlier in 1977-79. All this is done because there is genuine terror in the hearts and minds of the BJP and its factotums around the Prime Minister downwards. The genuine terror arises from the unprecedented rainbow coalition. The convergence of political forces opposed to this rotten dispensation which gathered recently at Kolkatta which has led to terror, fear and absolute panic in the hearts and minds of the BJP and the Prime Minister and obviously to cover such blunders as in the Farm Sector, as in the denial of jobs and as in scams like Rafale, as in mid night knocks and tax terrorism, as in misuse of agencies etc. that these remarks bespoking at attempts to form alliances are being made.

Friends, our second point is of course, relating to the great friend our friend Mehul Bhai. Mehul Bhai Choksi! It now appears that Mehul Bhai is not going to be friends anymore because he has decided not to ever return to India, his Indian passport stands surrendered. And the Antigua citizenship having come, we want to juxtapose that with the earlier and the recent statements not once but by innumerable times by the Prime Minister, by his colleagues about getting him back in ‘X’ days ‘Y’ days.

! Utter hypocrisy and again misleading the people of this country again, why, to hide hard figures because hard figures are not contradicted by ‘Jumlas’.

One hard figure and a single hard figure tells you the whole story – in one year 2017-18 bank frauds in this country have increased by 72% and I personally took a briefing some weeks ago and there is yet no answer, no clarification. These are Government figures; we do not run a Government publication agency. The total debt of India has risen 50% from Rs. 54 lakh crore to Rs. 82 lakh crores. This is the hard figures based reality Vs Modi Ji’s ‘Jumlebazi’.

The third and last point I quickly want to touch upon friends is this whole approach to governance, as governance by subterfuge, governance by cheating the people of India, the governance by being over clever, too clever by half – an example is now published by you and has come to light. One way is to appoint wrong people by using your brute majority when the Prime Minister, a Cabinet Minister and a third person, be the Chief Justice or a third person is in a Committee and we have seen some very bad examples of that. All the opposition leaders e.g. we see in some bad examples that we see in CVC and CBI but now Modi Ji has found a better way – why bother about selection committees because selection committee at least has list of the opposition. It may have a Judge or Chief Justice. It may have someone else. So, she has avoided Lokpal for all, these years in Gujarat and here.

He has found a new way. The new way is to instruct his departments of the government of India who constitute the search body to put in the first place before the selection committee names which are skewed which exclude the eligible and the desirable and include the undesirable and the less intelligence.  So, the pool which you have to select from automatically gets distorted and skewed. Well, what happened here was we know have a statement from the people that a number of persons who were very keen and apply, their names were not included by the search departments of the government of India, not put in the first place before the selection committee which selected the Information Commissioners and the CIC and mind you the selection itself was done after delays of months and keeping the post vacant for many-many months and reducing the Information Commission to a cripple. So names of persons desirous of applying in writing excluded by whom, by government departments – obviously at the instructions of the I, Me Myself Mr. Modi and then the names of those who have not even applied included. Those names also you have in the press today. They have said never applied, I was not even knowing about this but either because someone was close to a Minister, someone had been in the Minister’s personal staff and someone has other direct obvious link known to all of you, his name is put by the search committee or the search group. Obviously the pool of those whom were to select gets skewed. This is the true chaal, charitra, chehra, the true ‘pehchaan’ of Mr. Modi and his Government. We have given three concrete examples. For all three of them manifest the basic approach to governance by subterfuge, governance by ‘Jumlebazi’, governance by misleading this nation.

Kumaraswamy has said that Ms. Mamata Banerjee has all the capability to be the Prime Minister of the country, Dr. Singhvi said Mamata Banerjee had said yesterday that and many other leaders on the dais said so, I do not think Mr. Kumaraswamy means what you are trying to imply that to me. All of them said in my presence that matter of Prime Ministership is deliberately is a red-herring created by the BJP. We have many PMs but we all have a very-very strong discipline amongst us common objective which will enable decision of Prime Ministership after the figures are out. This is such a simple; straight forward sentence Shri Rahul Gandhi said so, Ms. Mamata Banerjee had said so. So many others have said so.

So, merely because the BJP tries and Mr. Kumaraswamy was there and I think he has absolutely no problem with this. So, I think he should take it in that context.

To another question on Karnataka MLAs, Dr. Singhvi said there is no fighting. I think the BJP stands exposed. The official version which we have heard it, somebody suffered a fall. This is your version, I don’t know about it but let me tell you one thing Yes, you can ask us in jest or in seriousness but will you ever ask the new definition of politics in the last few years in every State that the BJP by sheer money power and the rates in Karnataka are frighteningly high is going around state after state, sour grapes having lost the elections trying to bribe MLAs. It is an open secret – your questions are based on that. Now what is that display of about a political party is ruling in the country. It is openly trying to lure MLAs; we have heard of it in Tamil Nadu, we have heard of it in Karnataka, we have heard of it in Karnataka earlier, we have heard of it in Gujarat, we have direct evidence virtually. There are five more States I can name – what about the bribe givers of the alleged bribe given or the attempted price given?
